Reso 0903HC-51,392.7 r RESOLUTION NO. 903 OF THE ARCHITECTURAL AND SITE APPROVAL C014MITTEE OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF INSTALLATION OF A TRASH COMPACTOR UNIT AT A LIGHT INDUSTRIAL SITE PROPERTY 014NER: Carl Berg APPLICANT: Four -Phase Systems, Inc. ADDRESS: 10700 N. De Anza Boulevard LOCATION OF PROPERTY: 10700 N. De Anza Boulevard FINDINGS The Architectural and Site Approval Committee finds as follows with respect to this application: 1. Acoustical documentation presented to the Committee indicates that the adjacent residential area will not experience an increased ambient noise level as a result of installion of the trash compactor unit. Conditions of approval as enumerated in this Resolution will ensure satisfactory compliance with this finding. CONDITIONS OF APPROVAL: 1-8. Architectural and Site Approval Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. 9. The recommendation of approval is based on Exhibit A, A-1, A-2 and A-3 of this application except as may be amended by special conditions contained herein. 10. Permitted hours of operation for subject trash compactor shall be Monday through Friday, 8:00 a.m. to 8:00 p.m. In the event that section 10.45.030 of the City of Cupertino Municipal Code is modified in the future to incorporate more restrictive hours, permitted hours of operation for the Four -Phase compactor shall be reduced accordingly. 11. Subsequent to installation of subject trash compactor, an acoustical engineer consultant shall be retained by the applicant to conduct an on -site investigation of all noise levels associated with the compactor. A City staff member shall be present during subject noise analysis. Results of said analysis shall be provided to staff, and any increase in noise levels deemed to be perceived by adjoining residents shall be mitigated prior to start-up of normal operations. Further, the City shall retain the right to require mitigation of noise levels which induce complaints by adjacent residences at any time. The applicant is aware that subject mitigation measures may include, but are not limited to, reduced hours of operation, technological modifications, relocation or complete enclosure of the unit, and removal of subject compactor from the site. A recommendation on this matter shall be made by the Architectural and Site Approval Committee to the City Council in the event that such action is warranted by an adverse . acoustical report or future citizen complaints. For purposes of reducing noise levels associated with the Four -Phase site, the following conditions shall be implemented upon installation of the trash compactor unit: a. The refuse pickup period for subject compactor shall closely cor- respond to peak traffic hours of 7:00 a.m. - 8:00 a.m. b. The retracting metal doors situated at the east elevation of Four - Phase Building No. One shall be limited to a total of six opening movements between the hours of 5:30 p.m. and 8:00 p.m. Subject restriction applies to custodial operations only.
