Fretwell to discuss maintaining an auto repair garage in a CG zone at tbe comer of Granada and Orange Avenues in Honta Vista. IIrs. Hazel Regnart Fretwell, 10159 Byrne Avenue, Cupertino, said she was present to protest the Planning Commission action in its decision on the above-mentioned auto repair garage. She g~ve a detailed history of the matter, as was detailed in her letter to the Mayor on December 3, 1973. Mrs. Fretwell said she is not new to the area; she has lived here sixty years. She presented to the City Ccu~cil the signatur~s of those people in her area ~~o are not against this business in this location. . Mrs. Fretwell noted other auto repair shops in CG zones such as Sears, Geo~o and Key Chevrolet. The Planning Director ansvered the Mayor th3t they are all secondary services, vith the primary uses being cocmercial. The City ~nager reviewed the history of this business in its present ~~å its previous locatio~s. He noted that the City issues business licenses for revenue and this does not in any yay determine land use. He suggested this matter be referred to the City Attorney's Office for a legal finding, since he was not presen t at this meet ing. Moved by Councilman Jackson, seconded by Councilman Frolich to refer the above matter to t~e City Attorney for clarification of whether or not it is illegal and next to determine if Mrs. Fretvel would like to apply for a variance or a change of zoning. Councilman Frolich would like the staff to inve~t1gate what makes Mrs. Fretwell's aituation different frOlD the auto repair services at Gemco, Sears and Key Chevrolet. Motion carried, 4-0 Mrs. Fretvell stated that she would not have asked for annexation if she had DOt been assured by the City staff that this would be a legal use. The City Manager stated the staff hAs explored tt-a matter extensively and recooaends a 10% increase in garbage collection rates. Los Altos Garbage Cocpany is asking for 20%. Copies of a memo from the Administra- tive Assistant were distributed to the Councilmen, as well as other pertinent C8terial. He said that basically, the disagreement is in the area of depreciation of equipment and c~ntainers. The City ~4~ager said there have been very few complaints made, in spite "f :::'e fact that this matter has bee~ postponed to this date and it was publicized. The City ~~nager stated that further studies are bein~ made and based upon these s:udies, there is the possibility of a further increase next year. Attorney ?3ul 1.
