Application: 231-HC-67, Watson Associates, 1260 Windemer Drive, Los Altos, requesting Arch. & Site Approval of the landscape plan of the Car Wash, located at 10115 Saich'.Way. Mr. Frank Watson, of Watson Associates, 845 N. Humbolt, San Mateo, placed the landscaping plans on the bulletin.. board. He said they have been advised to use non -deciduous plants. There will be 4 street trees and extensive use of Hollywood juniper, juniper phitzer, palm trees, phlax and ivy. Comm. Kowitz felt the plants scheduled for the corner would grow too high and will cause a blind spot for motorists. There was some concern on the part of the Committee about the maintenance of these plants. It was pointed out that car washes always have an abundance of water. Mr. Watson stated Mr. Roger Jensen will be the manager of the car wash, and judging from others he has managed, Mr. Jensen will not allow this to become rundown in any way. Ch. Irwin commented that a 3' maximum height should be placed on the plants for the corner, with the exception of the palm tree. Mr. Watson said he would be able to obtain a smaller variety of phlax. Comm. Fitch noted that there will be light poles here. He cautioned that, since this is a night operation, precautionary methods should be employed to see to it that these are not bothersome to the neighborhood. It was noted there will be concrete wheel bumpers along the building. Some precaution should be made to prevent the cars from running into the redwood headers. The Committee asked for concrete bumpers along the perimeter planting. Ch. Irwin asked for more information on the light poles. Mr. Watson said they would be flat floodlights that shine directly into the car wash. Moved by Comm. Fitch, seconded by Comm. Stern, that application 231-HC-67 be recommended to the City Council, relative to the prints submitted with the changes made on the prints, and subject to the 10 standard conditions. AYES: Comm. Ch. Irwin read the l.etters..from Mr, Robert Schisler, Cupertino. School Superintendent Charles Knight, Kennedy School, Principal Leona:Thornton;.Lincoln School.Principal Bert Gibbs,. and Mra William Vann, Mr Tom Henderson,,. Civil Engineer,, - 10601, S, ,.Saratoga- Sunnyvale,Road, Cupertino, noted, that the letters,,from the schools re,f:erred to zoning,: which is ,not before this committee tonight:. The zoning has been here for several years; -in fact, since before these homes were built in the area. Mr. Henderson placed the new . rendering on the ,bulletin . board , Hesaidthat, on the basis of information gathered at the previous hearings, they `have employed an architect who has taken :pictures of the buildings on the- De Anza campu:•s and has consulted with the De.Anza architect .before preparing this rendering® --.Every attempt will be made to have the exterior of this. building compatible -with the campus buildings; even to the extent of matching the ,hue- of the made -to -order cerami.c,tle roof, He Stated that the parking spaces meet the=Cupertino Ordinance. Ch.. Irw n commented that the rendering.looks very much like the De. An.za :buildings Mro.•C J Dineen9 933 Bubb Road, said he spoke orthe majority, of the homeowners in the area. They believe they_: will all be affected as to the value of their homes if this.Speedee Mart is permitted. This would mean noise until 10 or ll P,M. and.increased traffic :on Bubb Road, which is much.t.00 busy already. He pointed out there are no ,sidewalks on that side of the street.. He felt their strongest argument. is the fact that Speedee Mart is only,interested in having a..:business where beer and wine can be;solda He said -Safeway made a survey in the area and found the people in the area did not want a ..store nearby, The City of San Jose backed the people in their fight -against commercial zoning in the area He said _ the people moved.to-this area because they found the beauty and seclusion made up for the inconvenience, Mr, James Sable, 9:15 Bubb Road, Cupertino; lives diagonally across from this property. He claimed this proposal was not compatble9:it is strip commercial; he,does not -like the style of building; and this would increase traffic, He said the safety of our children should be of utmost importance. He considers this use an attractive nuisance,, The -mistake was made six .yea rs ago when the property was rezoned; letrs.not compound this mistaken -3- Mr. M. W. Smith, 8099 Presidio Drive, asked if this is the same plot plan as previously submitted. He asked where the air conditioning cooling towers go-ald be placed. He noted the City of Cupertino now has traffic counters on Bubb Road. He has asked the City of San Jose to set up a radar speed zone in the area. He does not feel Bubb Road is the type road that can support the type of problems potential cus- tomers of this store would create. Mr. Henderson answered this is essentially the same plot plan with a new building exterior and ceramic the roof, which will be compatible with De Anza College, as requested by the homeowners at the last meeting. The air conditioning cooling towers could be hidden within the parapet roof or there could be a small one on the ground. The only way you get sidewalks is through development of the property. There are sidewalks along the developments on the other side of the street, and crosswalks can be utilized. Mr. Bill Jacobs, 11076 Linda Vista, said there are 4 super markets within a short distance of this area and he feels the applicant has not established the need for one here. Mrs. Diana Koff, 1031 Pennington Lane, said she would like to have a Speedee Mart in the area, for her convenience. She can understand the concern for the safety of the small children, but small children should not be allowed out in front or to cross busy streets. School -age children must, by necessity, learn right away to observe safety walks. She also pointed out that schools have closed campuses, so this would then put the responsibility on the parents, whether or not they wish to let their children go to the store. Ch. Irwin agreed that everyone knows the zoning is there. However, he feels it is the duty of the Committee to listen to the people who have come to the meeting with something to say. Mr. Smith said Bubb Road splits down the middle; San Jose on one half and County on the other. He does not see how Cupertino can effectively control the traffic. Comm. Kowitz stated that, since the zoning is already there, this is a matter to be determined by the City Council. Mr. Robert Laws, 916 Providence Court, said that each time the applicant has come back in, he has presented a better proposal. He wanted to clarify whether this proposal was for an asbestos the or ceramic the roof. Mr. Henderson said it is ceramic tile. -4 - Mr,.Laws said that what the people are trying to-do is block any further encroachment of commercial endeavors in a residential. neighborhood. They are still faced.,: -with an il- luminated sign on the front :o.f the building, .;which W:i11 be shining .in the Windows until 11. -P.M. Another: thing -they must contend with is the ever-present ice, gum, and other machines in front of . every Speedee Marto They want -to avoid .anything that would make this look like=a commercial building, Mr®. Laws: said the property to .the south is still up in the air. This bu:ildng will probably set the standard of the future development of the commercial area. If it is a Well designed building, in good ,taste, as this rendering indicates, it could.be a credit to "the n.ighborhood - Mr, Henderson sa d :only the 21 x. 24 g sign . in t-he center of the marquee will be illuminated, The street lights will give more light to -the area.than this sign. Juan Road, Cupertino,: said -there have been three hearings on this proposal. He has tried to come u.p.with what the 'people want. As far as crosswalks are concerned, :he said the City Council will require these in keeping with the safety standards W-hen-he develops,hzs property he Will be putting in the sidewalks and all'the on -site improvements, Mr.- Dineen asked if the San Jose newspaper article°about -Mayor,Fitzgerald's statement in regard to wideningof'Bubb;Road would affect this property. He -also stated the -County, . in trying to :keep the area around the college in its ,proper light,.tu.rned down an.application for rezoning'at Stelling. and McClellan. He : asked. how the City of'Cupertino feels about reciprocation. Ch.,Irwin questioned whether that Was a -matter of rezoning, Mr, Jack Gillam, Spe.edee Mart Representative, 2531 Newhall, Santa .Clara, said . that on Stelling and McClellan, the zoning is. C-1 and the County was discussing the matter of. a .Use Permit ,for a service station. They are currently.modifying the Use Permit request to include a Speedee Mart, There has been a -.denial, but through the appeal procedure, they are working again with the County, The matter is not --settled Moved.by Comm. Kowitz, seconded. by Comm Stern, to close the Public Hearing© Comm. Kowitz affirmed that the widening of Bubb -Road is irrelavent to this application before this body. AYES: Comm. Fitch wanted to recap the matter: The objections the Committee has heard have been from the schools and people who live in the area. The schools have made a strong stand; closed campuses are an effort on the part of the schools to keep the kids off the street. This proposal presents an attractive nuisance. Foothill College will be self-contained and will not need the services of this store. However, the man has a right to develop his property. But there has only been one voice in favor of this application. A larger, unified development would be more desirable here; but the property is under two ownerships. The rendering presented at this meeting is very well done and is compatible with the college architecture. The applicant is to be commended. Comm. Fitch was concerned about strip commercial development here. The taxes derived from a small business such as this would not be significant to she City. There are some indus- trial developments coming into the area that will do the tax rolls some good. He was not in favor of recommending this application for approval. Comm. Kowitz said we all realize that this application has many ramifications, from the traffic pattern to the safety of our children. He asked if there is a better location for this Speedee Mart. He felt he could not make an objective decision on this application because he is interested in the feelings of the people in the area. On that basis, he wanted to pass this on to the City Council without recom- mendation. Comm. Stern said he was surprised by the stand the schools have taken on this. He does not believe this is the proper place for a Speedee Mart. It is not the function of this committee to be concerned about traffic, etc.; only in the architecture and the site. Moved by Comm. Kowitz that application 265-HC-67 be sent to the City Council without recommendation. He added that the developers of this Speedee Mart have made a tremendous • improvement in their rendering of the proposed building. Motion died for lack of a second. Moved by Comm. Application-. 268®HC-67, Eugene Ravizza� 10601_So Saratoga -Sunnyvale Road, . Cupertino, :requesting Arch. & Site_Approval to remodel the existing commercial buildinglocated at 10601 S. Saratoga -Sunnyvale. 'Road, Architect Ed Myers-9 10601 S. Highway 9,-Cupertino, repre- sented Mre.Ravizzaa Plans were put on the bulletin board. Ch. Irwin asked Mr.. Myers if applications have been made for the required variances, noting that any recommendations by.this body would have to be contingent on the gaining of these variances, Mr. Myers said the necessary variance applications have been. made.. Mr. Myers .said the building at therearof the property and the remodeling of the present Cupertino Electric Warehouse are being considered at this time. Dyers said they will be camoflaged if the Committee requests. Commo.F tch asked about the exterior colors.Mro Myers said i the intention is to stay with the existing -colors, and an effort will be made to match the orange as close as .possible. Comm,�Kowitz.did not see any problem with the basic. -remodeling. It all depends on whether or not they get the variance, Moved -by Comm,. Stern, seconded by Comm. Kowitz that application 268-HC=67 be recommended for approval to the City Council, per the plans submitted, subject to the 10 standard condi�- tions, the appurtenances on the roof to be shrouded; anal_the parking spaces are to conform to all City'Ord nances9 and this application recommendation is contingent on the applicant receiving approval of certain variances. Mr,:Willam Jensen., 1197 Ferry Street,.Oaklan.d, requesting Arch. &. Site.Approval for addition of a canopy over the gas`' pumps at theexistingservice station at McClellan Road .and Highway 9. VA Mr. Jensen said the fluorescent lighting will be under the canopy and will be less harsh than what is presently there. He assured the Committee there would be no A -frame or other unauthorized signs. The canopy will up -grade the looks of the station. Moved by Comm. Fitch, seconded by Comm. Stern, that applica- tion 269-HC-67 be recommended to the City Council for approval per the print submitted and per the comment that there will be no storage of products ir the pump area, and that the City Ordinances regarding signs will be adhered to, and no signs hung from the canopy. AYES: Comm. Fitch, Kowitz, Stern, Irwin NAYS: None ABSENT: Comm. Small Motion carried, 4-0 VI UNFINISHED BUSINESS Comm. Kowitz requested the Minutes show his reason for abstaining from the voting on application 265-HC-67 was because he was sympathetic to the view of the residents in the area and could not otjectively evaluate the application. Ch. Irwin said that, as a recommending body, the Committee has a responsibility to state its feelings on applications presented. There followed a discussion of Section I: PURPOSE, of Ordinance No. 306, delineating the role of the Architectural and Site Control Committee. VII NEW BUSINESS -- There was none.
