Reso 162 95-Z-63 File No. 29-TM-63 Zone Change & Tentative Map PLANNING COMMISSION RESOLUTION NO. 162 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOM- MENDING GRANTING A ZONE CHANGE FROM AN R-1:B-2 ZONE TO AN R-1 ZONE AND APPROVAL OF TENTATIVE MAP. WHEREAS, the attached application has been submitted to the City of Cupertino ertino requesting a change of zone in the zoning regulations ulations of the City from an R-1:B-2 District to an R-1 District and approval of a Ten- tative Map; and WHEREAS, the Planning Commission has held at least one public hear- ing in regard to the application on the date as noted on said applica- tion; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the zoning ordinance of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission finds that the proposed zone change: a. Encourages the most appropriate use of land, ® b. Conserves and stabilizes the value of property, c. Provides for adequate open spaces for light and air, d. Permits adequate control of fires, e. Promotes the health, safety and public welfare, f. Provides for the orderly development of the City, g. Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. 2. That said Planning Commission, therefore, reports favor- able to the City Council in the matter of granting said zone change and approval of the tentative map. Said approval to be subject to the fol- lowing conditions: Exhibit B, items 1-12 13. 56° street to have traveled way between curbs of 140 ° . 14. Public utility easements (2° on each side of street right of way) , if necessary. 15. Existing sewage system to be backfilled.
