Reso 1199RESOLUTION NO. 1199 (MINUTE ORDER) OF THE ARCEIITECI'URAL AND SITE APPROVAL CONINIITTEE OF THE CITY OF CUPERTINO TRANSMITTING TO THE CUPER`I'INO CITY COUNCIL AN ADVISORY RECOWMMTION OF DENIAL FOR APPLICATION 1-V-86. The Architectural and Site Approval Committee respectfully requests that the City Council of the City of Cupertino DENY Application 1-V-86 of John Vidovich for variance to Condition 7 of Ordinance 1223 on the grounds that: 1) Applicant was informed and knew of the requirements for landscaping as sset forth in the CONCEPTUAL ZONING PLAN FOR STEVENS CREEK BOULEVARD (3-Z-83), and could have designed and positioned the project to comply with said requirements. 2) If Applicant believed that the project was financially infeasible WITHOUT the variance, he had the option not to implement the proposed development. • 3) It is this Committee's belief that this inappropriate use of the Variance proceedure would degrade the Conceptual Zoning Plan, and compromise the visual integrity of the City of Cupertino. 4) The Stevens Creek Blvd. Landscape Setback Plan, as embodied in Zoning Action 3-Z-83, is a major unifying element that does not warrant compromise in this instance.
