Speakers are limited to three (3) minutes a person. In most cases, state law will prohibit the commission from making any decisions with respect to a matter not listed on the agenda. A. No Speakers. NEW BUSINESS 1. Subject: Receive a presentation from Tony Batalla, Chief Technology Officer with the City of San Leandro, on their Journey to a Fiber Network. Guest Speaker Tony Batalla, Chief Technology Officer at the City of San Leandro ("City"), presented a PowerPoint detailing the City's journey on building a Fiber Optic Master Plan. 'I The City's journey started in 2011, when it entered into a Public-Private-Partnership with a local company called Lit San Leandro. The City was focused on Economic Development, and looked for ways to incentivize investment in its Downtown area. The project consisted of Lit San Leandro paying construction costs to put fiber through all of the City's unused conduit to create a broadband, in return they would give the City 10% of the Fiber. This approach was a joint effort, and an economic development tool to attract and retain businesses. The partnership was very successful, and in 2014 San Leandro decided to expand with the help of a$2.1 Million grant provided by the Federal Economic Development Agency. In 2015, the City of San Leandro used fiber to light up downtown providing Wi-Fi. This led to the expansion of Wi-Fi in most City TICC SPECIAL MEETING MINUTES JUNE 24,2019 facilities and by 2017, the City had connected all of its main Facilities to Wi-Fi. By 2018, the City of Sari Leandro decided to create a Master Plan that will guide the future investment of fiber and put in place an overall strategy. Currently, San Leandro has partnered with Common Networks to build a residential broadband service licensing the City infrastructure. Mr.Batalla confirmed the City of San Leandro has entered into a License agreement with the Company to license them City owned fiber and City rooftops to construct a residential broadband service expected to generate$120,000 a year for a term of 5 years with multiple renewal options. The City has three Internet Service Providers on their network: Crosslink, Paxio, and Unwired. These providers paid an estimated$3 Million in construction costs to pull 288 strands throughout the network. As a result, the City connected 350 businesses to Internet service. This resulted in a field of competition, and led to AT&T and ComCast coming in to install fiber throughout the City of San Leandro. During the discussion, the Commission discussed City of San Leandro's Smart City framework. As part of the discussion, Mr. Batalla reported on the Smart Streetlights program which involved converting all the City street lights to LED. The City coupled the upgrading with installing IoT notes and connected all the street lights to the wireless network. Ultimately, the City provided a narrowband network that can serve in the future to connect transportation, weather monitoring, gunshot, and audio analysis. The project is projected to save $8 million dollars in a period of 15 years. Following discussion, the Commission also discussed Adaptive traffic signaling, as San Leandro is currently working with TrafficWare, an automated Traffic Management system to build out adaptive traffic signaling on the main corridors. The pilot project has been proven successful and has only been conducted within City boundaries. Mr. Batalla highlighted Public Safety as it relates to their Fiber Network framework, and how the City plans to utilize its network for sensors, video cameras which can be used for evidence. This allows the City leverage since all they have to do is add an IoT note as opposed to constructing a new environment. In conclusion, Mr. Batalla confirmed City owns Conduit, in terms of Fiber there is Lit San Leandro fiber which the City owns 10% of. The shared fibers are housed in the City- owned conduit that varies in size ranging from an inch and a half. Mr. Batalla shared the Wireless Master Plan took a year to develop the Master Plan and have council approval. The Commission and City Staff thanked Mr.Batalla for sharing San Leandro's experience. Subject: Discussion with Cupertino's City Engineer,Chad Mosley,regarding a Public-Private-Partnership with Verizon Wireless, to obtain City-owned conduits. City Engineer Chad Mosley and Verizon Wireless representatives presented a PowerPoint for a Public-Private-Partnership. During the discussion, Mr. Mosley informed the Commission the City of Cupertino has a number of small cell agreements with Xnet, Verizon, Mobility, AT&T, and Crown Castle. He affirmed Verizon is interested in placing fiber in the City. Mr. Mosley supported the City of Cupertino working with Verizon to negotiate the installation of City-own conduits while Verizon installs fiber. The City of Cupertino charges $1,500 per year for Small Cells,however, a current Federal Communications Commission ("FCC')has regulations stipulating the going rate should be $270 a year. The City of Cupertino is considering lowering the small cell rate down to $270 provided Verizon appropriates a 1 1/4 inch City-own conduit inside of a 4 in. Verizon conduit. The agreement would be an ongoing partnership, and the attached Exhibit B shows the Fiber Map Conduit of the areas where the City-owned conduits would be housed. As part of the agreement, the City of Cupertino will be unable to tap into Verizon's 4- inch conduit. Thus, City of Cupertino would be required to work with Verizon to access the box. Cupertino would require for Verizon to respond to requests to access the box relatively quick, in addition they would need to insured the person working on the box is certified or licensed to work on Fiber. City Engineer Mosley explained Cupertino has the ability to pull out of the Verizon box should it decide to expand Fiber. Following the discussion, City Engineer Mosley relayed to the Commission he wanted direction in the manner to which proceed. The Commission has the option to direct him to move forward with beginning a negotiation of that agreement and get it prepared for Council approval, or accept recommendation for alternatives Verizon can provide. City Engineer Mosley relayed the City owning a small piece of conduit would be a great start to a Fiber network. Verizon provided the attached Exhibit A map which shows the conduit routes. Commissioner de Leon inquired about a Map depicting the box locations. Verizon indicated the route map is based on their high-level design, whereas they are currently working on the low-level design obtaining permits and plan approval. Verizon affirmed they would install innerducts as they buildout the conduits. Equally important, the City of Cupertino believes the FCC ruling will lower the rates for small TICC SPECIAL MEETING MINUTES JUNE 24, 2019 cells, whereas Verizon assumes it will not. Verizon affirmed they are looking to Partner with the City and request they follow the FCC's Safe Harbor rates. City Engineer Mosley requested Cupertino's Traffic fiber be segregated for the benefit of the City. Verizon referenced the Settlement agreement currently in place with the City of Cupertino that prevents the use of utility infrastructure, supporting street light use. The Commission requested for Verizon and the City to educate the Public on the radiation levels. Chief Technology Officer Mitchell suggested marketing information relating to radiation levels at the Town Hall meetings the City Manager is having with Councilmembers. Additionally, advertising the information on the City website to further educate the Public. City Engineer Mosley reported there will be a study session on Small Cells Facilities within the Public Right of Way at the upcoming July 16 City Council meeting. He affirmed the agenda item will be to strictly educate Council on Small Cells, what they are, and provide an opportunity for the Public to come in and support or opposed Small Cells, FCC regulations, and what the City can and cannot do. Commissioner Bollineni moved for City Engineer Mosley to move forward with negotiations for a Public-Private-Partnership with Verizon Wireless, and to inform Commissioners Mohanty and Soundararajan on the information presented today and receive their input on the negotiation and bring back a daft Agreement to the Commission on August for recommendation to the City Council. Summary of Terms & Conditions for Innerduct Verizon will install a manhole system with 4" HDPE conduit on select major thoroughfares in the City of Cupertino, subject to a revised wireless Master Lease Agreement (MLA). Verizon will install 3-1.25" HDPE innerducts inside the 4" conduit segments: • 1 innerduct would be owned by City of Cupertino and labeled as such on engineering and as built documentation • For any 3rd party companies that Cupertino allows use of innerduct the 3rd party would be allowed access under these conditions: 0 3rd party provides engineering to Verizon for anticipated length of use 0 Enter and exit from Verizon owned Manholes—31 party to provide knock out or core certification location 0 3rd party must place their own hand holes for any cable coils, splice cables, and termination points.
