Mrs. Gayle Bate stated that she had a concern with the construction procedures regarding San Fernando
Oaks (Application 5--90 - Lotus Development). She said she had talked to the mayor, code
enforcement, public works and Lotus Development, regarding the issues of the speeding trucks, parking,
etc. She stated Council originally approved the application with the conditions that the construction
vehicles would be using McClellan Road and not San Fernando Oaks.
Mrs. Bates also mentioned that the whole neighborhood is very angry and upset and they are concerned
for the small children when they are out playing in the neighborhood.
Director Cowan stated that he has to review the conditions and minutes of this application.
Mr. Michael Heckrotte, Board of Directors of Ridgecrest, expressed concerns to Lotus Development
regarding the fence along Ridgecrest.
Mr. Barnes, Lotus Development, stated they are checking into the fence problem.

Staff Presentation: Planner 11 Robillard described the two parts to the variance request. He stated that
r the first -story setback on the north side of Lot 4 to be 9 ft. instead of 10 ft. Mr.

Robillard stated the setback was needed because of the location of a water main which is not the
developer's fault. Mr. Robillard stated the second reason regarded a second -story setback on a flag lot.
He stated the minimum sideyard setbacks are usually 20 ft. Mr. Robillard said the request for the
variance is to have 12 ft on the north side and 14 ft. on the south side. He said on a conventional flag lot

the minimum setback would be 10 ft. Mr. Robillard felt that it was justifiable to have a shorter sideyard
setback on a second -story.
Director Cowan explained the variance guidelines of approval for granting a variance. Mr. Cowan asked
Mr. Barnes to explain the rationale for the variance.
Mr. Barnes stated that Mr. Robillard explained it accurately.
Director Cowan opened the public. hearing.
Mr. Michael Heckrotte, 21987 McClellan road, stated that he had a letter signed by seventeen of the
homeowners at Ridgecrest, stating their concerns , regarding the second -story facing their existing
properties. He wanted to know if they could modify the style so it would not impact their privacy? Mr.
Headgrove said they would like to preserve their open space and privacy.
Mr. Greg Schlick, 22035 McClellan Road, expressed concerns regarding their real estate values that
would impact them because of the huge structures next to them. He stated he did not understand the
variance.
Planner Robillard explained the first -story setback variance request is to come 1 ft. closer to the side than
what would be allowed. The second part of the request is to have the second story, the bedroom portion,
come within 12 ft. of the property line on one side and 14 ft. on the other side instead of 20 ft.
Mr. Barnes stated that the variance was only asking for theoneroom to protrude.
Mr. Schlick stated that is what they were objecting to.
Mr. Theodore Constant, President of the Ridgecrest Homeowners Association, 22025 McClellan Road,
stated the residents were concerned that the structure represents a higher density type of use in, that area.
In general, they are unhappy to see how many homes were placed in that area. He said he felt the
appearance will have an impact to the area.
Director Cowan stated the lot was unique in the sense that it is not a typical flag lot. He said he would be
inclined to approve the first -floor setback. He asked what could be done to resolve the massing issue and
the privacy issue?
Mr. Barnes stated there was a larger section of the property which produces a difference in height.
After much discussion, Mr. Constant agreed that the privacy issue was not as big as it seemed at first.
Mr. Barnes explained where the windows and roof would be built with consideration of privacy,
including. backyards. He also stated the allowable coverage of the lot allowed them to cover 5,400, and
they only covered 4,000. He said that did not involve massing and use up. all the floor space.
Mr. Constant wanted to know what square footage the floor plan was. He asked if this was going to be
the largest house of the development?
Mr. Barnes stated that the people who bought the lot, customized the house.

Director Cowan stated he could approve the plans with some modifications.

0 Director Cowan stated that the second story could be approved subject to modifying the plan to reflect
two corner windows.
Mr. Barnes stated that the window be either a 4 ft. or 5 ft. in height, to keep it above the roof. The corner
window would be equal in height to accommodate the roof line.
Director Cowan closed the public hearing.
Director Cowan approved the variance for both the second floor and the first floor based upon model
resolution findings, with the addition of the conditions requiring the architectural modifications that will
be noted on the plans and made part of the file.
ADJOURNMENT: Having concluded business, the Director of Community Development adjourned at
6:3 8 p.m.
