Map, Ex. 1) Chairman Ryner stated that since Applications HC-51,269 and HC-51,270 were essentially the same, except fi�or the location of the stations, that the two would be discussed concurrently. 5. Application HC-51,270 - Shell'Oil Company requesting approval for remodeling existing statio.,n, site and architecture, Stevens Creek Blvd. and Stelling Road. Map, Ex. 2) Mr. David Wheeler, Real Estate Representative for -Shell Oil, 100 North Winchester, San Jose, said he reviewed the proceedings of the last H-Control meeting with the Shell Oil Management and learned there are no additional funds available to domore than was originally requested. by Shell. Member Adams stated he would not recommend approval of this applica- tion because the site plan does.not'have the complete treatment, as the Committee has asked for in thelpast for similar cases. Chairman Ryner asked for comments from the audience. There were none. i Member Sargent felt Shell Oil was Presenting a proposal for partial treatment. He said he could understand Mr. Wheeler's position, since this was a decision by ShelliManagement. He asked for further clarification of Shell's position.' Mr. Wheeler said this is a large program on the part of Shell to gee rid of the "tin box image", but funds to completely renovate all the stations were not available. If this proposal is not accepted iC will probably be delayed for a considerable length of t_'_me. If the cities do not approve the pro- posal the funds will be spent elsewhere. Member Sargent asked how restrictive their response is. Mr. Wheeler said he gets weekly reports regarding the tea Western states. Long Beach and Portland have received very good response. E • 11 _! MINUTES OF THE SEPTEMBER 22, 1971 H-CONTROL MINUTES I HC-40 Page 3 Member Sargent felt the problem probably is with the garrish signs. He asked if Shell has any control over the signs at the individual stations. Mr. Wheeler said the Los Gatos Use Permit conditioned their' -approval on approval of the signs and this was actually put in their lease. This way it can be enforced. Member McLaren said she was very, excited when she learned Shell was going to upgrade their stations. Since the funds are limited, she wondered if they could be concentrated on the station at Stevens Creek Blvd. and Stelling because of its proximity to De Anza College and the new extension of the freeway. We are now getting people to come to Cupertino from all over the world. She asked if the applicant would be in favor of a conditioned approval, Mr. Wheeler said that would be better than nothing. It would give him some "amunition" to take back to a meeting with the Shell people. Member Adams was in favor of upgraded landscaping and one sign with the deletion of exterior advertisements in the form of tire displays. Chairman Ryner disagreed with Members McLaren and Adams because he felt it was the responsibility of the applicant to present their plans and the Committee is to either recommend approval or denial to the City Council. Member Adams said his recommendation was not to give carte blanche approval but rather the Committee would specifically state what they would approve, which Mr. Wheeler could present as guidelines to Shell Management. Chairman Ryner was in favor of denying this application with the reasons for denial delineated. The Committee can't recommend something to the Council that they have not seen. Moved by Member Adams, seconded by Member Sargent to close the Public Hearings. Motion carried, 4-0 Moved by Member McLaren to recommend to the City Council denial of application HC-51,269 - Shell Oil at Highway 9 and Bollinger Road. This denial is to give the applicant the opportunity, without prejudice, to come back at a later date with updated landscape plans; and subject to the H-Control standard conditions and recommendations from the staff report —Conditions A through F. Chairman Ryner felt the motion should b.e reworded in such a way as to list the reasons for denial. The application does not include a complete plan of landscaping; 2. The application does not include a complete. plan for signs; 3. The application does not satis,f y completely the requirements of the H-Control conditions; 4. The application does not include the staff's suggestions to the original application. Application HC-51,162 - Pacific Gas and requesting approval_ of architecture of and Homestead Road. (Loc. Map, Ex. 3) Mr, Clark Mulliner, P.G. & E Representative, was present at this meeting. I Electric Company fence, Blaney Avenue 77 Beale, San Francisco, The Planning Director said previous approval was given the applicant in December 1970 for landscaping of the boundaries of the property excluding the Blaney Avenue boundary. The applicant now proposes an 8' slump stone concre~_a block wall_ with pilaster to run 468' along the frontage of the P.G. & E. property on Homestead Road with a 20' gate to be provided in the center MINUTES OF THE SEPTEMBER 22, 1971 H-CONTROL MEETING The site plan and elevations were displayed on the bulletin board. Colored photographs of the area were shown. Mr. Mulliner said when they submitted th(--:ir application for the. fence they inadvertently omitted their request for approval of a small identification sign. He presented photographs of the proposed sign to the Committee. Member McLaren wanted it clarified that the variance for an 8' . fence was approved. The Planning Director said this was the case. They now only need H-Control approval on it. Member Adams asked if this 8' high slump stone fence extending approximately'400' on Homestead and'1800' on the easterly property line will be inside or outside the trees. Mr. Mulliner said it ® will be placed outside the trees. Member Adams wondered how the neighbors will feel about the situation. The applicant said there will be additional landscaping installed. The Planning Director said the present landscaping is now about 6' tall. Mr. Mulliner said the brushed aluminum P.G. & E.identification sign will have letters 811.high and Cupertino Service Center 3". Moved by Member Adams, seconded by Member Sargent to close the Public Hearings. Motion carried, 4-0 Moved by Member Adams, seconded by Member McLaren to recommend to the City Council approval of application HC-51,162 - P.G. &.E. for the slump stone wall per Exhibits A and B submitted and also to approve the P.G. & E. sign and location sign, and the gate as shown in the photographs submitted with the application. Subject sign to be brushed aluminum letters 8" high for P.G. & E. and 3" high brushed aluminum letters for CUPERTINO SERVICE CENTER. MINUTES OF THE SEPTEMBER 22, 1971 H=CONTROL MEETING Member McLaren said the landscaping'°in the Portal Shopping Center is really in need of groomiut. There is a lot of debris around. They have not conformed to the conditionti placed on the approval of their application. The Planning Director said that normally occupancy would not be allowed until an applicant has conformed to all conditions placed on their application. This 'case is different in that the air conditioning was already installed and the Council agreed to let them "plug it in".. MINUTE ORDER: Moved by Member Adams, seconded by Member McLaren to instruct the staff to convey the Committee's feelings about this application to the Council. i' Motion carried, 4-0 Member McLaren said that sometime ago she asked the staff to check on the trash container situation at.th!e drive-in restaurant across from Gemco. There was a complaint from the car dealer across the street, wondering why they didn't have to conform to conditions placed on their application. The staff will jcheck into this again. i The Planning Director stated that Mr. Ahamnos is still interested in putting something higher on.thelroof of Don's Burger Villa. He plans to extend the mansard roof 2•JI/2'. After some discussion the Committee instructed the staff -to tell Mr. Ahamnos that the new shingles must be the same color as the old ones. NEW BUSINESS 0 is Member McLaren said the Bold Knightll Restaurant on Stevens Creek Blvd. has changed hands. They have installedlnew air conditioning equipment and the staff should check to see i;f it is visible from the street. Chairman Ryner said there is a grey signboard with tires and junk in front of it located just in front of the sign on Highway 9 saying you are entering the City of Cupertino. He; asked the staff to check on it. There was some discussion about the new fellow at the American Oil station at Highway 9 and Stevens Creek Blvd. who has started a trend in merchandising that bears looking into. b MINUTES OF THE SEPTEMBER 22, 1971 H-CONTROL MEETING ADJOURNMENI .
