Rec_ded for approval. the Associate Plaaner ideDtH1ed the property on the -.p aDd displayed the site plan. Be said it tdll be a speculation building. Be said there were three basic ccnac:ems on this application: iDtensity of use, design consideratioøs as to setback, and access to Prune ridge Avenue. This is labeled Vallco Park but it is actually under, separate ovnership. Councilman Jackson said he foresees some potential problems in regard to incentive in the future with proposed Condition l7. Mr. Walter Ward, Vallco Park General Manager said that LID project 64-1 calls for the installation of Prunerid¡e and Tantau Avenue. If the LID were to b<! opened up he imagInes it "~'~d be based upon the benef~t to the property owners. He answered Mayor Irvin that the City has the control to do everything necessary here. The Associate Engineer referred to the July 12, 1973 IIII!<W from the ~reetor of Public Works oa this matter. The four categories established are: Category I - Existi=¡ ~velopment and Approverl; Cate60ry II - Committed: Category III - ie¡ional Shopping Center; and Category IV - Uncommitted: He said it is Impractical to try to arrive at a price at this ti=e. Perhaps ~e ~st approach is to ask theo to agree to join any assessment distri:t Deeded at a later date. The City Attorney said a reasonable conditian to attach to the LID would be to ~k for something that is r~asonable that would be of benefit to the property owner. He understands that it has to be necessarily vague at this point. Councilman Meyers said tha: :he applicant, on his last Cse Permit, was asked to take part in slg:alization. Secondly, since he is a minor property owner here he wo~:ë be compelled to join an LID. Councilman Jackson brought up Condit::'~n 16 which deals with the number of parking stalls per the number of employees and shift schedules. Be wonders if at this point we need to give this some thought as to what we can legally require. He is not sure that a condition of the Use Permit on the owner could ~ upheld against the tenant. The City Attorney said it would be better here to leave the sc~pe of it vague. Any reasrnabl~ condition ca= be attached to the Use ?erait. Councilman 3ackson suggested that a condition of the Use Permit could be the requirement that this caa41tioD be included in their lease agreement. I . . Cou:1ci1-= Meyers said that if we don't plan lOa enforce it, it shou!è not be left in.
