RESOLUTION NO. 1234
OF THE ARCEIITECIURAL AND SITE APPROVAL COMMITTEE
OF THE CITY OF CUPERTINO RECOMMENDING DENIAL OF FENCING
FOR LOT 43 OF THE ALCALDE KNOLLS SUBDIVISION.
PROPERTY OWNER: Howard & Helen Low
APPLICANT: Howard & Helen Low
ADDRESS: 10396 Avenida Lane
Cupertino, CA. 95014
LOCATION: North side of Avenida Lane, southerly of Voss Avenue
FINDINGS:
The Architectural and Site Approval Committee finds as follows with regard
to the decision to recommend denial of Application ASAC 51,671.1:
1) Visibility of the subject wire mesh fencing from downslope
properties on Voss Avenue and Krista Court has not been adequately
mitigated.
2) The area encompassed by the subject wire mesh fencing is excessive
for pool safety enclosure, thus increasing its visibility from
neighboring properties.
3) The location of the subject fence disrupts visibility of the
ridgeline upon which it is located.
4) By recommending denial of the subject application, the Committee
reaffirms the concerns expressed by the membership of the
® Architectural and Site Approval Committee on June 23, 1977 at which
time fencing controls were established to protect wildlife migratory
patterns and to preserve open visibility of the commmity's hillside
areas, and finds that these concerns have not been adeqautely
addressed in the present case.
