None WRIITTEN COMMUNICATIONS: Letter from Joseph Wisneski, 1710 Evemarie Avenue, Los Altos, CA 94024 Received February 3, 2000 PUBLIC HEARING 1. Application No: 1-DIR-99 Applicant: Rita & Alfredo Cruz Location: 10203 Miller Avenue Director's Use Permit to allow a large -family day care home in an existing duplex in an R-3 zoning district. Staff Presentation: Mr. Jung presented a brief overview of the project, stating that Mr. and Mrs. Cruz propose to open a large family day care home in one unit of the duplex at 10203 Miller Avenue. A large'family day care may provide care for 7 to 12 children, with the possibility of increasing the number to 14 if certain conditions are met. He explained that State law regulates large family day care homes and that the State encourages cities to approve such facilities because they are in short supply and there is a growing need for them. The care facility, however, must meet local standards for such things as parking, traffic control, noise or concentration of such facilities. Staff recommends denial of this project because it does not meet the requirements of Cupertino's parking ordinance. PAGE) Mr. Piasecki suggested that Mr. and Mrs. Cruz limit the number of children in their care to 6 or less (with the possibility of increasing the number to 8 if the two additional children are of school age). Then they would not need to obtain a use permit from the city. He also explained that they would have the option of appealing the Director's decision, should the application be denied. Thenext level of hearing would be at the Planning Commission level. ACTION: Mr. Piasecki denied the application; based on the parking deficits. ADJOUPNMENT.
