grant to the CITY OF CUPERTINO, a California municipal corporation, an easement for public
purposes and for preservation of public safety, welfare and convenience, including but not
limited to roadway purposes, together with the right to construct, repair, operate, and maintain
any and all public utilities and improvements in, on, under, along and across the real property
described in Exhibit A and shown in Exhibit B, which is situated in the City of Cupertino,
County of Santa Clara, State of California.

LEGAL DESCRIPTION
All that certain real property situated in the County of Santa Clara, State of California and being
a portion of Lot 12, as shown upon that certain Map entitled Tract No. 124 Subdivision of the
Van Dine Tract, filed in Book 4 of Maps, Pages 24 and 25 on January 2, 1940, at the official
records of Santa Clara County. Said lands being more particularly described in that certain Grant
Deed,filed for record on October 21, 2008,Document No. 20023764, at the said County.
An Easement for Public Roadway purposes over and across a portion of said lands being
more particularly described as follows:
COMMENCING at the intersection of S. De Anza Boulevard (formerly Saratoga-Sunnyvale
Road) and Prospect Road thence along the centerline of Prospect Road, S.87°30'00"W., a
distance of 204.19 feet to the point of intersection with the westerly line of said lot; thence along
said line, North, a distance of 45.04 feet to the southwest corner of said lot,lying in the northerly
line of said public street (45' half street width), said point also being the POINT OF
BEGINNING; thence continuing northerly along said lot line, a distance of 3.00 feet; thence
N.87°30'00"E., a distance of 110.49 feet parallel with the southerly line of said lot; thence
N.02°30'00"W., a distance of 1.00 feet to the point of curve of a non-tangent curve to the left, of
which the radius point lies N.02°30'00"W., a radial distance of 31.00 feet; thence northeasterly
along the arc, through a central angle of 87°30'00", a distance of 47.34 feet; thence East, a
distance of 1.00 feet; thence North, a distance of 103.53 feet, parallel with the easterly line of
said lot to the northerly line of said lot; thence East along said lot line, a distance of 3.00 feet to
the northeasterly corner of said lot lying in the westerly line of said public street (60' half street
width); thence following three courses along said lot lines, coincident with said public streets:
1) South, a distance of 103.53 feet to a point of curve
2) along said curve to the right having a radius of 35.00 feet and a central angle of 87°30'00",
southwesterly along the arc a distance of 53.45 feet
