Dear Mayor, Vice, Mayor, City Council and City Manager,
I am writing today to urge you to accept the$ 9 .8M contribution by Apple Computer for bike/ped infrastructure
improvements . This will be an excellent use of funds for alternative commute opportunities for residents, and for
students to bicycle to school. Both will help reduce congestion on the streets and improve air quality.
As a bike rider and car driver I see many benefits of increasing the bicycle infrastructure in our City. This
infrastructure will reduce frustration of drivers by giving bicycles and cars their own spaces on streets, and more clarity
about the rules that regulate traffic flow .

I think you will agree that traffic congestion is among the highest priority items that is wanting solutions in our city. It
presents a danger to drivers, pedestrians, and bicyclist, especially children going to school. It also adds air pollution and
greenhouse gases to our atmosphere that advances Climate Change. It is up to the city to find ways of reducing the
amount of car travel resident do to get around town.
The Bicycle Pedestrian Commission has a city approved' Transportation Plan that will help reduce the amount of travel
by cars residents do by providing safe bicycle lanes and trails that both students can bicycle safely to school and adults
can bicycle safely around town. Not only will bicycle enhance safety but will provide exercise badly needed by both
children and adults which they can do together.
I know there are avid bicycle riders among you. Apple wants to give $1 OM to our city to go into building bicycle
infrastructure. This will go a long way towards making the Transportation Plan become a reality. I strongly urge you to
accept this gift so that the bicycle trails may become a reality sooner. It isn't often than the city is offered so much
money. Let us graciously accept the offer with many thanks .

routes to school, this message is to alert you that a discussion item tentatively scheduled for July (as noted° in my prior
communications) has been included in Cupertino's City Council meeting agenda for next Tuesday, June 18th.
During agenda Item #22 , Council will decide whether to accept or reject an almost $10 million donation from Apple,
Inc which would fund School Walk Audits, Mary A venue Protected Bikeways, and select projects identified in the
2016 Bicycle Transportation Plan and 2018 Pedestrian Plan.
The Council received an update and had a discussion about the Apple donation on April 2nd , 2019, at which time it was
unclear whether they would accept or reject the donation from Apple.
City Council welcomes community input. If you would like to contribute to the discussion, please consider adding your
voice by attending the meeting Tuesday night or writing a letter to City Council : CityCouncil @ cupertino.org .
With many other important items on the agenda that night occurring before Item #22, including a Community Shuttle
Pilot (which could be a sustainable alternative for students to get to high school), the Fiscal Year Budget and Capital
Improvement Plan adoption, and a Special Study Session about Valeo before the Regular Meeting, it may be a very
long meeting.
The Regular City Council meeting will begin at 6 :45, or later if the Special Study Session at 5:30 runs long.

For the sake ofresidents, students and workers, I encourage the city to accept the generous contribution by Apple
for bike/ped infrastructure improvements. I also encourage the city to allow Apple to fund those specific needed
improvements they have earmarked ( a sensible privilege of any donor). Doing so paves the way towards a more

The main challenge was to transform the large bicycle storage required into an attractive spot to
hang out. This was achieved by positioning the coffee bar/workshop into an elongated,
transparent space by a green slope, with the bike parking deck above. This gives the building the
appearance of a pavilion rather than a storage facility

Pedestrians keep the direct line, with their path arching over the water at 12 metres high and
giving a view over the city. The 100-metre-long cycle deck under the arch removes the slope to

Apple Bike Path Improvements
I have lived in Cupertino since 1967, when it was still San Jose. I attended Jollyrnan elementary, Kennedy junior high
and Manta Vista high school (class of '81, along with Cupertino's new city manager, Deborah Feng), as well as doing
two years at De Anza College before moving to Southern California to finish college and attend law school. I still own
a home in Cupertino, on Kirwin Lane, and I think that what Apple is proposing is brilliant. I urge the council to accept
Apple's offer to complete this very responsible and appropriate project.

The City has long hoped to extend the Stevens Creek Trail to the North and the South. The offer of the land donation
for the extension South to Linda Vista is a gift the City should not turn down . How often does the City get offered
land to extend trails? The City will want to do this at some point. Later the donation may not be available, or even if
it is, the cost will only increase to make the improvements.
Based on past city estimates, the cost estimate of $2 .2M is likely on the high end of the range . The City should look
at ways to reduce the cost, but should definitely accept the gift and move forward with extending the trails in
Cupertino.

Dear Council Members,
I have few comments on agenda item 22: Donation for the funding of select projects identifiedin
the 2016 Bicycle Transportation Plan, 2018 Pedestrian Plan, School Walk Audits and Mary
Avenue Protected Bikeway
1. The Staff Recommended Action states, "Authorize the Director of Public Works in coordination
with the grantor to apply excess donation funds from any one completed project to other projects
identified in the donation as needed and per the conditions specified in Exhibit A of the Grant
Agreement;"
I would like to see the recommended action modified to include subject to Council approval.
Since, this involves millions of dollars the ultimate authority of reallocation of funds should rest
with people's representatives that is the City council.
2 . As per the draft grant agreement, funding to projects is back end loaded which means 1/3rd of
the final payment is due only after the completion of the project. This require the City to pre fund
over $3M dollars before grantor can reimburse the City. This should be renegotiated to release the
final 1 / 3rd in stages instead of after the completion.
Also, did the City have any say in drafting the grant agreement ? Did the City get what it
requested from Apple?
Whyn the transportation project funding discussions with Apple Inc came up at the April 2nd,
2019 council meeting, the council members asked the staff to renegotiate the grants to higher
priority projects. Did the City staff attempt to renegotiate the projects/priorities and please
disclose the outcome of the discussion at today's meeting?
