INFORMAL REVIEW • 1. Application ASAC 51,004.151 - City of Cupertino Staff requesting review and canunents on a draft heritage tree ordinance. Michele Bjurman outlined and explained the different points of the tree ordinance and answered questions of the Committee Members. Committee Members Weber and Jackson expressed concerns with applying the ordinance to single family residential property. • Committee Member Jackson expressed concerns with determining an enforcement of the pruning requirement and stated same trees such as oaks would be damaged if pruned that much, and others would require more pruning. All the Committee Members expressed concerns with determining significant economic hardship. Committee Members Jackson, Lim, and Weber felt that the ordinance imposes too much government control into people's lives and felt uncomfortable with the retroactivity of the ordinance. Committee Member Hoxsie suggested a specie specific requirement for R-1 areas or larger size requirements. ASAC Minutes for the Meeting of November 26, 1990 Page -2 Committee Member Lim suggested only trees which are clearly visible from the public right-of-way be protected. He further suggested the • ordinance have a special exception list. Committee Member Hoxsie stated that trees in the public right of way should fall under the same criteria as all other trees. Committee Member Jackson stated she felt the ordinance was an over kill for a very limited problem. Chairman Gong and Committee Member Weber stated that the fine was too law, and that it is cheaper to be fined than to follow the rules. FORMAL REVIEW 2. Application 1-ASAC-90 - Able Sign Requesting review and approval to. revise an existing sign program at an existing retail store. The site is located at 10127 Bandley Drive, southeast corner of Bandley Drive and Alves Drive. Due to the applicant not being present, on a 5-0 vote the application was moved to the end of the agenda. 3. Application ASAC 51,885.3 - Thomas Swan Signs Requesting review and approval for a new monument sign program for an existing retail center located at the southeast corner of Stevens Creek Boulevard and Portal Avenue. • Tarn Robillard reviewed the staff comments noting the scope of the project and recommended approval. Terry Greenan, Thomas Swan Signs, reviewed the scope of the project and answered questions of the Committee Members. Ca mnittee Member Hoxsie stated the sign was too big and liked the previously approved sign better. Chairman Gong asked about the height of the signs directly across the street at Portal Plaza. Tarn Robillard stated they were between 8 and 9 feet in height. Committee Member Weber stated the signs were too big, did not like the color, and did not like the secondary sign within the site. Committee Member Lim stated he liked the two signs adjacent to Stevens Creek Boulevard, but did not like the secondary sign. Committee Member Jackson expressed concerns with the equity of sign approvals stating the sign across the street was approved for 9 feet and that this sign should be approved at a similar height. She further stated that she did not like the secondary sign. Chairman Gong stated he liked the palm trees' design on the signs. Ctunittee Member Lim moved and Chairman Gong seconded a motion to approve application ASAC 51 885.3 according to the model resolution with Condition 10 added to read 10) The address number range shall be included on the monument sign so as to be clearly visible from passing motorists. The motion was denied on a 2-3 vote. DECISION: On a 4-1 vote with Committee Member Hoxsie, voting no, application ASAC 51,885.3 was approved according to the model resolution with Conditions 10, 11, and 12 added to read as follows: 10) The address number range shall be included on the monument sign and shall be clearly visible to passing motorists. 11) The sign shall be reduced to an overall height of 8 feet with a 6 foot sign on a 2 foot base. The height shall be measured from the adjoining finished grade. • 12) The secondary site monument sign is not approved as part of the submittal. 4. Application 5-U-90 - Taco Bell Requesting review and approval of a precise development plan for a new fast food restaurant located at the northeast corner of De Anza Boulevard and Bollinger Road. Tam Robillard reviewed the staff comments noting that staff's reccmi endation for denial was based upon staff consensus that the architecture did not propose a high-quality unique building which 06. takes advantage of the gateway location of the site. He explained the '. revisions to the landscaping plan noting that it reflected the changes requested by ASAC at the previous meeting. He reiterahr1 his concerns with the signage plan, stating that the ordinance normally allows two building signs or one building sign and one ground sign. He stated that staff suggests that the city sign read !'Welcome To Cupertino" instead of "The City of Cupertino" so as not to give the impression of a government or official building. Will Harris, Taco Bell, and George Mills, Robert Lee and Associates, further reviewed the scope of the project, noting the changes that were made according to ASAC's direction and answered questions of the Camnittee Members. The distance from the building shall be determined between staff and the applicant. 15) The north elevation shall not have an arch. 16) The grass area adjacent to the entrance at Bollinger Road shall be replaced with ground cover and shrubs which are used elsewhere on the project. 17) The lattice between the front arches may be extended to a level no less than the bottom of the building facia. NEW BUSINESS 5. Proposed cancellation of December 26, 1990 ASAC meeting. On a 5-0 vote the meeting of December 26th was cancelled. ANAL OF M NUIY 6. Minutes of the regular ASAC mooting of November 13, 1990 were approved as submitted on a 4-0 vote with Committee Member We1Pr abstaining. FORMAL REVIEW • 2. Application 1-ASAC-90 - Able Signs DECISION: On a 5-0 vote Application 1-ASAC-90 was continued to the meeting of December 13, 1990 due to the applicant not being present. CIITTEE RS Committee Member Lim asked staff to check the brightness of the lights for the YMCA sign. Committee Member Web r expressed concern regarding the number of signs at the Pacific Western Bank at Stevens Creek and De Anza Boulevards. Committee Member Hoxsie expressed concern regarding the sign for "Spare Change" and its conformance with the sign program. The discussion of the Committee Members focused on how ASAC comments are being presented to the City Council. They expressed concerns that the issues are not being accurately presented. The Committee Members also discussed the confusion of City Council direction for colors of buildings. They expressed concern regarding the City Council overturning ASAC's decision regarding the La Mancha building colors and then again overturning ASAC and Planning Commission recommendations for colors at the Boulevard Center which seemed to be at opposites.
