Proiect Description: Architectural Site Approval for a 4,707 square foot single-story residence in a
planned development zoning district (Oak Valley).
RECOMMENDATION:
Staff recommends approval of ASA-2005-16, based on the model resolution.
BACKGROUND
Any new residence in this neighborhood (Unit 3 of the Oak Valley development) requires architectural
review, since no specific housing styles were pre-approved for these areas. The design guidelines for
this development require that "manufactured materials such as stucco should be used sparingly and
should not visually dominate." This guideline has been interpreted to mean that no more than 50% of
the residences in anyone area shall be stucco. Currently, including this application, this area has 10
stucco and 8 shingle/siding residences, and two vacant lots. Therefore, the residences on the two
remaining lots must be shingle/siding. This lot is one of the two that need to be shingle/ siding. The
applicant is proposing a lap siding home. A photograph of what the home will look like is attached to
this report.
DISCUSSION
The plan is in conformance with the development standards. The applicant proposes a 4,707 square
foot single story residential home.

WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more
public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:
1. The proposal, at the proposed location, will not be detrimental or injurious to property
or improvements in the vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
2. The proposal is consistent with the purposes of this chapter, the General Plan, and
zoning ordinance;
3. Abrupt changes in building scale is avoided and a gradual transition related to height
and bulk is achieved;
4. Design harmony between new and existing buildings is protected through the use of
consistent or compatible design and color schemes;
5. The new development is designed to protect residents from noise, traffic, light and
visually intrusive effects by use of buffering, setbacks, landscaping, walls and other
appropriate design measures.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the design review application is hereby approved subject to the
conditions which are enumerated in this Resolution beginning on page 2 thereof; and
That the sub conclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning Application ASA-2005-16
set forth in the Minutes of the Design Review Committee meeting of, November 17, 2005, and
are incorporated by reference as though fully set forth herein.

The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other
exactions. You are hereby further notified that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.

The driveway shall be paved with permeable pavers on sand and aggregate base (or
similar pervious materials). A material sample and the final design shall be reviewed and
approved by the Planning Department prior to issuance of building permits.

DISCUSSION
The applicant proposes a 575 square foot addition to the rear of Unit B of an existing four-plex.
Please note that the architect made an error in identifying the unit numbers of the property.
The actual unit numbers have been used in this report. The following table shows the actual
units numbers and the numbers that the architect has used.

The four-plex is situated on a 16,637 square foot lot. The proposed 575 square foot addition
will increase the lot coverage to 23.67% (maximum allowed is 40%). The addition conforms to
the R3 ordinance and is not visible from any neighboring properties.
The Design Review Committee could request privacy protection for the proposed second story
deck on the West elevation (rear); however, staff does not believe privacy protection planting
is necessary since the property to the west of the subject property is on a higher grade. The
change in grade is approximately four feet six inches. Additionally, there are several large
trees that screen with landscaping (see attached photographs). Thus, the neighbor will not be
affected by the addition of the second story deck for use by Unit C. The new entry feature
being added to Unit B and the embellishments to the porch also enhance the aesthetic
appearance of the property.
The applicant is planting five trees along the rear (southern) fence line of the property, one tree
along the east property line and bushes along the west property line to increase the amount of
landscaping on the property. The applicant is proposing to plant Lombardy Poplars along the
rear fence line; however, this grows without much of a canopy. Staff recommends that some
other species, that has a canopy, be planted along the southern fence line. A condition has also
been added to plant one tree in the front yard of the property.
Additionally, the open parking stalls in the rear are not striped on the ground. Striping of the
parking stalls has been added as a condition of approval.

WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more
public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:

SECTION II: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more
public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:
1. The proposal, at the proposed location, will not be detrimental or injurious to property
or improvements in the vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
2. The proposal is consistent with the purposes of this chapter, the General Plan, and
zoning ordinance;
3. Abrupt changes in building scale is avoided and a gradual transition related to height
and bulk is achieved;
4. Design harmony between new and existing buildings is protected through the use of
consistent or compatible design and color schemes;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the design review application is hereby approved subject to the
conditions which are enumerated in this Resolution beginning on page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning Application ASA-2005-15
set forth in the Minutes of the Design Review Committee meeting of, November 17, 2005, and
are incorporated by reference as though fully set forth herein.

This approval is based on the design in the plan set entitled "First Floor Addition for Unit
, Am dated October 28, 2005, as amended by this resolution.
2. LANDSCAPING
Applicant shall submit a revised landscaping plan proposing another species of trees for
the five trees along the fence to the south. This revised plan shall be submitted to and
approved by the Planning Department prior to issuance of building permits.
