better to leav~ it as is, due to tbe far.t that trash has a tendenc

that the City Councll adopt the policy authoTizing the utilization of
a defeTTed developaeøt asreement and authorize the City Attorney to

which would facilitate adoption of tbe policy.
As to tbe underground vater rights, the Director recommended the convey-
ance of s~id water risbts to the City be required with the provision
that the owners and successors in interest to these parcels viII have
the right to utilize existing wells for the purpose of providing domestic
and agricultural vater supplies necessary to satisfy their needs, except
that at such time as the property is to further develop, the City may
require that the water supply distribution system shall be developed to
City standards under the auspices of an improved utility source desig-
nated by the City Council.
The Director recommended that the ûpplicant apply to the County Health

The Director of Public Works answered CouncillD8l1 Stokes that a
study could be completed 10 3 to 6 montbs.
Hrs. Katby Nellis presented charts shoving that Los Catos charges
$850, Saratoga - $450, Los Altos Hills - $200, Santa Clara
County - no fee, Cupertino minimum is $150 and average is $180.

39. Appeal by Hr. Emil V. Mathews for a Council decision of an
Ad~inistrative interpretation by the Building Official.
The Director of Planning and Develop~ent referred tte Council to
tbe lea¡:thy staff report on ;:his subject. The Assistant City
Attorney quoted the Ordinance wherein it is the duty cf the City
Council to give a decision on an administrative inter?retation
by the Building Official.
Mr. Hathews gave a detailed documented report of his problem,
whicb se,,:ned to center around the fact that he feels t~¡e contrac-
tor did not comply with Ite= 32 of the Plan Check Steels (double
oarallel floor joists uDder parallel partitions). He felt that
.he Building Departce~t vas deficient in signing this off as
completed. He presented three exhibits: Exhibit A - a 51004.0g
bill sub~itted to the City of Cupertino: Exhibit B - 54519 for
other expenses; Exhibit C - the October 18, 1971 letter to the
contractor, copying Mr. Benevicb.
There followed a technical discussion about what Ite~ 32 actually
said. The Building Official said tnere is a clerical error in
Item 32 of the Check List, Which has been corrected. It now says,
as it should, that there shall be double parallel joists under
hearing partitions.
Mr. M~thews said that 19 of 86 itelllS are Code violations, but be
won't let them in the house to correct tbem.
