A. Remove the existing cashier kiosk and con v ert,�an e�fisting storage building to the new cashier
booth.
B. Reduce the size of the canopy and install grey side panels;' _
C. Alter gasoline pump island locations.
D. Widen the exit aisleway to accommodatel rjelocated 'underground gas tanks. The existing
tanks are located within an reciprocal access easement and parking area.
ISSUES:
ARCHITECTURAL AND SITE MODIFICATIONS:
The Architectural and Site Approval Committee had no concerns with the aesthetics of the
proposed modifications. Specifically, the Committee encouraged the relocation and.
reconstruction of the underground gas tanks.
STREET AND STREETSCAPE IMPROVEMENTS:

A. The City's Street and Streetscape Improvement .Policy requires full improvements in cases
where the cumulative floor area affected by applications exceeds 25% of the total floor area of
structures on site. As this project contains ,10,0% (160 sq. ft.) of the site's floor area, full street
improvements are required under the policy. ;Improvements include the 50 foot wide
landscape setback and the parkway sidewalk as�contained in the Stevens Creek Boulevard
Conceptual Plan and the Boulevard Landscaping and Sidewalk Standards.
B. The street improvement policy was developed in response to Application 7-1-1-86. A 1.500
square foot bakery applied for a use. permit; within the McClellan Square Shopping Center.
The application would have triggered full street improvement although it comprised only 2%
of the site's total floor area. The Street and Streetscape Improvement Policy was created to
standardize the City's deferral strategy and to avoid the requirement of costly improvements
on small applications.
C. That applicant feels it is unreasonable to impose the aforementioned improvements on this
application given its limited scope. The applicant points out that only 40 square feet of floor
area. could be affected by an application on this site under the "25% rule" since the site's total
square footage is 160 square feet. The site, therefore, is disproportionately constrained by
the policy.

RECOMMENDATION:
A. ASAC recommends denial of Application ASAC 51,762.1 finding that the proposal conflicts
with the current street improvement policy since the application does not implement the
required improvements.
B. However, ASAC also felt that the aforementioned improvements are an unreasonable and
excessive requirement because the application is minor in scope. The Committee approved a
Minute Order asking Council to consider a deferral of improvements for this application
C. Should Council find the improvements unreasonable, staff suggests that the improvement
policy be modified to apply only to application which encompass more than 500 square feet of
floor area. As a result, the policy would not apply to small applications such as kiosks,
cashier's booths, and snack shops.
