V APPLICATIONS
A. Application: 262-Hc-67, Federal Sign &.Signal Corp..,
1521 Terminal Avenue., San Jose., requesting Arch. &.Site
.Approval to erect. a go sq. ft. pole sign to replace
existing sign., formerly Scott's Auto Store,
Mr. Pete Peterson., of Federal Sign and Signal Corporation,
1521 Terminal Avenue, San Nose, said he checked with the
Planning Department and learned there is anew Sign. Ordinance
being --prepared,. and designed this sign so that it.would
conform. 'with the new Sign Ordinance

Mr. Peterson said the building is 4(D00 sq. ft., and 3% of
this equals 120 sq. ft. He submi-.ted a proposal for a
90 sq. ft. sign. It was noted by the Committee that this is
a double -face sign, and it is 90 sq. ft. on each side;
therefore, in order to conform wi-.h the forthcoming Sign
Ordinance, his sign should be a maximum of 60 sq. ft. on each
side, based on 3% of the building area.
Chairman Fitch suggested the sign be passed, under the old
Sign Ordinance, and if the City Council feels he should
conform to the new Sign Ordinance they will so instruct him.
He did not feel the Committee could base their recommendation
on anything other than those ordinances presently in effect.
When it was pointed out that the new Sign Ordinance would
probably be in effect within sixty days and this proposal
would be non -conforming and would have to be removed within
a specified time, the representative from the sign company
asked that his proposal be based on the Sign Ordinance now
in effect. He said he was told the maximum allowable square
footage for his sign, under the new Sign Ordinance, but he
did not ask if that meant for one or both sides. There
followed a lengthy discussion of she section of the new
Sign Ordinance pertaining to pole signs on property with less
than 210 lineal footage of right-of-way.
Mr. Irwin asked about the colors of the sign. Mr. Peterson
said the upper portion would be an interior illuminated white
plastic with blue letters and the lower portion would be an
interior illuminated red plastic with white letters. He
added that he has tried to make this sign within the scope
of the forthcoming Sign Ordinance.
The Chief Building Inspector requested to the Chairman of
the Architectural and Site Control Committee that application
262-HC-67 for the auto parts store on Stevens Creek Blvd., be
denied. The reason for this request is that in the immediate .
future, a new Sign Ordinance will be in effect which will
cause this particular application to be non -conforming.
Comm. Irwin said the Chief Building Inspector's statements
were well taken and understood.
Moved by Comm. Irwin) seconded by Comm. Stern, to recommend
to the City Council approval of application 262-HC-67, per
the plans submitted, subject to the 10 standard conditions,
and under the present Sign Ordinance, specifically.
Comm. Irwin commented that the applicant has been made aware
that a new Sign Ordinance is forthcoming and that upon ap-
proval and enactment, if this condition exists, the new sign
will have to be removed whenever -,he Sign Ordinance so states.

B. Application- 263-HC-67., James Ghielmetti, 455 22nd Ave,,
San Mateo, requesting Arch, & Site Approval to construct
a 61, x 56, duplex to be located on Parcel A,,.Deep Cliffe.
The applicant's brother, Mrb Charles Ghielmetti, 22380 McClellan
Road., Cupertino,. presented the plans. He said this is the
only lot left on McClellan in the duplex area,
.The.plans showed a heavy shake roof and, brick pilasters,
.board and batten with brick veneer exterior, There will be
two double -car garages.

the City Council the approval of application.263-HC-67,
subject to the 10 standard conditions,, plans as submitted,
the Planning Department check list,.and landscaping.plans
to be .submitted prior to final -inspection.

20215 Stevens Creek Blvd.
Chief'Fred Luhring,, :528 Tully Road, San Jose, has obtained
a: snorkel,for our area, He is at a loss to house t hl s
particular type apparatus at this time; therefore, I he is

proposing to raise the roof of the present Firee-Station on -
..Stevens. Creek. Blvd,,
By.elevating!one of the three stalls*
and extending it back approximately 8 feet, they Will be
.,able to accommodate this new snorkel. Then,to keep the_
building looking in proper proportion., they will extend the
.new roofline'across all three stalls in front and install
new aluminum doors to replace the old, wooden ones o.
"Chairman Fitch commended Chief Luhring on his foresightedness
in obtaining this equipment for which there will be an in-
creasing need in this area,

Comm. Irwin said that any time we can upgrade our city's
facilities., he is all for it.

D. Application: 265-He-67, Hugh Jackson, 22608 San Juan
Road, Cupertino, requesting Arch. & Site Approval to
construct a Speedee Mart Store, to be located on the
east side of Bubb Road.
Civil Engineer Tom Henderson, 10601 Saratoga -Sunnyvale Road,
Cupertino, presented the building plans. He said the property
is located on Bubb Road, south of McClellan, beyond the
Shell Station. The plan showed a brick and glass front on a
concrete block building, with a tar and gravel flat roof.
He asked that the sign be reviewed at a later date. He
presented two sets of landscaping plans; one with the build-
ing centered on the lot and one with the building to the side.
It was pointed out that the property on either side and at the
rear is also zoned Commercial.
The Planning Director said the zoning has been Commercial here
for several years. Bubb Road is a major road, serving this
entire area, with a 60' right-of-way (40' from curb to curb).
The street improvements would have to be assumed by the
developer. There are no plans at present for widening the
road. Mr. Henderson said that if it should go to 901, it
would make this lot too shallow for perpendicular parking.
The Planning Director stated that if the street were widened
the land would be useless. He said we have no official
plan line that we could enforce at this time.
Mr. M. W. Smith, 8099 Presidio, Cupertino, representing the
Yorktown Homeowners' Association, stated that Mr. Noor
Billawalla has told him that he plans to put in a town and
country type shopping center in the commercial property
surrounding this property. This is the only commercial
property in the area. Mr. Smith noted that the property in
question is quite small, and he questioned whether the appli-
cant would be able to meet the parking requirement. He feels
the flat roof would not be compatible with the heavy shake
roofs in the area or with the type shopping center envisioned •
by Mr.Billawalla. A shake roof would be prohibited by the
Fire District, so he suggested the applicant use a tile roof.
The homes in that area start at about $30,000. He does not
object to a Speedee Mart, but f eeJ.s the building should be
compatible with the other structures, in the area. There are
about 120 homes in the area at the present time.
Mr. Robert Lawes, 916 Providence Court, Cupertino, also from
the Yorktown Homeowners' Association, called attention to the
large Speedee Mart sign that would shine directly into the
windows of the homes across the street. He proposed an
overhang across the front of the building to deflect this
light.
Mrs. Mildred Dineen, 933 Bubb Roaci, Cupertino, reminded the
Committee that they have an obligation to the homeowners.
She said she could gather 200 names of people who would be
willing to boycott this Speedee Mart. The Planning Director
commented that the zoning was there before any of the homes
were built in the area.

Mro . Walter Sears, 8093 Hyannisport, Cupertino, feels that the
image of the College,;Mr, B llawalla's..proposed shopping
center, and the homes in that area should be considered;
Since the homes have been built and this property has not
been developed, he feels the zoning should not preempt the
character of the area He suggested a 6' hedge around the
Speedee Mart With a 14' driveway, He feels the proposed
configuration is not compatible with the area. He also
feels that three trees are not enough for this,property
In closing,:he said they don't need a Speedee Mart, and the
people don't want one,
Mr. R. Y. Havens, 8187 Presidio Drive, Cupertino; said that
since there is a proposed.complete shopping center for this
area, it seems like Speedee is trying to get the.jump on it.
He would like to see a unified development plan for this
commercial property, together with the adjoining commercial
property; He noted that there are no sidewalks; and was
concerned about the safety of children and adults crossing
Bubb Roado
Mra . Henderson said he has not heard of any plans for a
shopping center for this area; Speedee Mart does not 'plan
to buy the property; they will be merely the franchisee,
Mr. C a J o Dineen., 933 Bubb Road, Cupertino, said he. liven

worth of ,...homes; in, the area. Considering the homes and the
College, the value of the area is fairly good. The basic
purpose of a Planning Commission and an Architectural and
Site.Control Committee is to keep Cupertino foremost in the
minds of those who live.here and those who would like to.
live here, This 90' 120' lot was zoned commercial before
Yorktown and many other subdivisions were, built, The people
. have, pretty' .much resigned themselves to. the ,fact that _a
commercial development will be here, Mra Dineen said he
.has seen three different Billawalla plans and. all three are
marred by this 120' lot, He said he went to.every.home in
Yorktown and got the following results.- 14 did not answer;
one was not interested because they are moving in June;
the balance of the homeowners in Yorktown are all against
having that.which is proposed tonight,
Mro Hugh Jackson, 22608 San Juan Road.,. Cupertino,.said that
althou.gh.this is not his proposal, he is the present owner
of the.property and used to live in the house on the -property.
He still lives.in Cupertino, but has moved a little further
west. He commented that this is a small piece of commercial`.
property and, therefore., has limited possibilities. He
stressed the,factthat he is just as concerned about the
development of this property as the others who have voiced
their opinions tonight; He came because.he was interested in
seeing Speedee Mart's proposal.

Mr. J. F. White, 8137 Presidio Drive, Cupertino, said that
some time ago, there was discussion of developing San Jose's
property at Bubb Road and McClellan Road. It was refused
the rezoning because it was thought to be incompatible with
the area.
Mrs. Helen Tibbets, 927 Bubb Road, said she is a California
school teacher. In this area we have Kennedy School 12 blocks
away, as well as Lincoln School and a high school site nearby.
She feels the type construction should be given much consider-
ation; the residents in the area should be considered.
Mr. Dineen commented that if there can't be any cooperation
between these two property owners, perhaps they could trade
areas and move the Speedee Mart down to the area next to
the service station.
Chairman Fitch said there is a definite possibility of the
development of a town and country type shopping center here.
The interest of the people who live in the area, who have
spent the money and time to create a pleasant atmosphere
must be considered; however, we cannot deny anybody the
right to build his business on properly zoned property. But
to allow growth only for growth's sake is short-sightedness.
He said this area was discussed at the recent Congress for
Community Progress. There is a great interest in taking
advantage of planning wherever we can, but we must integrate
our efforts and take advantage of business interests wanting
to come into this City. The area in question is already
assigned to this type of zoning, but it would not be to the
best interest of these people to develop it as proposed
tonight. It was the recommendation of the Chairman that, if
we are to welcome business into the area, to take a close
look at this proposal and to try to get the highest and best
use of the property, which will also be in the best interest
of the people who are already there.
Comm. Irwin made the following comments: •
1) The proposal is not architecturally compatible with the
homes in the area, the C(�llege, and perhaps with the
contemplated shopping center.
2) The sign would shine into :,he windows of nearby homes.
3) The property adjoining all this commercial property is
zoned Agricultural, which means it could go either
Commercial or Residential.
4) Some of the people are afraid of strip commercial
developing here.
5) Someone suggested moving subject property down next to
the gas station; can this be done equitably?
6) A 6' hedge with a long, 14' driveway was suggested;
what about safety?

Mr. Henderson asked if he could approach Speedee Mart about
building something compatible; He explained that Mr. Jackson
is in the process of selling this property,
Mr, Irwin askedifthere is a" possibility of the developer of
this.property.getting together -,with Mr, Billawalla If there
is a planned, compatible shopping center in the offing,
Speedee.-would do well to take noteof this, Mr„ Henderson said
Speedee has found the best business locations are next to a
super market.
Mrs, Patricia Phillips, 11167 Linda ,vista Drive, Cupertino,
said she is the realtor involved in .this and Mr, and Mrs.
Marina are the prospective buyers She said we have been
talking about a unified plan that may or may not develop.
She.said she has seen the:new type building;.Speedee is con-
structing -now., and it is, very nice looking, There is one
in Menlo Park that it
a the roof.
Mr. Stern said he would like to. recommend,,as far as a design
concept is concerned, for somebody to get together with
somebody else and try to cooperate. He would like to see
something here that is compatible withthe area.
Another-resdent of the area commented that Bubb Road is
the dividing.line between San Jose.and Cupertino; The resi-
dences are in the San Jose portion and the undeveloped pro-
perty is in Cupertino. He asked how responsive the Committee
is to people living in a neighboring city; Chairman Fitch
said.we do cooperate with San Jose,_ He thinks that we a -re
very much interested.in doing what.would be best for the
area ,,San Jose and Cupertino.
Mr..: Sears suggested, as a result of the discussion.which
has taken place, that,a Speedee. Mart representative come and
explain just what they plan to construct here, He sug-
gested they build a town and country style store and -move it
to within 5' of the street and have the parking in the rear,
and have a 6' hedge rather than a masonry .wall.
Moved by Comm, Irwin, seconded by Comm, Stern, to continue
application 265-HC-67 to the next regular meeting, and to
have present at that meeting the applicant, a.Speedee Mart
representative, actual plans for.this property and,proposed
trade-off, to make the plan.more compatible with the area.
Chairman Fitch said they must take a close look at these
plans because this could introduce strip commercial to the
area. He added that it behooves us to put in something
unique in an area that is in such close proximity to the
College,

E. Application: 256-HC-67, Pleasant Hills Convalescent
Hospital; Excell and Son, requesting Architectural and
Site Approval to construct addition to the Hospital.
Mr. Alomia, 1327 Morton Avenue, Los Altos, said this hospital
is located at Foothill Blvd.and Voss Avenue. The addition
will be identical with the existing structure. He said
they plan to put in the rest of the improvements now. The
Planning Department is in full concurrence with this.
It was noted that the parking spaces should be 10 x 20
instead of 9 x 20, as noted on the plans. The applicant
agreed to this. He also stated there would be no appurtenances
on the roof. The landscaping plan will be submitted prior
to final approval.
Moved by Comm. Stern, seconded by Comm. Irwin, to recommend
to the City Council for approval, application 256-HC-67,
per the plans submitted, the 10 standard conditions, the
Planning Department check list, parking spaces to be corrected
to show 10 x 20 rather than 9 x 20 as shown on the plans at
this time.
