Applicant: Yew -Lee Lim
Location: 7552 Shadowhill Lane
Director's Extension of a Use Permit to locate a large family day care home in an
existing single family home in an R-1 zoning district.
Staff Presentation: Mr. Piasecld presented a brief overview of the application request to
extend the use permit to allow a large family day care facility with between 7 to 12
children in a single family residential zone. No environmental assessment is needed
because the project is exempt under the California Environmental Quality Act. Mr.
Piasec1d stated that his decision will be final unless it is appealed. r
This facility requires a use permit because it is within 300 feet of another day care facility
which is located on Rainbow Drive. Mr. Piasecki said that he had driven by the facility
and observed that it meets the parldng requirements necessary for a large daycare facility
in Cupertino.

Parents, Helen Chen and Fred Key, spoke in favor of the center. They stated that the
facility is an asset to the neighborhood and that their respective children have benefited
from the classes.
ACTION. Mr. Piasecki approved the application.
ADJOURNMENT: Having concluded business, the Director of Community
Development adjourned the meeting.

Property Owner: Vanessa S. Lam
Location: 7552 Shadowhill bane
Staff Presentation: Planner Wiles stated the applicant applied for an application to operate a large
family day care out of their home. He mentioned the Municipal Code states that a large. family day
care home that is' within 300 ft. of another daycare, such as the one at 7553 Rainbow Drive; must ,apply
for a conditional use permit to be issued by the Community Development Director. He pointed out the
location of the day care facility and how the other daycare was 300 ft. of the boundary.
Planner Wiles said there has been correspondence both for and against the facility. He said the major
concerns were the parking requirements and the side thatis located in an R-1 zone which is a zoning
for residential structures. He stated the requirements are four, units, two in the garage,, two open spaces
plus one parking space for a nonresident employee and one space for drop-off. The city code states
these additional spaces may be located on the street. Planner Miles pointed out the lot itself is 57 ft.
wide and subtracting the width of the driveway, which is 12 ft., would be 45 ft.. This amount would be
sufficient space for both drop off and one additional employee.
Planner Wiles stated the use permit is good for 4 years from the date of approval. After 4 years, the
applicant will. have to re -apply. The second condition states day-care homes must comply with state
and local health and safety regulations.
Planner Wiles stated that staff recommends the approval of Application No. 1-U-96.
Planner Niles asked if there were any questions pertaining to this application?
Ms. Martha Chang asked if they were ready to approve the application today?

Planner Niles answered that the Director would make the decision.
Ms. Chang wanted to know if the applicant met the guidelines would the application be approved at the
meeting?
Director Cowan stated yes.
Planner Wiles said the decision was final unless there was an appeal in 14 days.
Director Cowan said he would like to hear from the applicant if they had any additional comments.
Ms. Lam stated she had operated her day-care facility before she moved to 7552 Shadowhill Lane. She
mentioned that she was three houses away at 7586 Shadowhill Lane. She said she had no problem
with the neighbors and no objections. She asked for a permit to continue her day-care and said she
qualified for a state license.
Director Cowan asked if she had read and understood the proposed conditions of approval?
Ms. Lam. stated she did understand.
lbs. Lim said she was the owner of the house at 7552 Shadowhill Lane. She mentioned she had
checked Ms. Lam's previous day-care center. She said it was in mint condition and was the cleanest
day-care center she had ever seen. She said the children were very orderly, quiet and happy. Ms. Lam
said she decided to rent the house to Mr. Lam because she felt she was going to run a very excellent
day-care center.
Director Cowan asked to hear from the public.
Ms. Emma Looker stated that she was an assistant for Mrs. Lam since last September. She said she
had observed many wonderful qualities within the school which she considers the best association ever
made with children. The children do not arrive at the same time and there are brief stops and no traffic
jams.
Director Cowan asked the applicant if there were going to be 12 children at the center and, if so, what
times would they arrive and depart?
Ms. Lane stated they arrived between 8:30 a.m and 9:30 a.m.
Director Cowan asked if there was any carpooling?
Ms. Lam said yes.
:Director Cowan asked how many cars?
Ms. Lam stated there were 9 to 10 cars occurring 10 minutes apart.

Director Cowan asked if any of the neighbors had any additional comments.
lbs. Martha Chan stated she left for work between 8:00 and 8:30 a.m. She stated she had not come
across any problems with traffic. She also pointed out that the center has been existing for about a year
on the same street and there have been no complaints from neighbors. She said has been living there
since 1983 and had not noticed any changes..
Ms. Lee stated the day-care was convenient for her. She said she did not think that traffic would be a
problem,_ because she hardly ever save anyone else dropping their children off the same time she did.
She said the hours for Ms. Lam's daycare are flexible.
Since there were no additional comments from the public, Director Cowan closed the public hearing.
Mr. Cowan stated the city's concern was with the issue of traffic and parking. He said he had heard no
concerns from neighbors regarding traffic. He said he would approve the application based upon the
conditions described in the model resolution.
Director Cowan said the application was approved.
ADJOURNMENT: Having concluded business., the Director of Community Development adjourned
at 5:45 p.m.
