MINUTES OF THE REGULAR MEETING OF THE ARCHITECTURAL AND SITE
APPROVAL COMMITTEE HELD MAY 27, 1970 IN THE.COUNCIL CHAMBERS OF
THE. CITY HALL, CUPER.TINO, CALIFORNIA
Chairman Small called the meeting to order at 8:02 P.M. and led the
salute to the flag.
Roll Call
Committee Members present: Adams, Marquez, Ryner, Chairman Small.
Member absent: McLaren. Also present: Chief Building Inspector
Benevich; City Clerk -Finance Director Ryder.

There were no written communications.
Oral Communications
1. Mr. Benevich advised the Committe that Member McLaren had
called, stating she could not attend due to illness.
2. Mr. Joe Wucher of Vallco Park addressed the Committee and
requested permission to present an application for a ground sign.. The
reason for the special request was the impending absence of one of the
principals which necessitated an earlier than expected decision from
the Committee.
It was moved by Member Ryner, seconded by Member Adams and passed un-
animously that the requested application be heard at the end of the
40 meeting.
Minutes of Previous Meeting
It was moved by Member Adams, seconded by Member Ryner and passed un=
animously that the minutes of May 13, 1970 meeting be approved as sub-
mitted.

A. Application 366-HC-68, Ad Art, Inc., 1607
Terminal Street, San Jose, requesting approval
to erect a 212' x 8' ground sign for Information
Storage Systems, located at 10435 Tantau Avenue,
Cupertino.
The application was presented by Mr. Vern Burgess, 1079 Almarida Drive,
Campbell,who explained that the ground sign was well within the limits

of ordinance.requirements as were the' roposed letters on the building.
The ground sign would be 3' 3" X 11' 3.".
It was pointed out that the heading for this particular application on
the agenda did not cover the request for the letter signs on the build-
ing and this fact should be pointed out to the City Council so that
both may be considered for approval.
It was moved by Member Adams, seconded by Member Marquez and passed
unanimously that the ground sign and building sign in Application
366-HC-68 be recommended to the City Council for approval as per the
rendering submitted and the 12 Standard Conditions.
B. Application 463-HC-70, J.; Cyril Johnson
Investment Corporation, 125 Willow Road,
Menlo Park, requesting approval to construct
a 120 unit apartment complex on the east
side of Foothill Boulevard between Alpine
Drive and Salem Avenue.
Chairman Small said that he had that afternoon received a telephone
call from the applicant of Application 463-HC-70 requesting that the
hearing be postponed'until a question on the Tentative Map had been
resolved.
It was moved by Member Ryner, seconded by Member Marquez and passed
unanimously to continue Application!463-HC-70 until the'n'ext meeting.
C. Application 466-HC-70, Loyal Order of Moose
Lodge #2049, 22250 Homestead Road, Cupertino,
requesting approval to add to existing build-
ing and landscaping.
Mr. Dean Finkenbinder, 954 Henderson Avenue, Sunnyvale, presented the
application.
Chairman Small explained to the other members of the Committee the
actions taken by the Moose Lodge in their acquisition of this property
and defined the site location of the lodge building. He stated that
special consideration could be given to this landscaping in that it
was set back from any major highway frontage. The area already was
landscaped to some extent. It hadi'been discovered that there was
some underground wiring in existence and this would provide for some
small mushroom night lighting. He also pointed out that there is an
8 foot fence along the west side for a distance of some 200 feet.
Mr. Benevich advised the Committee that the Planning Commission had
decreed that an 8 foot fence was illegal and that the maximum height
was 6 feet.

Chairman Small said that there was a.3 or 4' drop along the property
line and inquired from which side was%.the measurement to betaken.
Mr.-Benevich stated ,that the grade is established from where the.fence
is being erected. In a.residential area, being separated.from.com- comments -by
mercial, the 6 feet are to be measured on the residential side of -the Chief
fence. Building Insp.
Member Marquez said he still would be in favor of recommending to the
Council that an 8 foot fence be, constructed. -Again Mr. Benevich
cautioned the Committee that.they.could not impose such a condition
and Chairman Small said that, regardless of the ordinance or standard
condition, he would like to see the recommendation made for the'8
foot fence.
After reviewing the presentation Chairman Small said that.no plans had
® been submitted so the Committee could not take any action on any pro-
posal for additions to the buildings.
Member Ryner asked what the additional landscaping would be,besides
general cleaning up of the property.
Mr. Finkenbinder said that there would be the small mushroom lighting,
approximately 6;..the planting of shrubs among_redwood.chips along
® Maxine Avenue and, also, to the immediate rear of the main building comments by
and on the corner of the property. There also would be some existing applicant
shrubs removed due to neglect in the recent past. He answered Member
Ryner's question that the picket fence would be repaired.
Member Marquez asked the size of shrub to be planted and was told that
they would be from 10 to 12" high. Chairman Small said that 5 gallon
shrubs were specified.
It was pointed out to the applicant by Member Marquez that sprinklers
were a part of the standard conditions, even though they were not
there now.
The question of garbage containers was answered in that they.would be
maintained to the rear.of the building.
The -general discussion then took place on the kind of fence that would
be required. There was some question as to whether this -should be a
masonry wall as specifie'd.in the Standard,Conditions or :the redwood .as
called for in the plans and whether or not this should be considered committee
the same as if it was separating commercial and residential properties. discussion
Chairman Small said that alas was a lodge which had minimum funds at its comments of
disposal and he could not see why the City would force on this group Chairman
the construction of an expensive fence. He was in favor of going along
with a redwood fence and seeing what happened at the Council level.

Mr. Benevich pointed out that the Standard Conditions called for a
comments by masonry wall and suggested the only alternative was to let the applicant
Chief request a variance from this at the Council level. This was agreed to

Inspector matter even if it did want to recommend something different.
It was moved by Member Ryner, seconded by Member Marquez and passed
unanimously that Application 466-HC-76 be recommended to the City Council
466-HC-70 for approval subject to the landscaping plans submitted, the 12 Standard
approved Conditions,_a recommendation to the City Council that an 8 foot redwood
with fence be installed around the rear of!the property as per the plot plan,
conditions the installation of a sprinkler system, indirect lighting to be installed
so as to prevent direct reflection into neighboring houses, and that all
landscaping not now in existence would be not less than 5 gallon size.

D. Application 467-HC-70, Monta Vista Ready
Mix, 21705 Stevens Creek I Boulevard, Cupertino,
requesting approval of their landscaping.
The application was presented by Mr.;Ron Rose, attorney for Mr. Rifredi.
He pointed out to the Committee that;Mr. Rifredi had submitted the ap-
plication for a Use Permit even when there was doubt as to its necessity
and, in so doing, had agreed to conform to the landscaping requirements.
He said, essentially, the proposal would include a 25' x 60' raised
comments by
planter box in which would be placed, a slump stone sign;, the removal of

Member Ryner commented on the mixing of Japanese and Monterey pines and
was wondering why the fast growing 'and slow growing varieties were being
placed next to each other. He wastold this was the architect's choice
and would be changed if this was requested.
Chairman Small offered Mrs. Anne Anger of Monta Vista the opportunity to
comment. Mrs. Anger stated that she was not -in favor of having any open
fence as this did not obstruct the activity going on inside the property.

She pointed out this was the main entrance to Old Monta Vista as well as

the new Ditz-Crane subdivision. She said that even though the City of
Cupertino,does not want to give any consideration to the appearance of
Old Monta Vista or the residents, fit should take care of its own citizens
by making this entrance as attractive as possible.

Mr. Rose rebutted that this point; had been argued before the Planning
Commission and it was felt that the combination of fencing and landscap-
ing would adequately screen the business activity.

It was pointed out that the trees were placed 20 feet on center as this
would be proper spacing when the trees reached maturity; The north-
ern portion of the property would not be.landscaped. as existing pine
trees were there.
Mr. Benevich suggested the planting of junipers in the planter box be
4 feet on center.

Mr. Rose said that this would entail additional expense .to his client and
that there was sufficient rock and chips available to.cover the area
pending the full growth of the junipers.
Chairman Small said that the Committee could give consideration to thel
additional investment being made by the applicant in landscaping and
commented that this would be one of the fanciest rockeries in the County.
it was moved by Member Marquez, seconded by Member Ryner that Application
467-HC-70 be recommended to the City Council for approval subject to the
12 Standard Conditions, the landscaping plan as submitted, the planting
of junipers in the planter box to be.4 feet on center and not less than
2 gallon size and for approval of the proposed slump stone sign.
Mr. Rose then inquired as to the sprinkler system in the 12 Standard Con-
ditions stating that there was a long row of trees. He said that there
was a water truck available and in use on the property and the watering
of these trees would be much better by using the. truck rather than a
sprinkler system.
Mr. Benevich advised the Committee that a similar situation had arisen
relative to the application for the Customhouse and that the Council
had allowed natural watering due to the hardship of installing a sprink-
ler system. 1.
Chairman Small then advised the applicant, on the recommendation of
Member Ryner, that this matter be brought up before the Council and the
relief requested would be presented to them.
Member Ryner said that consideration also should be given to making the
trees all Monterey pines rather than using a partial slow growing
Japanese pine. The applicant had no objection to this.
It was moved by Member Adams and seconded by Member Marquez to amend
the motion for changing the landscaping on the easterly border to in-
clude all Monterey pines and to recommend to the City Council the
deletion of the sprinkler system requirements for both the 1,100 feet
and 800 feet of trees.
The motion on the amendment was passed unanimously. The vote on the
original motion was passed unanimously.

E. Application 468-HC-70, R.J. Mitchell, 10135
S. Saratoga -Sunnyvale Road, Cupertino, request-
ing approval to install a;3' x 6'8" roof sign.
Mr. R. J. Mitchell presented his application stating that this was a
travel agency to be located next to the pharmacy in the Town and
Country Shopping Center. He said that this sign conforms to the ex-
isting style and to the business signs in this center.
Mr. Benevich said that the requirements of the ordinance had been
met.
It was moved by Member Marquez, seconded by Member Adams and passed
unanimously that Application 468-HC-70 be recommended to the City
Council for approval subject to the plans as submitted and its con-
formity to existing signs as to size; shape and colors.
Application 432-HC-69, Vallco Park, requesting
approval to construct a ground sign for the
two-story multi -tenant building located at
10300 N. Tantau Avenue.
The application was presented by Mr.. Joseph Wucher of Vallco Park
who said this was the only sign on which the tenants of the building
would be listed. It would be the same color as other signs in Vallco
Park. It was their intention to paint but one side of this sign at
the present time and when the overcrossing was completed the other
side would.be painted.
Member Ryner asked why the sign needed to be 10 feet high. Mr. Wucher
siad that it was required for the listing of all tenants on the sign
and so as to have it visible for those persons who would be going
over the Tantau overcrossing. He said the sign is not a solid mass
and it was the first such sign fora 2 or 212 story building in Vallco
Park.
It was moved by Member Adams, seconded by Member Ryner and passed un-
animously that Application 432-HC-69 be recommended as per the plans
submitted.
Unfinished Business
1. Mr. Benevich stated that the owner of Don's Restaurant had
come into the City Hall as requestL-d and had been told that corrective
action would have to be taken prior to this meeting. Mr. Ahamnos had
agreed but work had prevented Mr. Benevich from verifying whether or
not the corrective action, in fact;, had been taken.
Chairman Small said that he would check this matter out tomorrow and
reportto the Committee at the next meeting.

2. Chairman Small said that -one of the parking lot lights at
the House of Pies on Wolfe Road was extremely bright and was visible

even from the freeway in driving south on Wolfe Road. Mr. Benevich
stated that he had a meeting with the owner -of -the establishment the
following day relative to other matters arid would take this up with
him at that time.
