Reso 179 • F.:1, 10 No. 35-U-63 PLANNING COMMISSIoNDESOLUTION NO, 179 WHEREAS, the Planning, Commission of the City of Cupertino received the application of Frederick J. and Emma Luippold for a USE PERMIT for a convalescent hospital and rest home; and WHEREAS, the applicant has met the burden of proof required to support his said application. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, fats, exhibits and other evidence submitted in this matter, the application for the USE PERMIT be, and the same is hereby granted, subject to the following conditions: 1-12 Exhibit B 13 Reach a satisfactory agreement with the City Staff • for a 401 - 1/2 street from Homestead Road - Eminent domain proceedings may be necessary.
