Location: 10495 S. DeAnza Boulevard
Use Permit for a specialized school in an existing commercial building
Community Development Director's decision final unless appealed.
Staff presentation: Ms. Wordell explained that the only issue raised > concerning the
specialized school was to assure that there is adequate parking. The report listed a
condition of approval in the resolution stating that as long as there are not more than
twelve potential employees or driving students at any one time, which is the number of
spaces which would normally be allocated to that retail space, then the applicant would
satisfy the requirement for parking space. The proposed specialized school would have
younger students, most of whom would not be of driving age, so the allocated parking
spaces would be adequate. She stated that staff wanted to make sure the applicant also
understood that there may be physical changes in the building, and that the applicant had
already covered the changes.
Staff recommends approvalfor the use permit.

Mr. Cowan responded that parking is the issue for two main reasons:
1. The City does not want to see its retail centers overwhelmed with nontaxable
operations, since retail sales is the lifeblood of the City. Centers occupied by
non sales tax producing entities after a while erode the tax base. The City's
Finance Officer said this is not a major consideration for this application.
2. If the school became very successful and gained more students, the nearby
tenants could become upset if they lost some of their parking spaces to the
school employees or students.
Mr. Cowan stated that he felt the conditions of the resolution were adequate; and, for the
record, there were no other individuals in the room _who wanted to testify on the
application. The findings prepared by staff reflect the situation accurately, and his
decision was to approve the use permit.
Ms. Wordell then explained that City Council members and all the Planning
Commissioners would receive a copy of the Director's decision and that anyone has the
right to appeal the decision within 14 days.
The applicant had some procedural questions concerning obtaining a building permit after
the 14-day appeal time had expired.
Mr. Cowan instructed them that the Planning Department had approved the use of the
property for a specialized school. The Building Department would now feed to review
the actual plans to ensure the safety of the students.
