assistance and cooperation in instituting several of the assign-
aents put to tbem during the past year. He then declared the
Offic:e of tbe Mayor vacant.

appoint Councilman Noel to the Offic:e of Mayor of Cupertino for
tbe year 1971-1972.

29. Appeal of Mario and Rita Barbieri requesting reversal of the
Planning Commission denial of application 4-TM-71 for a
Tentative Hap to divide 4.1 acres located at the northwest
corner of Stevens Creek Boulevard and Vista Drive to allow
c:onstruc:tion of a gasoline sales/automatic car wash on one
parcel.
The Planning Director reviewed the action of tbe Planning Commission
a~d displayed a transparency of the area in question. He stated
that it would be logical to have Vista Drive as backup street for
Highway 85 and it sbould be widened to two lanes in each direc:tion.
This affects tbe Tentative Hap because it would require 14 feet
on eac:h side. This additional dedication would render this lot
#1 tOO small to func~ion properly.
Attorney Dan Donovan, representing the applicant, asked for
relief for tbe Barbieris on tbe basis of hardship. They purchased
the property in 1968 for $85,000 and vere not aware of tbe Tenta-
tive Map requirements. The County Assessor's map and the title
searc:h did not reveal tbese requirements. In Harcb 1969 they
rec:eived ~ separate tax bill for parcel II. When they decided to
sell this troperty tvo years ago they found tbis vas not an
officially subdivided lot. Hr. Donovan said the applicants have
abandoned ~he application for a permit for a car vash. He
pointed ouc that tbis is the saae Tentative Map the City found
acc:eptable two years ago.
Hr. Donovan said tbe developaent of tbe Mariani property is conjectural
at this point. It may be developed five, ten years frOlD now - or
..ybe never. The Barbieris were sold this parcel on the basis that
only a 60' wide street vould be required. He submitted that if an
additional 14' for streeta is needed for Mariani Hall, then the
developer of the mall should sbare the expenses.

stop ligbt, based on construction south of Homestead Road. He said
the signals vere modified so that they won't have to be changed

Mayor Noel asked if this could become effective after there is some
traffic soutb of Homestead &cad. ~r. Yarboraugh said the original
installation costs were shared by Cupertino, Santa Clara County ~~d

beforF the City Council; then it should go back to the Planning
eo..ission and H-Control. It should be considered an en:irely
new applic:ation. He did not beli~ve this œatter belonged at
Council level at this time.

that there vas still a valid Use Permit for a service station on

Councilman Green felt it would be more expeditious to deny the
application and let the applicant start allover. Councilman
Stokes said the Council would rot back off from that condition.
The City Attorney pointed out tbat bis statements about the
validity of the Use Permit were directed to the City Staff and

The Direc:tor of Public Works requested an adjustment from $1000
