at a residence located in the Oak Valley Planned Development District at 22249
Hammond Way
Chapter 19,164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Jim Redman, representing James and May Topper, is requesting to make rear
yard landscaping enhancements at an existing single-family residence at 22249 Hammond Way.
The subject property is located in the Oak Valley Planned Development District, and any
significant exterior changes require approval by the Director of Community Development.
The proposed enhancements include:
• Native, drought tolerant, and fire-resistant plantings in the rear private open space
easement
• New colored concrete walkway and patio
• Installation of new pond and seat wall
• New arbor and seat wall, with built-in fireplace and hearth
• Extension of the existing ground floor deck
• New outdoor barbeque in the deck area
• Removal of non-native, non -protected trees and replacement with native trees
• Reduction of existing lawn area
• Reduction of total water usage by 30 percent
The proposed rear yard accessory structures, handscape, and landscaping enhancements are
consistent with the Cibla ord'maace and the pertinent development standards and design
guidelines prescribed in the Oak Valley Planned Development District.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:

1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Preliminary Landscape Plan, Topper Residence, =49
Hammond Way, Cupertino, California," prepared by Elements Landscape dated June 12,
2012 and consisting of 3 sheets labeled LI, L2, and L3; except as may be amended by the
conditions contained in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. COMPLIANCE WITH OAK VALLEY USE PERMIT CONDITIONS
The project shall comply with all applicable conditions of Oak Valley Use Permit no. U-
1997-06.
4, BUILDING PERMIT
The applicant shall be required to obtain the necessary building permits through the
Building Division prior to commencement of work.
5. PROTECTED TREE COVENANT
Prior to final approval, the property owner shall be required to record a covenant with the
Santa Clara County Recorders Office requiring that the new tree plantings shall be
maintained as protected frees in accordance with the City's Protected Trees Ordinance.
Failure to do so may result in code enforcement and/or administrative citations.
6. NOTICE OP PEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you willbe legally barred from later
challenging such exactions.
This approval of the modification is effective June 19, 2012. The fourteen calendar day appeal
period will expire on July 3, 2012.
