BACKGROUND Section 19.56.040 of the Cupertino de Municipal Co -related to General Commercial uses requires that specialized schools that comprise more than 5.0% of.the space of a shopping center are subject to the issuance of a conditional' use permit `by the Director of 'Community Development and may be approved provided there is adequate parking ,,and `that noise requirements are met. The applicant proposes to locate a specialized school in a small: shopping center. He will lease 2,955 square feet of the total 5,479 square feet in the building, which comprises more than <50% of the building. Twenty three parking spaces are provided, which meets the required parking for retail uses. DISCUSSION 0.ne of the main reasons that specialized schools receive conditional: use permit review is the issue of parking. The students in this school are: reported to be between the ages of five and eight. There are reported to be three employees at peak time. Given this information, the maximum number of parking spaces needed at peak time for this use is three. If this space had a retail use, twelve parking spaces would be required. Therefore, the ,proposed use is well under the parking spaces allocated for this space. A condition of approval is proposed that would assure that the number of employees ` and students of driving age does not exceed twelve spaces at peak time. Another issue involved with`locatng specialized schools in a shopping center is that they replace retail uses and possibly could decrease the retail activity in a center. Staff is not concerned about replacing retail use with a school in this case because of the small square footage involved'. It is not a significant amount, and will not affect the City's retail base or the. shopping center as a whole. There are no noise issues related to this type of school.
