RECOMMENDATION
Staff recommends that the Planning Commission approve:
1. The tree removal application, file number TR-200S-02, in accordance with
the model resolution.
BACKGROUND
The property owners, the Roans and Yeungs, share a specimen size Coast Live
Oak (Quercus agrifolia) that straddles their common side property line. They are
requesting a tree removal permit for the removal of over 25% of the canopy of
this tree (Exhibit A), which measures 27.6 inches in diameter (measured 4'12 feet
above grade). Per the City's Municipal Code Section 14.18.020 J, removal of
greater than 25% of a specimen tree is considered tree removal that requires
Commission approval per Municipal Code Section 14.18.090. The permit is being
requested retroactively since over 25% of the tree's canopy was removed in
November 2004, without a tree removal permit. The applicants claim that less
than 25% of the oak was removed. The City's consulting arborist, Barrie D.
Coate & Associates, provided a report on the past and recent pruning of the oak
tree, an assessment of how much was removed, recommended measures to
prevent long term problems and appropriate mitigations if any (Exhibit B).
DISCUSSION
Past Pruning The Coate's report notes that the oak has been severely pruned in
the past, particularly on the west side. The west side of the canopy was
truncated in the past, most likely to make space for the westerly 2-story house.

Tree Removal
A review of the 1985 subdivision file (#IS-TM-8S) shows the oak was recognized
as a protected tree under Cupertino's tree ordinance, but there are no additional
records to show what pruning, if any, was allowed to accommodate the
dwelling. Staff also observed a number of older cuts of larger branches (about 8"
diameter) on other sides of the oak. It is not possible for staff to date or
determine whether this previous pruning would have required a tree removal
permit.
Recent Pruning
The City Arborist visited the site, as well as reviewed photographs of the oak
taken during the pruning activities (Exhibit A). He noted that most of the foliage
was removed, excluding one water sprout, from the 12" diameter south facing
limb. A 10" diameter branch was stub cut to 4" diameter on the north side and
about 5-10% of the foliage was removed from branches remaining on the west
side of the upper canopy. In addition, the entire upper canopy and the canopy in
the northwest quadrant was excessively thinned of all interior branchlets and
twigs. Other cuts throughout the canopy has left the canopy abnormally thin
and highly susceptible to sun scald on the newly exposed westerly parts of the
oak.
The City Arborist has reviewed the level of pruning and estimates that 40% - 45%
of the canopy was removed (page 2 of the arborist report). Staff has reviewed his
numbers and cannot duplicate his calculations. Staff believes there is a
mathematical error and is awaiting a clarification from the Arborist. Using
conservative assumptions of the arborist's numbers, staff estimates that at least
28% of the canopy was removed.
The onsite code enforcement officer who observed the foliage on the ground and
the size and number of branch cuts estimated that about 35% of the tree had been
removed. The Code Enforcement Office regularly responds to tree removal and
pruning complaints as part of its duties. In all cases, staff estimates more thán
25% of the oak tree was pruned.
The City Arborist believes that 25% of the value of the tree was lost with the
excessive pruning, which is about $2,750 (25% of $11,000). Since the entire tree
was not removed, staff does not believe that additional trees should be planted
as mitigation. The City requires property owners to file for a tree removal
application, even if the tree has already been pruned or removed in order to
ensure proper mitigation measures. Additional work is needed to prevent

further harm to the oak. The City Arborist recommends the following as detailed
in his report:
Tree Removal
1. Re-cut the stub-cut limb on the south side back to the 2" diameter water
spout which emerges 5 feet from the trunk. Pruning should be done by
an ISA certified arborist to ensure that no other pruning occurs.
2. Remove the 18-foot tall California Date Palm which is adjacent to the oak
and whose crown will eventually grow into the canopy of the oak.
3. Apply a mixture of 50% light colored latex paint and water to all newly
exposed limbs on the west side to prevent sun bum of the limbs, which
causes tree wounds.
4. Excavate soil around the oak trunk to expose buttress roots on all sides to
avoid oak root fungus infection. Completed work should be inspected by
a certified arborist to ensure the buttress roots are truly exposed.
5. No pruning should be done for three years, except to re-cut the stub-cut
limb on the south side (See recommendation #1) or in an emergency
safety situation.

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVAL ACTION
The year 2004 removal of large and smaller limbs, branch ends and overall thinning
of the canopy constituting over 25% of the canopy of the 27-inch diameter Coast
Live Oak Tree in the front yard between 21535 and 21545 Addington Court is hereby
authorized.
2. CORRECTIVE TREE WORK TO PREVENT LONG TERM PROBLEMS
The applicant shall engage an International Society of Arboriculture (ISA)-certified
arborist to execute additional tree work recommendations #1, #3 and #4 specified in
a report titled: "An Assessment of the Tree Pruning at 21535/21545 Addington
Court, Cupertino" prepared by Barrie D. Coate, ASCA, Consulting Arborist, dated
February 14, 2005. Upon completion of the work, the arborist shall submit a letter to
the Community Development Director summarizing the work accomplished.
Recommendation #2 in the same report-- the removal of the California Date Palm
nearest the subject Coast Live Oak-may be done by any tree removal contractor
hired by the applicant(s).
3. 3-YEAR PRUNING PROHIBITION
Except for the tree work listed in Condition #2 and an emergency safety situation,
all pruning of the oak shall be prohibited for a period of three (3) years effective the
date of this tree removal approval.
4. NOTICE OF FEES. DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66020(d) (1), these Conditions constitute written notice of
a statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you
fail to file a protest within this 90-day period complying with all of the requirements
of Section 66020, you will be legally barred from later challenging such exactions.

Assignment
I was asked to answer the following questions regarding a Code Enforcement case in
which property owners allegedly removed over 25% of a Coast Live Oak Tree,
1. How much of the tree was removed?
2. Does additional work need to be done to the tree for its health or the safety of the
structure?
3. What are appropriate mitigations for this situation?
In addition, I was asked to read the documentation provided to me by Mr. Gilli.
Observations
Past pruning
The tree has been severely pruned in the past removing several limbs of8"-12" diameter,
most of them on the west side, apparently for construction on the house at 21545.
The tree is appears to be directly on the property line between the two properties.
It is 4' from the house foundation to the west.
The tree is 42' north of the sidewalk and more or less at the end of a long boxwood hedge
which is apparently planted on the property line.
The tree has a 27.6" DBH (diameter at 4Y2' above grade) and is 47' tall (measured with a
clinometer. )
The tree's canopy is composed primarily of three main limbs which divide from the main
trunk at approximately 12' above grade.
The largest of these three limbs are 14" and 16" in diameter at the point where they join
the main trunk.
The third limb which was stub cut at 12' from the point where it joins the main trunk is
12" in diameter.
Each of the major limbs divides again into 12" and 10" diameter branches at 18-25'
above grade.
90% of the canopy of the tree is now on the east side over the garage at 21535 and only
10% of it is over the 21545 home and property.
Recent pruning
Recent removals from the canopy include primarily and most importantly, all of the
normal foliage, excluding one water sprout, from the 12" diameter south facing limb.

In addition, a 10" diameter branch was stub cut to 4" diameter, 15' ITom the parent limb
on the north side. Approximately 5-10% of the foliage was removed fÌ'om branches
remaining on the west side of the upper canopy.
In addition to all of that, the entire upper canopy of the tree and the canopy in the north-
west quadrant have been excessively thinned of all interior branchlets and twigs, leaving
the tree far thinner than is nonnal and healthy for a young Coast Live Oak (Quercus
agrifolia).
Numerous large cuts were made throughout the canopy ITom to 3-4" diameter branches
back to I" diameter water sprouts, leaving the canopy abnormally thin and highly
susceptible to sun scald on the west facing newly exposed parts.
Ql. How much ofthe tree was removed?
Since there were 5 major parts to the tree's canopy which are more or less equivalent to
the south-facing limb which was stub-cut, and those branches were 12", 10" 12" and 10"
respectively. They total 44 diameter inches. The south facing limb of 12" diameter was
stub cut to remove all nonnal foliage. That implies that 36% of the canopy was removed,
merely by stub-cutting that one limb.
In addition, however, the severe thinning over the center and west side of the canopy to
remove 2", 3" and 4" diameter parts, leaving a very thin canopy, has removed at least
another 5-10%.
Removal of branch ends back to small water sprouts in the southern side of the canopy
have resulted in loss of at least another 2-5%.
Summary
In my opinion, at least 40% and perhaps 45% of the foliage has been removed during this
recent pruning to say nothing of the severe pruning that has been done to the tree in the
past.
Q2. Does additional work need to be done to the tree for its health or the safety of
the structures?
I recommend the following procedures for the tree's benefit and to prevent long tenn
problems:-
I. Re-cut the stub-cut limb on the south side back to the 2" diameter water sprout
which emerges 5' from the trunk. This is not a nonnal branch but it will at least allow the
tree to produce significant foliage in this portion of its canopy, and to prevent this part of
the tree fÌ'om starving fÌ'om lack of nutrient supplies produced by the foliage.
I suggest that only an ISA certified arborist be allowed to pnme this tree to ensure that no
other pruning occurs,

2. Remove the California Date Palm which is now approximately 18' in height. As
it grows and expands its crown diameter, it will grow directly into the canopy of the oak
tree.
3. Apply a mixture of 50% light colored latex paint and water to all the west side of
newly exposed limbs to prevent sun burn which inevitably will happen unless those parts
are protected. Sun burn will cause wounds on the west side of the exposed wood which
results in permanent decay sites where that sun burn occurs if not prevented.
4. The tree trunk is in a pit surrounded by a wooden retaining wall. The soil within
the retaining wall must be excavated to the depth where buttress roots are visible on all
sides of the trunk to avoid oak root fungus infection. This should be inspected by a
certified arborist after the work is completed, to ensure the buttress roots are truly
exposed.
Q3. What are appropriate mitigations for this situation?
There is certainly enough tree left to be worthy of retaining, but on the other hand, the
tree has lost approximately 25% of its value due to this excessive pruning.
Before the excessive pruning occurred, the tree would have been valued at $11,000.
25% of that value =$2,750
In relation to the statement :&om Yueh-Ing Roan regarding a medically diagnosed skin
disorder, I have never been told of a skin disorder related to insects or allergies caused by
oak trees.
Conifer flowers such as cypress, pine and cedar are known to cause allergies, but that
occurs only during the time the pollen is airborne in March.
I do not see evidence of insects in this tree and since I inspect Coast Live Oaks for insect
invasion weekly in one location or another, I can testifY the symptoms would have been
visible enough for me to identifY them.
There is a small incidence ofsinipid gall wasp damage to some of the leaves, but since
this tiny wasp is never encountered by people and the galls wasp themselves cause no
impact to people, that could not be the cause of a medical problem.
Conclusion
If this tree is not pruned for 3 years, its reasonably good health will gradually result in
production of enough foliage to support the canopy and carry on growth processes.
However, no pruning should be done for at least 3 years, because it needs all the foliage it
has to continue to production of adequate carbohydrates.

Next time pruning is done, end-weight reduction should be done rrom the eastern portion
of the canopy to reduce branch length and foliage density on that side.
The long tenn result of the severe interior thinning that was done recently, is longer, end-
weight heavy limbs which are more vulnerable to breakage than if this poor pruning
practice had not occurred.
No additional interior thinning should be allowed in this tree until it has produced a solid
canopy of foliage.

CONSULTING ARBORIST DISCLOSURE STATEMENT
Arborists are tree specialists who use their education, knowledge, training, and experience to
examine trees, recommend measures to enhance the beauty and health of trees, and attempt to
reduce risk of living near trees. Clients may choose to accept or disregard the recommendations
of the arborist, or to seek additional advice.
Arborists cannot detect every condition that could possibly lead to the structural failure of a tree.
Trees are living organisms that fail in ways we do not fully understand. Conditions are often
hidden within trees and below ground. Arborists cannot guarantee that a tree will be healthy or
safe under all circumstances, or for a specified period of time. Likewise, remedial treatments,
like medicine, cannot be guaranteed.
Trees can be managed, but they cannot be controlled. To live near trees is to accept some
degree of risk. The only way to eliminate all risk associated with trees is to eliminate all trees.

We exercised our greatest effort to understand the report prepared by Mr. Barrie Coate,
an ISA certified arborist. We would like to comment and address our questions as
follows:
Pa!!e 1: under 'Past pronin!!'
We understood that (3) three main limbs composed tree's canopy, namely 12", 14", and
16" in diameter despite Mr. Coate stating at beginning of the paragraph that several 8" to
12" diameter limbs were severely pruned. The 12" diameter limb was stub cut to the
trunk, leaving the 14" and 16" diameter limbs to branch into 10" and 12" diameter limbs
respectively.
Therefore, we concluded there were (4) four limbs, namely the 10", 12", 10", and 12"
diameter limbs remaining to fonn the canopy at certain elevation ITom the ground.
These houses were built approximately 20 years ago under a tract subdivision action.
According to the Ordinance, we want to believe the Planning Department had exercised
the same practice such that this oak tree was severely pruned under the work of a certified
international arborist.
We would like to review the tract conditions and these pennits and would like to know
the particular ISA who did the work. For (20) twenty years, the canopy of this tree has
been always thin and the boundary conditions around the root have never been tempered.
Pa!!e 1 and 2: under 'Recent prunin!!'
We would like to comment that, according to the Ordinance, so long as the removal of
canopy is fewer than 25%, all the conditions observed are acceptable and deserved no
concern of nobody. We also like to ask the question, which are the cuts of that 24.99% of
the canopy?
Pa!!e 2: under '01. How much of the tree was removed?'
We have problem understanding what Mr. Coate is trying to address.
Mr. Coate stated there are (5) five major 'parts' to the tree's canopy. Therefore prior to
pruning, these major 'parts' should add up to (12"+10"+12"+10"+12") = 56" in diameter.
South-facing limb was stub cut. Therefore the 'implied' percentage of canopy that was
removed should be (12"/56") = 21.4% by following Mr. Coate's logic. By further
following Mr. Coate's logic, we add (40/0-9%) to the 21.4% which yield the percentage
of the canopy removed in the range of(25.4% to 30.4 %.)
However, in view of the attached picture #3 as provided, there is certainly far more than
(5) five branches contributing to the canopy. We can easily account for (9) branches and
demonstrate the pruning is less than 25%.

Pal!e 2 to 3: under 'Does additional work need to be done to the tree for its health or
the safetv of the structures?'
We would like to comment that the boundary conditions of this tree have never been
changed since the house was built.
A recent photo was taken of the stub cut 12" diameter limb. Compared to picture #3 in
the report, it is obvious that not only this part of the tree is not in a starving situation but
is vigorously producing new foliage.
Pal!e 3: under '03. What are appropriate mitil!ations for this situation?'
We would like to know how Mr. Coate derives the 25% loss of value.
Pal!e 3 to 4: under 'Conclusion'
We would like to know if there is any unbalanced foliage weight problem, which might
potentially cause breakage of the branches and damage the structure or injure people. The
oak tree next door was tumbled and crushed the garage in the past.

1. APPROVAL ACTION

Live Oak Tree in the front yard between 21535 and 21545 Addington Court is hereby
authorized.
2. CORRECTIVE TREE WORK TO PREVENT LONG TERM PROBLEMS
The applicant shall engage an International Society of Arboriculture (ISA)-certified
arborist to execute additional tree work recommendations #1, #3 and #4 specified in
a report titled; "An Assessment of the Tree Pruning at 21535/21545 Addington
Court, Cupertino" prepared by Barrie D. Coate, ASCA, Consulting Arborist, dated
February 14, 2005. Upon completion of the work, the arborist shall submit a letter to
the Community Development Director summarizing the work accomplished.
Recommendation #2 in the same report-- the removal of the California Date Palm
nearest the subject Coast Live Oak-may be done by any tree removal contractor
hired by the applicant(s).
3. 3-YEAR PRUNING PROHIBITION
Except for the tree work listed in Condition #2 and an emergency safety situation,
all pruning of the oak shall be prohibited for a period of three (3) years effective the
date of this tree removal approval.
4. NOTICE OF FEES. DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to

Application Summary:
Hillside exception for a new 6,500 square foot residence on a prominent ridgeline
with slopes greater than 30% and exceptions to the maximum wall height on the
downhill elevation and to exceed the maximum grading quantities.
RECOMMENDATION:
Staff recommends that the Planning Commission approve file no, EXC-2005-08
and EA-200S-02 subject to the model resolution.
BACKGROUND:
The project site is located at the terminus of Regnart Road, with access off of a
private road that serves two homes. The existing home on the subject site will be
demolished, and the proposed new house has a main level (4,022 square feet)
and a lower/basement level (2,477 square feet) that is only visible from the west
and east elevations. A deck wraps around most of the west and east elevations.
The house is currently on a septic system. The new house will be connected to
the City's sewer system.
DISCUSSION:
Prominent Ridgeline:
The proposed residence is located on a prominent ridgeline as shown in Exhibit
A. The visibility analysis provided by the applicant is enclosed. Story poles
were constructed on the site. From the six established vantage points, the
analysis concludes that the residence is not visible from any vantage points.
Only the adjacent properties can see the residence, and these homeowners have
provided a letter öf support (Exhibit B). In addition, the residence presents a
low, single story profile from most directions. Even though the house has two
levels, it has the visual appearance of a single story house. The style is simple
and linear, and the colors and materials create a natural appearance. At staff's
request, the applicant has set the residence into the ground as much as possible.
Existing and proposed landscaping provide mitigation of eliminating visual
impacts. The applicant also agrees to plant two additional trees along the west
elevation and one additional tree along the east elevation to help better screen

the house from properties down below, Staff believes that proposal has no
negative visual impacts.
Developments on Slopes Greater Than 30%
The Hillside Ordinance prohibits any structures or improvements to occur on
slopes greater than thirty percent unless an exception is granted. The average
slope of the project site is approximately 44% and the majority of the project site
has over slopes greater than thirty percent. The project house replaces the
existing house at its current location with a minimum amount of disturbance to
the surrounding grade. The area in front of the proposed garage along the west
elevation and the covered patio area along the east elevation are the only areas
that will receive a more significant amount of alteration to the existing grade.
Both areas are essential to the proper functioning of the new home. Excavation
of the area in front of the garage is necessary to facilitate a driveway accessing
the garage. The excavation of the area under the covered patio is intented to
create a usable leveled space on a site with a minimal amount of useable flat yard
area. The access driveway will also be lowered by a foot along the westerly side
of the house for the house to have a lower profile. New trees and shrubberies
proposed along the westerly and easterly property line will eliminate any
negative visual impacts from these areas. Staff supports the exception to allow
for the above-mentioned developments to occur in area with slopes greater than
30%.
Downhill Elevation Wall Height
The Hillside Ordinance limits the downhill facing wall heights to fifteen feet.
The intent here is to address highly visible and unarticulated wall masses facing
downhill. Portions of the project wall heights facing the westerly and easterly
elevations (downhill) are 23 feet tall. However, these wall planes are well
articulated with the roof arcade and patio feature at the main level. The actual
walls are recessed approximately 13 feet from the edge of the roof and patio
railing. In addition, only approximately 15 feet of the wall height tucked under
the main floor roof arcade will be visible. Staff believes the project meets the
intent of the Hillside Ordinance.
Maximum Grading Ouantities
Site grading in hillside areas is limited to a cumulative total of two thousand five
hundred cubic yards (cut plus fill). The project proposes 2,600 cubic yards of cut
mostly from the excavation of the basement/lower level and the lowering of the
existing driveway. Staff supports allowing the extra 100 cubic yards of cut
because that allows the house to sit lower on the ridge and minimizes any visual
impacts of the home.

Geological
The City Geological Consultant has reviewed the geo-technical report submitted
by the project geologist and recommends approval of the project. The project
shall adhere to all of the recommendations by the City Geological Consultant as a
condition of this project.
Tree Removal
Forty-two trees currently exist on the project site. The applicant proposes to
remove sixteen of them and plant thirty-four new trees. None of the trees
removed are specimen or protected species. As a condition, the City Arborist
will review the final building plans and the tree protection measures/inspections
must be carried out prior to the issuance of building permits.

WHEREAS, the necessary notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more

1. The proposed development will not be InJUrIOUS to property or

6. The proposed development does not consist of structures on or near known
geological or environmental hazards that have been determined by expert
testimony to be unsafe or hazardous to structures or persons residing therein,
(See General Plan Policies 2-48.)
7. The proposed development includes grading and dri}inage plans that will
ensure that erosion and scarring of the hillsides caused by necessary
construction of roads, housing sites, and improvements will be minimized.
(See General Plan Policies 2-53, 2-54 and 2-57.)
8. The proposed development does not consist of structures which would
disrupt the natural silhouette of ridgelines as viewed from established
vantage points on the valley floor unless either:
a. The location of a structure on a ridgeline is necessary to avoid greater
negative environmental impacts; or
b. The structure could not otherwise be physically located on the parcel
and the size of the structure is the minimum that is necessary to allow
for a reasonable use of the parcel. (See General Plan Policies 2-46, 2-47
and 2-49.)
9. The proposed development consists of structures incorporating designs,
colors, materials, and outdoor lighting which blend with the natural hillside
environment and which are designed in such a manner as to reduce the
effective visible mass, including building height, as much as possible without
creating other negative environmental impacts, (See General Plan Policies 2-
46,2-50,2-51 and 2-52.)
10. The proposed development is located on the parcel as far as possible from
public open space preserves or parks (if visible therefrom), riparian corridors,
and wildlife habitats unless such location will create other, more negative
environmental impacts. (See General Plan Policies 2-55, 5-14 and 5-28.)
11. The proposed development includes a landscape plan that retains as many
specimen trees as possible, which utilizes drought-tolerant native plants and
ground covers consistent with nearby vegetation, and which minimizes lawn
areas. (See General Plan Policies 2-54, 5-15 and 5-16.)
12, The proposed development confines solid fencing to the areas near a
structure rather than around the entire site. (See General Plan Policy 5-17.)
13. The proposed development is otherwise consistent with the City's General
Plan and with the purposes of this chapter as described in Section 19.40.010.

2. FINAL COLOR APPROVAL
The Director of Community Development shall approve the final colors, which
shall be muted earth tones, meet the hillside reflectivity standard and be deep
rather than pale.
3. TREE PROTECTION
Existing trees shall be protected during grading and construction with chain-link
fencing around the drip-line. The City Arborist will review and approval the
final building and landscaping plans prior to issuance of building permits. A
bond in the amount of $10,000 shall be submitted to ensure tree protection. The
bond may be released following receipt of a report by an internationally certified
arborist that the trees have been adequately protected during development and
are expected to survive.
4. ADDITIONAL SCREEN TREES
A revised landscaping plan shall be approved by the Planning Department prior
to issuance of building permits indicating the additional screens as described in
the staff report dated June 15, 2005.
5. ELECTRICAL GATE
The City of Cupertino prohibits automatic electrical gates on residential
properties. An existing electrical gate is shown on the site plan. If the gate was
built prior to September 20,1999 then it is considered legal non-conforming and
may remain as is. If the gate is built after September 20, 1999, then the electrical
mechanism or components shall be removed. Prior to final occupancy, applicant
shall submit records confirming the construction date of the electrical gate.

Fire hydrants shall be located as required by the City, under the direction of San
Jose Water and the Fire department.
11. STREET TREES
Street trees shall be planted within the Public Right of Way and shall be of a type
approved by the City in accordance with Ordinance No. 125.
12. GRADING
Grading shall be as approved and required by the City Engineer in accordance
with Chapter 16.08 of the Cupertino Municipal Code. 401 Certifications and 404
permits maybe required. Please contact Army Corp of Engineers and/ or
Regional Water Quality Control Board as appropriate.
13. DRAINAGE
Drainage shall be provided to the satisfaction of the City Engineer,
* Pre and Post-development storm drain hydraulic calculations must be provided
to identify if storm drain facilities need to be constructed or renovated.

The developer shall comply with the requirements of the Underground Utilities
Ordinance No, 331 and other related Ordinances and regulations of the City of
Cupertino, and shall coordinate with affected utility providers for installation of

We feel the home depicted on the plan dated 12.16.04 as prepared by Martin Bernstein
Architect AlA. copy given to us on January 16,2005 will fit well on the site and be a good
addition to our neighborhood. Our only question at our last meeting was the height of the roof
over the entryway.
Subsequent to our meeting we met with Robert Nellis, one of the original founders of our
association to discuss the intention of the height limitation and the tenn "exclusion of chimneys
and other minor appurtenances" (section 7.13),
We also met with Mr. and Mrs. Ishi of22350 Regnart Rd. being the adjacent property whom
will have a direct view of the entry elevation, They expressed no objection,
It is our opinion the area in question is above the entryway, is not living area and is in fact an
architectural accessory therefore we can support the plan you have submitted.

Assignment
On April 7, 2005, I inspected the trees that might be affected by construction at the Bernstein
property at the end of Regnart Road.
A reduced plan titled "Master Landscape Plan" as prepared by Bruce Allen Chan, landscape
architect, undated, was used to prepare this report.
Summary
Although Mr, Chan has listed 19 existing trees on the property I found only six trees that are
likely to be affected by construction at this property.
The dominant specimen of concern should be the one listed by Mr. Chan as coast live oak #16
a very large specimen of this native species in the backyard.
The other trees that could be affected are two small coast live oaks and one multi-stem
European olive tree, one Douglas fir and one Monterey pine,
It should be noted that a group of trees identified in Mr. Chan's review which are seen uphilI
and southwest of the entryway drive to the property and are functionally a foreground for an
adjacent property have all been topped.
This is no doubt to enhance the view trom that adjacent uphill property.
It has essentially destroyed the value of JO swamp gum trees (Eucalyptus rudis) of 6-12 inch
trunk diameters.
The area in question and those individual trees would not be affected by proposed
construction on this property and the damage to them appears to be unrelated to this
construction.
Specific Trees
Tree #1 is a healthy coast live oak (Quercus agrifolia) downhill east of the adjacent
construction and would only suffer trom this construction activity if soil were pushed down
over its root zone area,
Tree #2 is a massive coast live oak which has been severely overthinned and is currently
suffering from the results of that overthinning, i.e., excessively heavy endweights with high
potential for limb breakage due to that excessive thinning.
In addition this tree is heavily infested with ehrhom scale (MycetococclIs ehrhorni), an
insect/fungal symbiotic combination which will have to be controlIed by pest control
measures,
The patio and tile overlay area that are planned beneath this canopy have the potential for
being severely damaging to the root zone and I would suggest that the square footage of the
area which is paved beneath this canopy be reduced or its method of installation be amended.

Tree #3 is a coast live oak which is currently outside the existing fence line and downhiH just
above the adjacent roadway.
It would appear that the planned patio would extend to just above this tree and potentially
push a significant amount of soil down over its root zone,
Tree #4 is multi-stem olive which has been pruned severely on the east side and is badly
misshapen but in spite of that is extremely healthy.
I would not expect the proposed activity to have a serious affect on that tree.
Tree #5 is a Douglas fir in reasonably good health which will be on the margin ofthe planned
lawn.
If landscaping adjacent to that doesn't apply water in the area beneath its canopy that tree
should be unaffected by proposed construction,
Tree #6 is downhill and by a considerable distance and more or less directly west of the
majority of the project area.
It would only be affected by the construction of an elevated deck below the existing road in
that area.
Trenching
No trenching for any purpose may occur beneath the canopy of any of the six trees addressed
in this report.
That includes trenching for services such as sewer, water, and drainage but also includes
trenching for irrigation mainlines or lateral lines,
I recommend that location of any trenches be shown on plans for the property before permits
are issued and that an inspection to be sure that those trenches have been installed only in
those locations authorized by the planning department have occurred,
Recommendations
Tree #1
Silt fencing must be installed near the top of the slope and just outside the proposed
construction activity area in an area approximately 30 feet long to prevent any soil from
traveling downhill into the area beneath that tree's canopy.
Under no circumstances may soil be pushed over this edge.
If soil does end up over the original soil grade beneath its canopy it must be removed by hand,
not by machine to leave all areas beneath the tree's canopy and 10 feet beyond clear of fill
above the existing current grade.

Tree #2
I recommend:
a) For the benefit of the tree and the homeowner that a ISA certified arborist who is
highly familiar with endweight reduction and drop crotch pruning procedures be
asked to reduce the density of the branch ends during August 2005 on this tree to
prevent limb breakage in the next two years.
b) Ehrhorn scale which is represented by the white patches on the underside of the
young branches and branchlets must be controlled by a certified pest control
operator.
c) A fence must be installed as shown on the enclosed plan to prevent damage to the
root zone of this tree during the construction process.
This fence must be composed of 5 foot tall or taller chain link fencing material
installed on 2 inch galvanized iron post driven at least 2 feet into the ground.
Warning signs' must be hung on the top of this fence on 10 foot centers warning
all contractors and subcontractors against the removal or damage to this fence,
This fence must remain intact and undamaged during the period before
construction or demolition begins on the project and the time when all contractors
and subcontractors are finished and gone wm the project.
d) I suggest that the concrete patio with tile overlay be reduced in square footage as
shown on the enclosed plan section to reduce the proportion of root zone of tree #2
which is covered by this surface.
e) In addition the walkway which is shown beneath the southwest side of the canopy
must be removed as well.
If on the other hand that walkway can be installed as pervious base material such
as coarse sand laid on top of existing grade without any excavation of any sort in
preparation for paving stones installation that would be acceptable.
I repeat however no excavation in preparation for installation of that walkway
should be allowed.
If the owner finds it acceptable to install the patio section which is beneath any
portion of the existing tree canopy in the same manner that would be acceptable
but I repeat that no excavation of any sort should be allowed in preparation of that
area for the paver stone surface.
No impervious materials such as base rock may be used beneath the canopy of this
tree either as a sub base for the paving or for the area between the paving stones.
Tree #3
This tree would only be damaged if soil is pushed down into the area beneath its canopy.

It may require a significant waIl uphill ftom this tree in order to build the concrete patio as
planned,
I suggest that a engineer's plan be provided showing how that west end of the patio will be
constructed in such a way that no intrusion into the area beneath the canopy of this tree
occurs.
Tree #4
The olive tree should survive the process very well without major remedial procedures as long
as no trenching occurs within 10 feet of the trunk,
Tree #5
a) No sprinkJers may be directed in such a way that they wet the soil or the trunk
beneath the canopy of that tree.
b) No trenching may occur beneath its canopy,
Tree #(j
a) A silt fence must be installed at the eastern margin of this tree's canopy before
construction begins on that elevated deck to prevent any soil ITOm traveling down
beneath the canopy of the tree.
Inspections
I recommend that inspections be conducted by our office:
a) After silt fences have been installed for trees #1, 3 and 6 and after construction period
fences for tree #2 have been instaIled.
b) Of detailed plans for the installation of the pavement in the area beneath tree #2 and that
inspection be conducted when the base material is laid for the pavement in any areas
beneath the canopies of those trees to prevent the contractor ITom excavating in the area
beneath the canopies.

Geologist has reviewed the report. In general, the City Geologist supports the project.
However, additional information is required to be submitted by the applicant for further
analysis. As a condition, the project shall receive final approval by the City's Geologist. All
I of the recommendations of the City's Geologist shall be conditions of this project.
I Currently, the project is on a septic system. It is the intention of the applicant to connect to
I the City's sewer system. Preliminary sewer design plans have been reviewed and
approved by the Board of the Cupertino Sanitary District on May 4, 2005. A new gravity
, feed sewer system will be proposed under the existing fire access road to the west of the
I residence located within an existing utility easement. The project shall receive final

SECTION II: FINDINGS FOR EXCEPTION
WHEREAS, the Planning Commission of the City of Cupertino received an application
for a Hillside Exception, as described on Section II of this Resolution; and
WHEREAS, the necessary notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more
Public Hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support this
application, and has satisfied the following requirements:
1. The proposed development will not be InJUriOUS to property or
improvements in the area nor be detrimental to the public health and safety.
2. The proposed development will not create a hazardous condition for
pedestrian or vehicular traffic.
3. The proposed development has legal access to public streets and public
services are available to serve the development.
4. The proposed development requires an exception which involves the least
modification of, or deviation from, the development regulations prescribed in
this chapter necessary to accomplish a reasonable use of the parcel because
the residence is not visible from City established vantage points, the house
design & new landscaping minimize any negative visual impacts and the
extra grading activities are intended to lower the profile of the home.
5. All alternative locations for development on the parcel have been considered
and have been found to create greater environmental impacts than the
location of the proposed development.

6. The proposed development does not consist of structures on or near known
geological or environmental hazards that have been determined by expert
testimony to be unsafe or hazardous to structures or persons residing therein.
(See General Plan Policies 2-48.)
7. The proposed development includes grading and drainage plans that will
ensure that erosion and scarring of the hillsides caused by necessary
construction of roads, housing sites, and improvements will be minimized.
(See General Plan Policies 2-53, 2-54 and 2-57.)
8. The proposed development does not consist of structures which would
disrupt the natural silhouette of ridgelines as viewed from established
vantage points on the valley floor unless either:
a. The location of a structure on a ridgeline is necessary to avoid greater
negative environmental impacts; or
b. The structure could not otherwise be physically located on the parcel
and the size of the structure is the minimum that is necessary to allow
for a reasonable use of the parcel. (See General Plan Policies 2-46, 2-47
and 2-49.)
9, The proposed development consists of structures incorporating designs,
colors, materials, and outdoor lighting which blend with the natural hillside
environment and which are designed in such a manner as to reduce the
effective visible mass, including building height, as much as possible without
creating other negative environmental impacts. (See General Plan Policies 2-

10. The proposed development is located on the parcel as far as possible from
public open space preserves or parks (if visible therefrom), riparian corridors,
and wildlife habitats unless such location will create other, more negative
environmental impacts. (See General Plan Policies 2-55, 5-14 and 5-28.)
11. The proposed development includes a landscape plan that retains as many
specimen trees as possible, which utilizes drought-tolerant native plants and
ground covers consistent with nearby vegetation, and which minimizes lawn

12. The proposed development confines solid fencing to the areas near a
structure rather than around the entire site. (See General Plan Policy 5-17.)

3. TREE PROTECTION
Existing trees shall be protected during grading and construction with chain-link
fencing around the drip-line. The City Arborist will review and approval the
final building and landscaping plans prior to issuance of building permits. A
bond in the amount of $10,000 shall be submitted to ensure tree protection. The
bond may be released following receipt of a report by an internationally certified
arborist that the trees have been adequately protected during development and
are expected to survive.
4. ADDITIONAL SCREEN TREES
A revised landscaping plan shall be approved by the Planning Department prior
to issuance of building permits indicating the location and type of additional
landscaping to screen the 23-foot tall easterly wall from views as seen from the
nearby Midpeninsula Regional Open Space District trails.
5. ELECTRICAL GATE
The City of Cupertino prohibits automatic electrical gates on residential
properties. An existing electrical gate is shown on the site plan. If the gate was
built prior to September 20, 1999 then it is considered legal non-conforming and
may remain as is. If the gate is built after September 20, 1999, then the electrical
mechanism or components shall be removed. Prior to final occupancy, applicant
shall submit records confirming the construction date of the electrical gate.
6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (1), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees,

dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
7. VERIFICATION OF VALLEY VIEW VISUAL ANALYSIS
Approval of this hillside exception is contingent on staff confirmation of the
minimal visual intrusion posed by the proposed dwelling from six valley floor
vantage points as presented by Bay West Enterprises in a reported dated
February 22, 2005.

DEPARTMENT
CONDITIONS ADMINISTERED BY THE PUBLIC WORKS
8. STREET WIDENING
Street widening and improvements shall be provided in accordance with City
Standards and specifications and as required by the City Engineer
9. DEDICATIONS AND EASEMENTS
Easements and dedications shall be provided in accordance with City Standards
and specifications and as required by the City Engineer.
10. RETAINING WALL CONSTRUCTION
All retaining walls and related structures shall be installed in accordance with an
approved grading/ improvement plan. Retaining wall specifications and details
must be submitted in conjunction with the grading/improvement plans. All
designs and plans must be approved by the Public Works Department prior to
commencement of work.
The City and its representatives shall obtain a Geotechnical Report for review.
11. FIRE HYDRANT
Fire hydrants shall be located as required by the City, under the direction of San
Jose Water and the Fire department.
12. STREET TREES ,
Street trees shall be planted within the Public Right of Way and shall be of a type
approved by the City in accordance with Ordinance No. 125.
13. GRADING
Grading shall be as approved and required by the City Engineer in accordance
with Chapter 16.08 of the Cupertino Municipal Code. 401 Certifications and 404
permits maybe required, Please contact Army Corp of Engineers and/ or
Regional Water Quality Control Board as appropriate.

14. DRAINAGE
Drainage shall be provided to the satisfaction of the City Engineer.
* Pre and Post-development storm drain hydraulic calculations must be provided
to identify if storm drain facilities need to be constructed or renovated.
15. UNDERGROUND UTILITIES
The developer shall comply with the requirements of the Underground Utilities
Ordinance No. 331 and other related Ordinances and regulations of the City of
Cupertino, and shall coordinate with affected utility providers for installation of
underground utility devices. Ordinance No. 331 requires all overhead lines to be
underground whether the lines are new or existing. The developer shall submit
detailed plans showing utility underground provisions. Said plans shall be
subject to prior approval of the affected Utility provider and the City Engineer.
16. IMPROVEMENT AGREEMENT
The project developer shall enter into a development agreement with the City of
Cupertino providing for payment of fees, including but not limited to checking
and inspection fees, storm drain fees, park dedication fees and fees for under
grounding of utilities. Said agreement shall be executed prior to issuance of
construction permits.

17. TRANSFORMERS
Electrical transformers, telephone vaults and similar above ground equipment
enclosures shall be screened with fendng and landscaping or located
underground such that said equipment is not visible from public street areas.

18. BEST MANAGEMENT PRACTICES
Utilize Best Management Practices (BMP's), as required by the State Water
Resources Control Board, for construction activity, which disturbs soil. BMP
plans shall be included in your grading and street improvement plans.
Erosion/ sediment control plan shall be provided. Identify all Pre-and Post
development BMP's that will be installed on-site.
19. WORK SCHEDULE
A work schedule shall be provided to the City to show the timetable for all
grading/ erosion control work/ improvements in conjunction with this project.
20. GEOLOGICAL REVIEW
The project shall obtain a written confirmation from the City Geologist that all
geological concerns have been identified and addressed prior to issuance of
building permits.
21. VERIFICATION OF LOCATION OF CERTAIN UTILITY LINES
Prior to building permit approval, the applicant shall verify the location of the
proposed sewer line and existing water line on the improvement plans to the
satisfaction of the City Engineer.
22. VERIFICATION OF LOCATION OF EXISTING EASEMENTS
The applicant is relying on the existence and location of certain easements to
facilitate the construction of a new sewer line. Prior to building permit approval,
the applicant shall verify the location of those easements on the improvement
plans and their relationship to the utility line locations to the satisfaction of the
City Engineer.
