I'he COlIDcil adjouned to the Library Conference Room at 7138 P.M., and
reconvened in open H.sion at 8 :lO P.M.
The Assistant City Attorney introduced Mr. Jensen, of Attorney Kenneth
Jones' Office. He then recommended the Director of Public Works give
the scope of the project; secondly, any written communications regarding
the proj, : should be introduced; and thirdly, oral communications
should be reque.ted.
Civil Engineer John H.idel, of George S. Nolte Engineering, stated they
had prepared the engineer's report for this project, lie reviewed the
assessment diagram of the Crossroads Assessment District that was
displayed on the screen. Crossroads Assessment District Phase I i. now
complete.

The City Clerk entered into the record the written protests to the
project: California Water Service Company; Mr. Harry Falk (represented
by Mr. Thoma. Harrington); six property owners represented by
Attorney Harry Margoli.; Paul, Mary Frances and Lorena Mariani;
Edward and Viola Murphy; Itsuo, Marian. Ernest and Shigeko Uenaka.
Mr. Harry T. Kerr, Vice President of California Water Service Company,
1720 North First Street, San Jose, called attention to the remarks
made by the Nolte representative, as to the undergrounding of utilities
and widening of Saratoga-Sunnyvale Road. He said this would be of no
benefit whatsoever to the public utilities, There appeared to be a
ajority on the part of the property owners protesting this project.
He felt the assessment would exceed the value of the property.
r. Heidel explained that none of the undergrounding of utilities costs
ere attributed to the California Water District. The $89,000 was
arrived at for the street surface sidewalk, medians, et~.
Every effort was made to make the spread of the assessments as fair a.

for a _jority.
Dr. Joe Brown. 20985 Peppertree Lane, CupertiDO, said he baa an
asses....t of $46,000 per acre on bi~ 8-acre parcel. This would
run $lOO per day for 14 years. The original assu_t of the
cost of tbis waa $30,000 per acre in 1972, when tbis was started.
Attorney Dale Junta, 26360 Aric Lane, Loa Altos RUls, representin
ths Harlani family that _ 60% of the land enc:oapasaed within
this District, said the petition was sigoed by the Kariania on
condition of approval of a use permit for a ..inimall. There is no
need for this aasesseent district at this time. There would be a
$6l0,OOO burden on property that is essentially in orc:hards.
Attorney Jensen said 95.4% protested this district. In view of
that, the City can overrule the protests requiring 4/5 vote or
can continue the hearing in order to give the staff tille to
prepare proper rebuttal to remarks made at this public hearing,
or the Council could abandon the project.

public hearing.

said the City can enter into an agreement that at the end of three
years this structure aust be rl!llOved.
Counc. Jackson noted this property is already zoned Commercial.
The Assistant City Attorney answered Co~nc. Jackson that the City could
initiate rezoning to PD, but this vould not materially affect the
City's ~sition.

Our busses are rolling, although there are some
problems to be resolved. More people are being
hired and trained to take care of the telephone
calls. There will be a meeting January 16, 1975,

The Committee has applied for recognition of
Cupertino as a Bicentennial City.
