RESOLUTION NO. 9533
A RESOLUTION OF THE C[TY COUNCIL OF THE CITY OF CUPERTINO
SUPPORTING PILOT PROGRAM FOR ROUTE 85 NOISE ABATEMENT
WHEREAS, Califomiu Statc Route 85 Freewuy was opened for traffic through
the City of Cupertino in October 1994; and
WHEREAS, noise mitigation measures exceeded that of Caltrans standards
through performance standards set forth by cities along Route 85; and
, WHEREAS, noise levels aRer the completion of Route 85 are unacceptable to
residents; and
WHEREAS, soundwall treatment, raad surface materiai can have an efl'ect on
sound level reductions where retrofit measures can diminish sound levels to acceptuble
levels; and
WHEREAS, the current freeway noise mitigation standards of the Federul
Highway Administration fail to account for the noise variance from road surfaces und fail
to account for design profile effects on noise which could be effectively mitigated
through design choices which, when taken together, could be upplied to minimize
freeway noise in urban residential ateas, at little or no additionai cost to the project; and
WHEREAS, such current tec}u~ology und design application should be undertaken
on a demonstration basis to determine whether federal noise mitigation standards should
be modified for new freeway design and to develop retrofit progrtims for existing
freeways; and
WHEREAS, the City of Cupertino does not have funds to undertake such an
effort; and
WHEREAS, Route 85 Freeway Noise Abatement Committee has expectise that
could assist in developing strategies which Caltrans can employ to a pilot project to
determine the results in actual field situations; and
WHEREAS, Califomia Statc Route 85 through the City of Cupertino is a
preferred location for u demonstration pmject becausc of the extensive pre-freeway and
post-freeway noise studies which have ulready been completed in the areas which would
provide the best bench mark of the effects of noise reduction strategies on depressed
profile freeways where retaining walis are used And the freeway location is in a
completely urbanized residential corridor.

NOW, THEREFORE, E3E I"C RESOLVED that the mcmbers of the Stute
Assembly and the State Senate representing the City of Cupertino are urged to sponsor
legislation to provide for a demonstration project for new installntions and that the
Cnlifornia State Route 85 in Cupertino be a test sitc Cor a rctrofit demonstrntinn project
using current technology and design methods to achieve maximum noise reduction from
freeways where urban residential conditions exist.
