Dear Esteemed City Council Members,
As a resident of Cupertino for more than 30 years, I am writing to you today to voice my concerns about the
proposed Regnart Creek Trail. While I understand and agree with the intent to find safe routes for young bikers
and walkers to get to school, I don't agree with the bicycle commission that the creek trail is a safe route.
When all the options were evaluated, the first criteria, was not safety, it was "off street". None of the on
streets alternatives were evaluated to determine a safe route. The creek is a drainage ditch with steep cement
sides and fast current when water is in the creek. It would be a hazardous place to allow our children to access.
Traffic volume on cross streets during school commute hours, the time when children would be trying to get
across those streets, has not been evaluated by the bicycle commission. No numbers of expected traffic, either
on the trail or on the streets have been presented. This is a major element to consider in determining the type of
crossing and the effect it would have on riders or automobile traffic. City Council should have the facts in order
to make data driven decisions.
Additionally, we are told, the trail would be closed when there is fast moving water, and before dawn or after
dusk, which means it would not be usable for school commutes or library visits, several months of the year. No
alternative has been proposed for those times. Improving city streets for bicycling kids is not being considered
by the commission, but would be necessary even with this off street trail route. We need a safe alternative to
the proposed creek trail.
I'm also concerned that no environmental report has been completed. The creek is home for many animal
species. Opening it to public access will mean the loss of their habitat. It takes only a cursory look at what is the
"improved" trail between East Estates Drive and the Creekside Park to see the damage to a wildlife refuge.
These are a few of my many concerns. I would be happy to discuss more issues with this plan if any Council

Subject: Bike Pedestrian Trail From a CYCLIST Perspective
Council Members,
I am a resident in the neighborhood of the proposed path and an avid cyclist and bike commuter. My
husband and two daughters bike as well.
I commute on bicycle through Cupertino/Sunnyvale several days a week, and also in San Francisco.
My experience has taught me what works for bike safety and what does not. Visibility is the safest
cheapest and best course of action in creating and maintaining bike lanes. The more visible the
cyclist is on the road to the drivers the safer the cyclist is. Thus, I think the best use of resources for
bike safety is continuing to create bike lanes and paint them GREEN. I have the least problems with
cars cutting me off and swerving towards me when I have a brightly painted green bike lane. When
this is not an option the white bike path marker in the lane is second best.
There are three main reasons the proposed path is unsafe as planned:
1. It is not wide enough to safely accommodate both bikes, runners, dog walkers, and strollers. There
is simply not enough room. Although a path would be nice squeezing it in where there is not adequate
room is not the answer. UPDATE: I was made aware at the meeting on April 24 that there will not be
an 8 ft. chain link fence but instead there will only be a 42" split rail fence for some (very few) sections
of the trail. I want to be clear this makes for a very unsafe trail for cyclists because there is no room
for error. If a child or dog runs in front of a cyclist they have no where to go, and if a bike hits a 421,
fence the bike will stop and the biker will continue with the momentum and flip over the fence. In this
case likely landing at the bottom of an 8-10 ft drop. I have included pictures I took at an existing trail
with a split rail fence that is the approximate height of the proposed fence. I have included a
measuring tape in the picture and my personal road bike against the fence to demonstrate the size
comparison.
2. The path crossing at Blaney Rd. is particularly unsafe because of impact on the current bike lane
that is used by many cyclists. The current bike lane on Blaney Rd. will be squeezed out to
accommodate the path crossing much like the barricades/barriers that were put on Portal just north of
Stevens Creek in Cupertino. These types of bump outs for paths push cyclist commuters like myself
into the traffic lane with little warning to the vehicles traveling in the lane. These types of bump outs
are unsafe and will deter cyclists from commuting on Blaney which in the past has been a safe bike
route. It will push more cyclists to DeAnza and Miller/Wolfe Rd. UPDATE as of meeting on April 24: 1
did speak with John C. the trail designer(?unsure of his last name or title) and was told that the bump
out would not take away the bike lane, but instead that the bike lane would remain a 5 ft. bike lane on
both sides of the 11 ft. lanes for vehicles. I am unsure if there is actually space for this. I have been
told that the roadway from curb to curb was measured at 39 ft. and 11 in. if you take away the 11 ft.
each for vehicle lanes and 5 ft. each for bike lanes that only leaves 7 ft. and 11 in for the bump outs
which means they would have to be just under 4 ft each. I do not know if the plans specify the size of
hte bump outs. AGAINj I am concerned about the existing bike lane and the ALREADY APPROVED
Class 4 bike lane that will go in on Blaney Rd. and there being adequate room for existing bike
commuters. This trail is not worth dirupting an already well used bike commute path that is safely
keeping cyclists off DeANza and Mlller/Wolfe.
3. The path crossing at Estates Dr. is unsafe because there is no visibility for the vehicles
approaching the crossing to see oncoming cyclists because of the nature of the residential areas,
houses are in the way. This area is already congested at school open/close times due to the high
number of students that commute through Creekside park. Adding another route that is not visible will
cause even more confusion for drivers which leads to an unsafe area for cyclists to travel. I know
specifically about this area because this is where my house is. I have witnessed near misses in
this area on the narrow path between cyclists and pedestrians and on the road at Vicksburg between
cyclists and vehicles.This path will put three four-way intersections in less than 100 foot of each other,
hence the confusion. If you have not seen this area I invite you to come and observe traffic flow
during the 7:30-8:00am time frame.
For these three main reasons the proposed path is unsafe and should not be pushed forward without
further inquiry into bike safety for current commuters. UPDATE: I am speaking specifically to
Alternate 1. 1 believe alternate 4 and 5 provide safe modes of travel for bikes and pedestrians. And I
would like to specifically address concerns I heard at the April 24 meeting. There was one resident
that stated when biking on Lamar Drive he was almost hit by a car from a cross street. First, there are
no cross street each of the streets off Lamar from Blaney to Estates only come from the south.
Second, other than the first street east of Blaney NONE of the streets have yield or stop signs
because there is so LITTLE TRAFFIC on these residential streets. If this is used as a bike commute
path yield and/or stop signs should be put in at the intersections of each of the south side streets.
Also there is no need to turn a residential street into a Class 4 bike lane as suggested by (I believe
one of the bike commissioners) another speaker.
IF this path is going to be created then it needs to be done in a way that is safe for those already
commuting and those that will use the path and the current proposal does not adequately address
safety concerns.

Honorable Mayor Scharf, Honorable Vice Mayor Chao and Councilmen:
With an earlier start time, I may not make it from work in time for oral comments. In reading the Capital
Improvement Program material, I had several questions that I hope staff can answer to provide additional
context to help prioritize the many projects listed. I hope you will find these questions helpful.
1. Citywide Building Condition Assessment. Seismic Condition. I am trying to understand the current condition
of City Hall and the extent of the safety improvements that are needed. If a seismic study was conducted, did
the report provide a Probable Maximum Loss (PML) number or Scenario Expected Loss (SEL) figure? PML
and SEL are industry standards used to evaluate the engineering integrity of a building by institutional lenders.
Are the figures under 20? If so, the building is viewed as safe. If the building is currently unsafe, how extensive
are the proposed retrofits? There is a proposal to almost double the size of City Hall, is the thought it is less
expensive to scrape and build new versus to retrofit?
2. Elevators: City Hall is two stories and I would guess that 90% of the time people use the stairs. Thus, the
elevators are lightly used, extending its useful life. What do the repairs involve? Cab, mechanicals, controller
and electronics, power unit, door operator? How old is the elevator? Is it under a maintenance agreement? Most
riders will be unable to tell if there is anything new in an elevator, despite having spent a lot of money. Is the
cost due to the proposed addition of 20K square feet?
3. Generators: Emergency generators are often lightly used and have a long useful life (30+ years). What is the
reason to replace the generator?
4. Library Expansion - The cost of $ 1 OMM for 4400 sf comes to $1,283/sf, 3x the cost of commercial
construction. Why is the addition so expensive, especially when it is for additional meeting space?
5. City Hall construction Costs: At $68MM for 40,000 sf, this comes to $1,700/sf, again far higher than
commercial construction costs. Even allowing for underground parking, the costs seems high.

In the Staff Report that will be presented at this meeting, the full community survey that ended 4/26/2019 will
not be included. I request that you review the updated results prior to making any decisions. I have attached
the downloaded .pdf report and the email from opengov.com that provides a link to the survey document as
of 4/26/2019 @ 5:04 p.m. (survey closed on 4/26/2019 @ 5:00 pm).
If you refer to page 6 of the summary report, this will show the Individual Registered Responses. Curiously,
there is only 1 response prior to 4/22/2019 when this survey was opened to the public (see screenshot below
with the survey Post Date: 04/22/2019 5:38 pm). I question the staff report that indicates 58 responses were
received to the online Open City Hall survey from 4/12/2019-4/22/2019. Why are these not included in the
formal report? You should ask. Could be a problem with opengov.com reporting. Note: The opengov.com
report does not include the responses for Question 3: What additional funding options would be supported
for the CIP.

Subject: Is it lawful for Council to review the Capital Improvement Program when the Planning
Commission has not held a public hearing or made its recommendations?
Honorable Mayor Scharf, Vice Mayor Chao, and Council Members Paul, Sinks, and Willey:
Please include this item as part of the public record for the 4/30/2019 Council meeting, Agenda Item 4
"Review the Proposed FY 2019 -2024 Capital Improvement Program".
It seems the Council continues to work too hard, while the Planning Commission is denied its
authority to hold hearings and make land use recommendations.
Why does Council review the Proposed FY 2019 -2024 Capital Improvement Program this evening
(Agenda Item 4) when the item has not been presented to the Planning Commission for its
consideration? Yet, 3 Planning Commission meetings were cancelled in 2019 for "lack of business".
Please reference item C below in Cupertino Municipal Code 2.32.70 Planning Commission Powers
and Functions:
The powers and functions of the City Planning Commission shall be as follows:
A. Prepare, periodically review, and revise as necessary, the General Plan;
B. Implement the General Plan through actions including, but not limited to, the administration of
specific plans and zoning, subdivisions, and sign ordinances;
C. Annually review the capital improvement program of the City and the local public works
projects of other local agencies for their consistency with the General Plan (pursuant to
Sections 65400 et seq. of the California Government Code);
D. Endeavor to promote public interest in, comment upon, and understanding of the General Plan,
and regulation relating to it;
E. Consult and advise with public officials and agencies, public utility companies, civic,
educational, professional, and other organizations and citizens generally concerning implementation
of the General Plan;
F. Promote the coordination of local plans and programs with the plans and programs of other
agencies;
G. Perform other functions as the City Council provides including conducting studies and
preparing plans other than those required or authorized by state law;
H. Establish as needed a standing subcommittee of the Commission for Design Review. The
Planning Commission shall decide appeals of the Design Review Committee for the purposes of
conducting design review on projects that properly come before the Design Review Committee for
review, and conduct design review of a project as required by Chapters 2.90, 19.132, 19.134 and of
the Cupertino Municipal Code.
(Ord. 1844, § 1 (part), 2000; Ord. 1787, § 1 (part), 1998)
note that the Planning Commission last reviewed the Capital Improvement Program (FY 2018 -
2023) on 5/8/2018 in preparation for a 6/5/2018 Council meeting. I note that the Staff Report for
Agenda Item 4 for the 4/30/2019 Council meeting makes no references to recommendations offered
by the Planning Commission regarding the Proposed Capital Improvement Program (FY 2019-2024).
Please follow the intent of the Cupertino Municipal Code to require the Planning Commission to
review the Capital Improvement Program to support the adoption of a final program that conforms
with the law. Postpone Agenda Item 4 "Study Session on the Proposed FY 2019 - 2024 Proposed
Capital Improvement Program" until after the item is heard during a regular Planning Commission
meeting and after the Planning Commission is given sufficient time to study the proposed Capital
Improvement Program to make its recommendations. Please ensure that the Staff report for the
"Study Session on the Proposed FY 2019 - 2024 Proposed Capital Improvement" Council agenda
item includes the Planning Commission's recommendations. Furthermore, as "Sustainability" is called
out as a priority in the Staff Report, maybe the Sustainability Commission could also review the
Proposed FY 2019 - 2024 Capital Improvement Program and offer its recommendations prior to the
return of this item to Council.

Dear Mayor and Council members,
I reviewed the 5-year CIP projects report for Study session today and here is my feedback for your
consideration.
1. Library expansion - About 900,000 visits have been made to the library in 2018. The
OpenGov survey results show that large percentage of respondents prefer investment in the library. So
investing in library expansion would have a wider impact to the community of over 60,000 residents. However,
the cost projections of $10 million for 4400 Sqft of expansion plus 33 additional parking stalls seems to be too
high. The city has to explore cost effective ways to expand 4400 Sqft. The library expansion is included in
Options A and B. This should also be included in Option C that leaves $3.15 to be allocated for other projects.
2. City Hall Expansion of $70 Million seems like a luxurious project for our city when we do not have dollars.
This includes raising taxes, going for high debt financing, and depleting all of capital reserves. Also, it takes
away money from all essential projects. Going with this option requires lot of community input. Instead, the
City should be looking at cost effective alternatives to retrofit the existing building.
The best option for interim city hall is using the Monta Vista Center. This is the lower cost option and this
investment also goes towards improving the city facility for the longer term.
3. Cupertino Sports Center Seismic Retrofit and HVAC upgrade: This is one of the best used facilities in
Cupertino. The customer base is 2000. The classes it offers has quadrupled since 2004, whereas the HVAC was
installed for a customer base of 600. The facility temperature is always too hot or too cold and is very
uncomfortable for the users when temperatures soars. Since a higher number of kids and adults use this facility
every day, investing in seismic retrofit and HVAC upgrade is a good idea. Seismic upgrade of $ 1 M is included
in all 3 options whereas HVAC upgrade of 500K is not included in any of the options, it is in other projects list.
5. Transportation Projects:
Blackberry farm entrance road improvement projects. The feasibility study was approved to start in FY2019. In
the transportation projects report to the Council on April 2nd, the report states that no cost estimate is available
for this project. However the CIP projects list shows this as a high priority project in options A and B with a
cost of $5.5M. Is the feasibility study completed? This looks like a large sum of money to be set aside for
Blackberry farm related projects that is draining City resources. The public should be provided more
information on this line item on why this is a higher priority.
Most of the transportation dollars goes towards bike projects ($58M out of $69.6M, as noted below), but the
issues are in the major arteries and intersections. So the City should be investing in roadway improvements and
major intersections, which is also the preferred option by the OpenGov Survey respondents.
6. Cost Estimates of CIP projects: The cost estimates for CIP projects has had huge escalations from the time
it is projected in the budget/master plans to implementation. For example,

The cost has escalated from $18 million to $58 Million in less than 3 years, which is 322% higher than original
estimates. The city should come up with a better way of estimating project costs. If you add up all city
wide transportation Projects in the list, the cost is $69.6 million . Bike projects alone is
$58.3 million which is 83% of total cost which is lopsided when there only 0.7% bike
commuters in the City per 2016 Bike plan.
So when the City Council makes projects decisions based on the project estimates, the dollars quoted should be
within a reasonable range so the Council can make right decisions in prioritizing projects that benefits the city at
large.
