Ca. 95103, requesting approval of sign for Trend O'Fashion
located in the•Crossroads Shopping Center (continued)

fact that this application was continued from the previous meeting
and the applicant was not yet present, to place this application at

5. Application 358-HC-68 - Review of final landscape plan for
Del Oro Construction Company for 84-unit apartment complex
located at 10375-10465 Mary Avenue. (Imposed conditions

6. Application HC-51,205.1 - Taco Bell, requesting approval of
architecture, landscaping, lighting and signs for building
located at 10660 South Saratoga -Sunnyvale Road.

Mr. Charles Fauvre, 14452 Nutwood Lane, Saratoga, explained that the
previous owner of "Senor Taco" had gone out of business and he had
taken over the building. He went on to explain in detail the changes
he planned to make to the building and grounds.. The covered drive -up
window would be eliminated. The mission -style architecture will have
a parapet around the building to screen the roof apurtenances.
Attention was called to the sign: "TACO BELL", which perhaps is a
departure from the architecture. Along the north side they plan to
landscape. Mr. Fauvre said he has operated three Taco Bells for
the past three years and all three have been enjoying good business.
Sales are up 13% over last year.

Mr. Fauvre said they are taking off the entire existing roof, will
cut the posts down to three feet height, and remove the drive -
through sign and replace it with a yucca. The building will be
adobe color and will have arches across the front. The existing
trash bin is too small and will be raised to six feet with new
redwood doors. Landscaping and colors will be complimentary to
the building. The patio surface in the front will be painted and
will have slump stone tables. There will be screening between the
outside diners and the moving traffic. The purpose of the fire pit
is to add a feeling of warmth and congeniality. The wall around
the dining area is ten feet back from the street.
Chairman Ryner asked the Committee if there.were questions regard-
ing the architecture. Member McLaren asked if the bell would be
free swinging and authentic. Mr. Fauvre said it would be free
swinging but it is not a real bell.
Chairman Ryner made it a point to remind the applicant of the
H-Control Standard Conditions - especially the one about roof
apurtenances.
The discussion then turned to the landscaping. Chairman Ryner
asked about the condition of the street trees. The applicant said
there is just one, which seems to be in good condition, although
it is not very big. He is not planning any other trees on the
property. Member McLaren said she would like to see more greenery
in the trash area. Member Gatto suggested some kind of decorative
block or brick across the top of the six-foot high trash enclosure
Member McLaren suggested a tree rather than the juniper. The
applicant said he could put a bottle brush tree in place of the
juniper.
Lighting was discussed next. Mr. Fauvre said he plans to remove
the fluorescent lights under the tile roof and. will put Spanish
wrought iron lanterns with 150 watt yellow bulbs all around the
building. There will be spot lights on the corners of the roof
and one or two lights directed on the plants and wall. The
colored metal letters "TACO BELL" are not normally lit. That is
the Taco Bell's logo and is crucial to their identity. The colors
are basic red, yellow, blue and green. Member McLaren said that
since the letters are metal and mounted as they are, she had no
objections except for the bright colors. Member Gatto also felt
the boldness of the colors was.objectionable and suggested earth
tones of the same colors.
Member McLaren did not feel the fire pit should be considered a
sign. She felt it added atmosphere and referred to another res-
taurant on Stevens Creek Boulevard across from.Valley Fair that
has something similar. Member Gatto also noted the fire pit was
oriented more to the guests than to the traffic. The applicant

said the fire pit has a steady gas flame and the Fire Marshall would
like to have a grate put around it. Entrance and exit are on either
side of the building. Existing lightoliers will remain.
Chairman'Ryner asked for comments .from the audience. There were none.

Moved by Member Gatto, seconded by Member McLaren, to recommend
approval of HC-51,205.1 - Taco Bell to the City Council, subject to
the H-Control Standard Conditions and as indicated on exhibits and
architects rendering, and subject to the condition that the sign
is to be in earth tone colors and the applicant should meet with •
and get staff approval prior to the City Council meeting; and that
instead of the plant by the trash enclosure as shown on the land-
scaping plans the applicant has indicated the desire to have a
bottle brush tree and tile trim around the enclosure,
Chairman Ryner noted that the applicant is making changes that are
good. He was concerned about the lights in the rear and was not
convinced of the need for flood lights directed on the sign.
Member McLaren was in favor of lights in the rear for safety.

7. Application HC-51-257.1 - Harold B. Wagstaff, Architect for
Horst Kliemann, requesting approval of site, architecture,
landscaping,.lighting, signs and underground of utilities for
20-guest residential care home to be located at the intersection
of Foothill Boulevard and Santa Paula.

The Director of Public Works referred to his summary of this appli-
cation. The site plan was displayed on the bulletin board.
Mr. H. B. Wagstaff of Marin County showed a rendering nf the tile -
roofed slump stone and brick building and professionaliy landscaped
grounds. Nine parking spaces will be provided for the 20-bed
building. He said the building has been relocated two feet farther
south than the site plan indicates. There will be a ramp entry with
6" grade leading to the front door for wheel chair patients. They

will have all ambulatory patients; no sick patients. Chairman
Ryner asked how they plan to gutter this building. Mr. Wagstaff
said they will build the gutter in behind heavy redwood fascia.
Member McLaren was concerned about the_ parking facilities.
Mr. Wagstaff said this was a 20-bed rest home with a staff of 4+.
There is parking in the rear, in addition to the six parking
spaces shown on the site plan.
Member Gatto asked how long most patients would stay. Mr. Wagstaff
said they could stay as long as they are well; 'there are no pro-
visions for bed patients.
Chairman Ryner asked if these plans have been discussed with the
people living in the area. Mr. Wagstaff did not know.
A six-foot trash enclosure will be furnished with provision for
® containers inside. No air conditioning is contemplated for the
larger structure. The living room, dining room and kitchen will
be air conditioned. The air conditioner will be a 3-5 ton, ground
mounted unit which Mr. Wagstaff hopes to effectively screen with
shrubbery or the fence. The walkway will be lit by lights approx-
imately twenty feet apart and a larger, translucent, amber opaque
100 watt standard at the main entrance. The rear deck will have
individual wall -mounted lights. Under the eaves there will be a
couple of lights on a time clock for safety purposes. The sign is
for the purpose of identification, not advertising.

Trees along the street will be in accordance with the City re-
quirements. Internal landscaping is of a low nature with the
exception of the trees. They will use five -gallon size shrubs:
pfitzer junipers, azaleas, evergreen, agapanthus, and foundation
planting. Along the perimeter there will be fifteen -gallon trees
every twenty feet. Chairman Ryner asked if there wouldn't be
any grass. Mr. Wagstaff said this could be considered. Member
Gatto asked if a member of the staff would be able to mow the
grass. Mr. Wagstaff felt this could be arranged.
Member Gatto observed that the users of the deck could not enjoy
the landscaping. To Member McLaren's question, Mr. Wagstaff said
the area around the trash enclosure would be landscaped.
Chairman Ryner told the applicant he had the option to postpone
his application inasmuch as there were only three Committee MemberE
present. Mr. Wagstaff elected to go ahead.

Moved by Member McLaren, seconded by Member Gatto to recommend to
the City Council approval of application HC-51,257.1 for the
20-guest residential care home subject to the plans and specifica-
tions provided regarding lighting, landscaping, the site plan,
underground utilities and subject to the H-Control standard
conditions, with'the stipulation, since the screening on the air
conditioning is not shown on the plans it should be approved by
the staff prior to installation. On the lighting of the rear deck,
wall brackets to be used typical of residential homes and if
necessary for further lighting, two soft flood lights could be
used on the rear deck area -- this would have to have approval of
the staff prior to installation as to lighting location and size.
Member McLaren wanted to call attention to the City Council that
although it is not under the jurisdiction of the H-Control Committee,
she was concerned with the parking facilities, at least with the
residents that would'be coming in and out and with cars backing out.
Her reason for concern is that she has first-hand "knowledge of the
congestion in the circular driveway area at another nursing home
in that area.

Director Yarborough placed the drawing of the proposed sign on the
bulletin board. Member Gattb said this sign seems to be similar to
those used in the rest of that shopping center. There were no
comments from the audience.'

Mr. Carl W. Haaland, 249 Copco Lane, San Jose, owner and developer
of this project said he had engaged the services of a landscape -
designer.
Mrs. Susan Manning, 7720 Meadow Court, Cupertino, landscape -
designer, said she was hired two days before this meeting. After
talking with the developer and City staff, her initial feeling was
the stark look of the walls so close to the curb. She wanted to
see some plant material going up the walls. She commented that
there are some very nice olive trees on the property. She wanted
to change the cutouts to one long, 4-foot wide strip for planting
and remove all the red rock. Rather than a fence, she suggested
pyracantha trimmed to 3 feet. The soil in the 4-foot planter
should be lowered to 1 inch below the sidewalk. She would use
xylosma, ginkgo trees and ceanothus (wild lilac) informally
espaliered against the wall.
Chairman Ryner asked the designer if she could do more with the
landscaping if given more time. She answered that the buildings
are there; this plan was the best she could do. Given more time,
her presentation would be more refined.

Member Gatto commented that the additional planting is the method
for solving the problem. Perhaps what has been presented is not
enough; additional large items against the building might be good.

1. Extend the 4' landscape strip continuously throughout the •
length of the frontage adjacent to the back of the walk
between the northerly property line and a point set southerly
where the curb would become tangent to existing driveway curb.
2. Increase landscaping adjacent to building faces with plan to
be reviewed and approved by the City staff before presentation
to the City Council.
3. Living fence to be allowed utilizing pyracantha shrubs within
the narrow landscaped strip paralleling the parking access aisle
which lies between the sidewalk and the buildings situated on
the southerly portion of the frontage of Mary Avenue.
4. Splash blocks to be installed as well as stepping stones added
to reduce the erosion on the slope area, particularly adjacent
to the service meter box area.
Subject to conditions and revised exhibits submitted by landscape
architect representing applicant. Revised exhibits to be com-
pleted and reviewed by City Staff prior to Council action.

9. Review of inquiries and requests directed to City staff relative
to reported violations of H-Control regulations. 40

of the hour and the fact that Mr. Ahamnos has been ill, to hear
Item b at this time.

(b) Mr. George Ahamnos, 20567 Russell Lane, Saratoga, application
347-HC-68 - Screening for air conditioning units on roof of
Don's Burger Villa, Stevens,Creek Boulevard and Portal Avenue.
The Director of Public Works said Mr. Ahamnos proposed to remove the
roof line and add a fence around the air conditioning unit.
Chairman Ryner noted that here is another case where we are building
another fence around an air conditioner on the roof and he was
against it.

Member Gatto asked how much higher the air conditioner would be
than the roof. He was told it would be one foot above the roof
line. Member McLaren suggested raising the parapet and taking the
fence down. It was decided this would make the roof look out of
proportion.
Mr. Ahamnos claimed he_needs circulating air around the unit and
he also needs to have it covered during the rainy season. Chairmar
Ryner suggested the applicant get together with the Director of
Public Works and the air conditioner installer to resolve the
inherent problems.
MINUTE ORDER:
Moved by Member Gatto, seconded by Member McLaren to instruct the
® staff to investigate this problem and further:
1. Find out the reason why the air conditioning unit needs a roof.
2. Take a photograph of the area in question, looking down into
the well.
3. Obtain information on the relationship of the air conditioner
to the parapet and any other pertinent information on the roof
that will aid the Committee in making a determination.

(a) Violation of Sign Ordinance by Produce Market on
Highway 9.
The Director of Public Works said the string of .lights has been
removed. The owner was warned that if there are repeated varia-
tions to the Sign Ordinance they will be dealt with more harshly.
10. Status Report of H-Control Applications
The PW Market representatives wanted to review their proposal with
the Committee once again, on the advice of the City Council.
Chairman Ryner said this should be heard under Public Hearings.
It was decided the Committee would listen to what the applicants
had to say on HC-51,230.1.

The applicants talked about shifting the units on the roof so they
won't be seen from the parking lot; or lowering the unit; or putting
it at the rear of the building. They also talked about a separate
building on the parking lot to contain the structure, or recessing
it in a well. The staff recommended lowering the unit.
Mr. Bruce A. McClelland, North First Street, San Jose, said this
is a matter of real concern to Mr. Franco, owner of PW markets.
Mr. McClelland has visited the site and the Cupertino Building
Department. This was sent back to this Committee to stud; alter-
natives: moving the large unit to the center of the building;
cutting a hole in the present building and lowering the unit down
into the bakery. They found removal of the unit from over the
machinery room becomes a.matter of impracticability. Another
alternative was to relocate the entire unit into a separate -build-
ing at the rear. This would create noise up against the property
line. Their final conclusion is to have the main air cooling unit
remain in its present location. The exhaust unit is located
toward the back end of the building. He then introduced Mr. John
Hassman, Engineer, and Mr. Humbert.
Mr. Hassman said they can reduce the highest unit by four feet -
50%. Mr. Humbert said this market is 40,000 square feet and requires
a 260 horsepower AC equivalent air conditioning unit to be effective.
He said this is an everyday type application. At 10 miles per hour
going east on Homestead Road by the apartments you can hardly see
the roof apurtenances. He added that they are scheduled to open
June 7th.
The applicant suggested the H-Control Committee let them present
this last proposal to the City Council on June 7th. The Director of
Public Works said the City Council sent this application back to
this Committee expecting a solution to the problem. •
Member McLaren still felt the screening should go around the peri-
meter of the building, with access to the equipment on one side.
Mr. Meu, the architect, offered to go to stucco above the 21" high
parapet across the back of the concrete building. The Director of
Public Works said the staff could discuss this possibility with
the applicant.
The site plans were discussed next., A future building is planned
on the east side of the FW market building, but it won't be as deep.
There was some discussion of how high the stucco parapet would go
along the back and how it would be tied in with the east side of
the building.
Member Gatto felt that m.nimizing the height of the apurtenances
rather than raising the parapet would be the best answer.

NEW BUSINESS
1. There is a new sign in front of Tate's Country Music Store.
This was referred to the staff.
2. Shire Records and Buck Skin Den was referred to the staff.
3. The car painting shop on Bubb Road between the Shell Station
and the market was brought to the attention of the staff.
Now they even have a sign: "All Work Guaranteed - Quick
Service".
4. Chairman Ryner was concerned about the status of the land-
scaping of Crossroads Shopping Center. Staff will research
the application.
5. It was suggested that perhaps the Committee should set up a
sub -committee to go over some of the applications submitted
is and approved to see if they have followed through.
The Director of Public Works said Final Inspection could have
a check list and submit it -to the Committee.
