RECOMMENDATION: Staff recommends approval of EXC-2005-12, based on the model resolution. BACKGROUND: The applicant, E. Hoffman Enterprises, owns a commercial building consisting of 3,303 square feet approximately 86 feet from the South East corner of Stevens Creek Boulevard and South Blaney Avenue. The building tenant is Charles Schwab, and E. Hoffman Enterprises has proposed to replace the existing channel letters on the Charles Schwab wall sign. The exception requested is for: Wall sign height The applicant proposes to replace the existing wall sign channel letters on the north elevation facing Stevens Creek Boulevard. The proposed height of the letters "h" and "I" in" charles" is twenty-four inches. The sign ordinance allows a maximum wall sign height of eighteen inches. DISCUSSION: Findin~s for Exception Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant an exception based upon the following findings: A. Literal Enforcement of the Sign Regulations will result in restrictions inconsistent with the spirit and intent of this title. The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of signs as they relate to building design" and to "provide [sign regulations] that will allow for good visibility for the public and the needs of the business...." Two of the seventeen channel letters in the wall sign exceed the eighteen-inch maximum by eight inches due to the lower-case font of the sign. Staff believes the sign is attractive and that the heights of the "h" and "I" letters are appropriate for the scale of the sign. If the "h" I-I July 21, 2005 EXC-2005-12 and "I" channel letters were reduced to eighteen inches, the remaining letters would be too small. B. The granting of the exception will not result in a condition that is materially detrimental to the public health, safety, or welfare. The signs do not create any health or safety problems. c. Least modification of the prescribed regulations and the mzmmum varzance that will accomplish the purpose. Per the Sign Ordinance, the applicant is allowed a 35 feet long wall sign. However, the applicant is proposing a much shorter wall sign at 24'2." RECOMMENDATION: Staff recommends approval of R-2005-18, based on the model resolution. BACKGROUND: On July 7, 2005, the Committee considered the project and directed the applicant to: . Provide a Privacy Protection Planting plan . Provide the setbacks for the homes on the two sides of the proposed project . Provide dimensioned building elevations with maximum height called out. DISCUSSION: Privacy Protection Planting plan The Privacy Protection Planting plan has been provided. The applicant is proposing to plant 7 (seven) Italian Cypresses in his right side yard and 6 (six) Italian Cypresses in his left side yard as privacy protection trees. These trees tend to grow vertically and can easily trimmed to allow adequate emergency fire access. The plan is missing some trees along the Southerly property line. Staff recommends adding one IS-gallon Cupressus Sempervirens - Italian Cypress and one IS-gallon Pinus Helipensis - Aleppo Pine in this area to provide adequate screening for the adjacent neighbor. Setbacks for adjacent homes Commissioner Giefer requested side yard information of the two adjacent homes. The following is an aerial photograph showing the subject property and neighboring properties with the side yard setbacks called out. d - 2..... PRIVACY PROTECTION PLANTING PLAN A detailed privacy-planting plan shall be submitted to the Planning Department for review and approval prior to issuance of the building permits. The plan shall incorporate one of the following items to address the privacy impacts of the bedroom window above the garage facing the right side of the house. The applicant shall either . Raise the sill height of the window to be five feet from the finished floor, or . Get a signed waiver from the adjacent neighbor at 10284 Orange Avenue or . The plan shall be consistent with the privacy screening provisions in the Chapter 19.28 of the Zoning Ordinance and the recommendations of the staff report. 3. PRIVACY PROTECTION COVENANT The property owner shall record a covenant on this property to inform future property owners of the privacy protection measures and tree protection requirements. The precise language will be subject to approval of Planning staff. Proof of recordation must be submitted to the Community Development Department prior to final occupancy of the residence. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions.
