CITY HALL, CUPERTINO, CALIFORNIA SALUTE TO THE FLAG Chairman Ryner opened the meeting at 7:38 P.M. with the Salute to the Flag. Approval of Architectural and Site Approval Minutes of May 19, 1971. Member Gatto had the following corrections to the Minutes: Page 2, middle of the page; the motion carried, 3-0 rather than 5-0; Page 7, second and third paragraphs under Item 5, Mrs: Manning is a landscape designer rather than landscape architect; Page 10, third paragraph from the top, the man's name is Mr. Haussmann rather than Hoskins and third paragraph from the bottom should read ". . . Mr. Meu, the architect, offered to go tc stucco above the 21 high parapet ." Moved by Member Gatto, seconded by Member McLaren to approve the Minutes of May 19, 1971 as corrected. Motion carried, 5-0 COMMUNICATIONS WRITTEN 2. Letter from Sears Roebuck regarding lighting fixture in the parking lot for the bell tower. Motion carried, 5-0 gym' 3. None requested. PUBLIC HEARINGS 4. Application HC-51,230.1 - George Meu, Architect, 553 Mission Street, San Francisco 94105, requesting approval for archi- tecture of screening for air conditioning units for PW Market located at the southwest corner of the intersection of Homestead Road and Saratoga -Sunnyvale Road. (Referred back to H-Control from City Council 5/3/71) (Loc. Map, Ex. 1) The Director of Public Works showed colored slides of the site. He said a solution to the problem of the air conditioning units has beer, prepared that involves lowering them and mounting them or. the canopy to the rear of this building: The staff had discussed the possibility at the same time as the screen is installed, addition of a small mansard screen to the canopy. The applicant felt this was an extreme requirement. The staff then went through the alternatives with the applicant. The Director of Public Works added that no solution has been offered for the small units on the roof over the bakery. Member Adams asked the staff and the applicant to briefly go over each of the alternatives. Mr. Meu deferred to the engineer, Mr. John Haussman, of Hussmann-San Francisco, Inc., 189 Constitution Drive, Menlo Park. He said the first suggestion was to drop the condenser into the machine room. Interference was caused by the water drain line and, too, they would need from time to time to go. in and service the machines. The second suggestion was to raise the condenser and enclose it within,a fence. After much discussion, the applicants decided to go straight down between two pilasters located above the frozen food box. :To put the condenser on ground level would involve moving the machinery. Member McLaren asked how much of the unit would project above the roof if it was placed in the rear with a mansard roof. The engineer said it would project about 2 feet. E Is G Minutes of the June 9, 1971 H-Control Meeting Member Gatto asked Mr. Meu about the canopy construction. Mr. Meu said it would be metal. Member Gatto then asked if some wood or something could be introduced to repeat the front of the building. Mr. Meu thought this unlikely because the canopy is painted, galvanized metal. To Member Adams' question, Mr. Haussman said the canopy screen would cover three sides. He said they did not have on this plan the other two apurtenances. Member Adams said he would like to see some treatment to the canopy similar to the front. Mr. Meu said the weight of tile would cause a problem. Member Adams commented that sometime in the future the property across the highway will be putting in higher buildings and this will be noticeable. Chairman Ryner was in favor of no apurtenances above the roof line on the west side. Mr. Meu said there are two air condition- ing units above the bakery and they show about one foot. They will try to move them further toward the center of the building, which should solve the problem. Chairman Ryner repeated that he wants no roof apurtenances to show. Mr. Haussman said they are air makeup units and supply fresh air to the bakery. They are 12 inches high and are now at their lowest position. :Rather than moving them, he wondered if the Committee would be opposed to some type of screening. The Committee indicated they were oppose to any screening or fencing. Mr. Haussman then added that this is a temporary measure since Mr. Franco intends to develop more buildings within two years, at which time all of these apurten- ances will not show. He. asked if the Committee would agree to this proposal until the additional buildings are built. There was no direct response to this question at this time. Chairman Ryner asked for comments from the audience. There were none. Moved by Member McLaren, seconded by Member Adams to close the Public Hearings. Motion carried, 5-0 Member Adams commented that if the Committee does decide on ap- proval he would recommend a condition on the basis of treatment to the canopy to the front or wood treatment; also, would condi- tion the approval that the two heating units for the bakery be reduced in height by some means to be worked out with the staff. She asked if a restaurant was not proposed for the adjacent building. The applicant said a junior department store was proposed there.. Member McLaren felt that with the impending development of the adjacent property, the two heating units did not present a perma- nent problem. Member Adams disagreed because he said you can't enforce a correction after the property is developed. There is no assurance the adjacent property i.s going to be developed. He did not like the idea of a condition to be enforced two or three years hence. Member Gatto wanted to consider the solution with the equipment on the canopy. It solves two of the main problems: conceals the condenser and the exhaust scoop. If given a little study, it can be an enhancement. As far as the two units in the center, it is a decision about how strict an interpretation of the Ordinance is called for. His feeling is that the adjacent property will shortly be developed and those smaller units will be forgotten. He did not think it warranted the moving of'those units. Moved by Member Adams, seconded by Member Gatto to recommend to the City Council approval of application HC-51,230.1 - PW Market, subject to the standard conditions of approval, the 14 standard conditions and additional conditions as follows: 15. The equipment screened canopy shall be treated with wood to enhance its appearance. 16. The two heating unit apurtenances to be lowered in height; to be a height selected with the staff's assistance. 17. Approval to be based upon Exhibit A. 18. Subject wood treatment of the canopy and the lowering of the apurtenances noted to be agreed upon with the City staff prior to submission to the City Council for approval. 19. If support for the canopy is necessary due to the wood treat- ment, it also is to be approved. Discussion followed. Member Marquez said he would like the recom- mendation except he did not agree with Condition 16 regarding lowering of the two heating units. Application HC-51,230.2 - Berwick -Pacific Corporation (Goodyear Appliance Store), P.O. Box 77143, San Francisco, California 94107, requesting approval for architecture and landscaping for building to be located on Sunnyvale - Saratoga Road near Homestead Road. (Loc. Map. Ex. 2) Mr. Andrew Berwick, P.O. Box 77143, San Francisco, California was ® the applicant. The Director of Public Works showed colored slide,, of the area. He said the building is to be located at the south- east end of the Payless store. A rendering was also displayed. The tile treatment will be the same as on the market. This will be a drive -through structure.. The site plan showed how the building is oriented to the Payless structure. The parking lot will be open to the adjacent lumber yard to avoid having traffic going back and forth onto Saratoga -Sunnyvale Road. Landscaping was discussed next. The ground light will be similar to those already in the parking lot. They have added some bottle brush plants along side the wall. Member Adams requested the applicant to give the design of the air conditioning unit. Mr. Meu said the Goodyear air condition- ing unit has a parapet all around it, with the air conditioner dropped down 3-4 feet. ® Member Gatto, regarding the rolling doors, asked if they are glazed or solid. Mr. Meu said they are solid, with one band glazed. When asked why they need doors on both sides, Mr. Berwick said each door leads into two bays. There will be a total of 8 bays. He said it is not a drive -through operation. You could drive through, but it is not practical. Chairman Ryner asked the exact dimensions of the trash enclosure. Mr. Meu said it is the same width as the one for Payless. When specifically asked, he said a dipsy dumpster will not be used here. Member Gatto asked if Mr. Meu intended mission tile, brick work and wood to be the same coloring as the rest of the shopping center. Mr. Meu concurred. The other landscaping will be against the building. On each end they will put fruitless mulberry trees. There will be four bottle brush plants against the building. The balance of the shrubs will be juniper, Algerian ivy ground cover, and some tan bark will also be used." The rest of the landscaping is already existing on the property. All planting areas will be fully sprinklered. Member McLaren noted that the motion should specifically exclude the sign so there won't be any misunderstanding. To Chairman Ryner's question, Mr. Meu said the lighting would have 60 watt bulbs. Member Adams asked where the three mushroom lights would go. He was told they will go at the end of the building. Member Marquez asked if the applicant was anticipating lighting their sign. The applicant said it could go either way. Moved by Member Adams, seconded by Member Gatto to close the Public Hearing. Motion carried, 5-0 Moved by Member Gatto, seconded by Member Marquez to recommend approval of application HC-51,230.211(Goodyear Appliance Store), subject to the standard conditions and Exhibits A and B submitted herewith,.pointing out that the. signs are excluded totally from this approval. and, that this building is to be aesthetically tied to the rest of the buildings in that complex with respect to materials used. The Director of Public Works said this business has changed hands and the Building Department will work with them for a solution to this problem. The Director of Public Works said from now on he will provide the Committee with a summary of action rather than individual reports. I] Is 11 0 Minutes of the June 9, 1971 Ii-Control Meeting IIC-34 Page 7 Chairman Ryner asked if there is any way, at the time a business Alert public changes hands, to notify these people of the Architectural and to function of Site Approval regulations of the City of Cupertino. The Director this Committee said the public is unsophisticated as to the City's rules. It is very difficult to reach them all, due to the quantity of trans- actions of this type taking place every day. Member Adams suggested perhaps the City Attorney could come up with a method of alerting new businessmen of the rules the the Committee. Chairman Ryner repeated he would like to have some way of inform- ing the people that these conditions exist. The Director said the staff, as a general rule, does not go out and look for trouble. Most complaints are brought to the attention of the staff by the public. Member Marquez believes the people who come in for a building permit or a license should be made aware of the function of this Committee. Member Adams observed that perhaps 90% of the businesses changing hands must go through real estate brokers -- perhaps this is where they should learn about the Architectural and Site control. This did not seem practical to the others. Crossroads Center Landscaping. • There was no further information and no action taken. 11. Status Report of H-Control applications. a. City Beautification Program The Director of Public Works said the Citv Council has adopted the City Beautification Program with minor modifications. It will be sent out to the Committee Members. b. Taco Bell The Director of Public Works said the Taco Bell people got rid of the orange and used earth tones of blue, green and tile color on their sign. The logo effect is still there. C. Parking Ordinance There will be a review of the Parking Ordinance as to parking stall size. Councilman Frolich wants it back to 10 X 20. 12. George Ahamnos, Screening for Air Conditioning Unit. Don's Burger Villa, Stevens Creek Boulevard and Portal Avenue. The applicant was not present. The Director of Public Works said he was taking the equipment down for the summer. NEW BUSINESS 0 A. Member Adams asked the next time we have an application similar to that by Mr. Meu, how can we avoid these potential headaches? Can we ask the owner to insure the lease agreement include the roof apurtenances shall not show? Perhaps another condition should be that these are preliminary plans and any final plans showing air conditioning units shall be reviewed by the Architectural and Site Approval Committee. 11 The Director of Public Works said we should tighten up the staff requirements as well as the Planning Commission and H-Control. There could be a requirement that the developers bring the site plans to the Committee, particularly on hillside developments. 0 Minutes of the June 9, 1971 H-Control Mec_ting I HC-34 • Pa,e 9 ® Member Gatto said a check list,is a must for all building permits issued requiring a personal initial or signature of the applicant indicating he is aware of the requirements. 0 Chairman Ryner said Councilman Frolich brought up the produce market at the last Council meeting. It was asked who determined they are within the Ordinance. The Director of Public Works said the Building Inspector said this was a pre-existing, non- conforming sign. .The market keeps coming up with new innovations on the original signs. This is a problem of enforcement. Chairman Ryner questioned the Chief Building Inspectors inter- pretation of the Sign Ordinance in that perhaps it is not a pre-existing sign since it is a paper sign that is changed periodically. Member McLaren suggested pictures be taken at different times showing the excessive signs and handing them to the City Attorney. The Director said periodically, two members of the Street Depart- ment go through the.City and remove all non -conforming signs and store them in the corporation yard. Chairman Ryner said West Valley Industrial Park has beautiful trash enclosures with nothing in them and dipsy dumpsters along side them. The staff should check on this.
