Written CommunicationsCC 07-08-19 #2 Settlement Agreement between City of Cupertino and former City Attorney, Randolph Hom Written Communications CC 7/8/19 Item #2 Cvrah Caburian From: Ian Greensides <ian@greensides.com> Sent: Monday, July 08, 2019 11:52 AM To: City Council Cc: City Attorney's Office Subject: Settlement of Randy Hom Tort Claim Dear City Council, am writing to express concern that the council is considering a settlement of the tort claim filed by Randy Hom. I believe that Mr. Hom's claim lacks merit, in that his termination was lawful and did not violate any employment laws. As an attorney, I have handled public entity claims in the past. I believe that Mr. Hom violated his duty of loyalty and the attorney client privilege when he publicly discussed privileged communications that he had with the city council about the SB50 application to redevelop the Vallco mall property. In addition, Mr. Hom filed this claim, just before the election, a move designed to sway a close election. A settlement would appear to be compensation to Mr. Hom for having swayed the election in favor of the current city council members. I urge Mr. Willey, Mr. Chao, and Mr. Paul to recuse themselves from the issue of settling the Randy Hom tort claim issue. Thank you for your consideration.
