Project Description: DRC review of building permit plans for conformity to the
architectural rendering approved by the City Council at its meeting of March 1, 2005.
RECOMMENDATION:
Staff recommends approval of a resolution finding that the building plans substantially
conform to the architectural rendering submitted on behalf of application file no. ASA-
2004-02.
BACKGROUND:
On March 1, 2005, the City Council approved an Architectural and Site Approval for the
design of a mixed use project, consisting of 2,395 square feet of retail space and 23
residential units at 20128 Stevens Creek Boulevard, also known as Adobe Terrace. Part
of that approval included a Council directive for the Design Review Committee to
review the building permit plans for their conformity to an architectural rendering that
was submitted by the applicant at the public hearing (Exhibit A).
DRC first heard this item on November 17th and continued the hearing to the next
meeting to obtain additional information.
DISCUSSION:
The submitted plans include: the preliminary final tract map and a plan set that
includes a number of construction drawings that illustrate features found in the
architectural rendering.

As with most architectural renderings, the front landscape is greatly simplified or
removed to better depict the architectural detailing of the building frontage. What
appears to be "curtains" in the garage elevation are actually openings in the wall
depicted on sheet # AO.6. Staff has reviewed the building plans and compared them to
the architectural rendering and finds the plans are in substantial conformance to the
rendering. The project architect will be at the hearing to answer questions and will
bring a color and material board. Staff will bring the full set of construction drawings
in the event you have questions not answered by this plan set.

That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the Design Review Committee finds that the building plan designs
are in substantial conformance to the submitted architectural rendering.
That the subconclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning Application ASA-2004-02
set forth in the Minutes of the Design Review Committee meeting of, November 17,2005, and

neighborhood commercial uses with incidental light industrial and residential land
uses (4-12 du/ gross acre),
RECOMMENDATION:
Staff recommends approval of ASA-2005-13, based on the model resolution,
BACKGROUND:
Audrey Smith, representing T-Mobile, is proposing an architectural & site approval to
allow a personal wireless service facility with the antennas mounted on the roof of this
office building located at the southeast corner of Stevens Creek Boulevard and Orange
Avenue, The City's wireless communications facility ordinance provides for different
levels of review and approval, depending on the visibility of the structures, Monopoles
visible to public rights-of-way and residential properties require use permit approval
from the Planning Commission, Facilities mounted on buildings, depending on their
visibility and level of architectural review, will be generally referred to the Design
Review Committee for review, In either case, public noticing has been mailed to a
1,000-foot radius, A neighborhood meeting hosted by T -Mobile was attended by only
two members of the public, using the same 1,000-foot mailing radius,
DISCUSSION:
Proiect: Three panel antennas are proposed to be mounted in the equipment well on
the top of the roof of this office building, The antennas have been situated in a roof
location that is furthest from residential properties and concealed behind a faux
chimney with spark arrestor and constructed of radio-transparent materials, The
maximum height of the panel antennas is approximately 34 feet and the faux chimney
will rise 6.5 feet above the parapet of the roof, The height and setback of the installation
is well within ordinance limits, The aerial photograph below depicts the actual setbacks
from residential properties, which are greater than the ordinance minimum of 50 feet.
· Antenna Location
The faux chimney will be textured and colored to match the building, Cable runs are
located in the rooftop equipment well concealed from view and the base equipment
cabinets will be located in a partitioned space within the office suite below the antennas,

Wireless Coverage: The coverage maps, Exhibits B & C, show the existing T-Mobile
radio coverage and the improvement with the proposal. This facility would serve the
Monta Vista neighborhood,
Radio Frequency Emissions Study:
Radio engineering firm Hammett & Edison, Inc. has prepared a report on the predicted
RF emissions generated by the proposed facility and compared them to the adopted
federal safety standard of 1,00 m W / cm2 for public exposures (Exhibit D), The
calculated maximum level of ground level exposure is 0,0048 m W / cm2 which is 0,48%
of the applicable public exposure limit, Second floor level exposure is higher and the
maximum calculated level is 1,2% of the applicable exposure limit,

WHEREAS, the necessary public notices have been given in accordance with the Procedural

The finn of Hammett & Edison, Inc" Consulting Engineers, has been retained on behalf of T-Mobile, a
personal wireless telecommunications carrier, to evaluate the base station (Site No, SF14973) proposed
to be located at 21760 Stevens Creek Boulevard in Cupertino, California, for compliance with
appropriate guidelines limiting human exposure to radio ftequency ("RF") electromagnetic fields,
Prevailing Exposure Standards
The V,S, Congress requires that the Federal Communications Commission ("FCC") evaluate its actions
for possible significant impact on the environment. In Docket 93-62, effective October 15, 1997, the
FCC adopted the human exposure limits for field strength and power density recommended in Report
No, 86, "Biological Effects and Exposure Criteria for Radiofrequency Electromagnetic Fields,"
published in 1986 by the Congressionally chartered National Council on Radiation Protection and
Measurements ("NCRP"), Separate limits apply for occupational and public exposure conditions,
with the latter limits generally five times more restrictive, The more recent Institute of Electrical and
Electronics Engineers ("IEEE") Standard C95,l-1999, "Safety Levels with Respect to Human
Exposure to Radio Frequency Electromagnetic Fields, 3 kHz to 300 GHz," includes nearly identical
exposure limits, A summary of the FCC's exposure limits is shown in Figure 1. These limits apply
for continuous exposures and are intended to provide a prudent margin of safety for all persons,

General Facility Requirements
Base stations typically consist of two distinct parts: the electronic transceivers (also called "radios" or
"cabinets") that are connected to the traditional wired telephone lines, and the passive antennas that
send the wireless signals created by the radios out to be received by individual subscriber units, The
transceivers are often located at ground level and are connected to the antennas by coaxial cables about
I inch thick, Because of the short wavelength of the frequencies assigned by the FCC for wireless
services, the antennas require line-of-sight paths for their signals to propagate well and so are installed
at some height above ground, The antennas are designed to concentrate their energy toward the

horizon, with very little energy wasted toward the sky or the ground, Along with the low power of
such facilities, this means that it is generally not possible for exposure conditions to approach the
maximum permissible exposure limits without being physically very near the antennas,
Computer Modeling Method
The FCC provides direction for determining compliance in its Office of Engineering and Technology
Bulletin No, 65, "Evaluating Compliance with FCC-Specified Guidelines for Human Exposure to
Radio Frequency Radiation," dated August 1997, Figure 2 attached describes the calculation
methodologies, reflecting the facts that a directional antenna's radiation pattern is not fully formed at
locations very close by (the "near-field" effect) and that the power level from an energy source
decreases with the square of the distance from it (the "inverse square law"), The conservative nature
of this method for evaluating exposure conditions has been verified by numerous field tests,
Site and Facility Description
Based upon information provided by T-Mobile, including drawings by MSA Architecture and
Planning, Inc" dated October 26, 2005, it is proposed to mount three Andrew Model 932DG65VTEM
directional panel antennas within a new screen, configured to resemble a chimney, to be installed above
the roof of the two-story building located at 21760 Stevens Creek Boulevard in Cupertino, The
antennas would be mounted with up to 2° downtilt at an effective height of about 34 feet above
ground, 6 feet above the roof, and would be oriented toward OCT, l400T, and 2400T, The maximum
effective radiated power in any direction would be 800 watts, representing four channels operating
simultaneously at 200 watts each, There are reported no other wireless telecommunications base
stations installed nearby,
Study Results
For a person anywhere at ground, the maximum ambient RF exposure level due to the proposed
T-Mobile operation is calculated to be 0,0048 mW/cm2, which is 0.48% of the applicable public
exposure limit, The maximum calculated level at the second-floor elevation of any nearby building is
1,2% of the public exposure limit. It should be noted that these results include several "worst-case"
assumptions and therefore are expected to overstate actual power density levels, Areas on the roof of
the subject building are calculated to exceed the applicable exposure limit. The maximum level inside
the building is expected to be many times below the public limit.
Recommended Mitigation Measures

It is understood that, because the roof of the building is restricted against unauthorized access, the
T-Mobile antennas would not be accessible to the general public, and so no mitigation measures are

necessary to comply with the FCC public exposure guidelines, To prevent occupational exposures in
excess of the FCC guidelines, no access within 2 feet in front of the T-Mobile antennas themselves,
such as might occur during building maintenance activities, should be allowed while the site is in
operation, unless other measures can be demonstrated to ensure that occupational protection
requirements are met. Posting explanatory warning signs' at roof access locations and at each antenna,
such that the signs would be readily visible from any angle of approach to persons who might need to
work within that distance, would be sufficient to meet FCC-adopted guidelines,
Conclusion
Based on the infonnation and analysis above, it is the undersigned's professional opinion that the base
station proposed by T-Mobile at 21760 Stevens Creek Boulevard in Cupertino, California, will
comply with the prevailing standards for limiting public exposure to radio frequency energy and,
therefore, will not for this reason cause a significant impact on the environment. The highest calculated
level in publicly accessible areas is much less than the prevailing standards allow for exposures of
unlimited duration, This fmding is consistent with measurements of actual exposure conditions taken
at other operating base stations, Posting of explanatory signs is recommended to establish compliance
with occupational exposure limitations,

Assessment by Calculation of Compliance with FCC Exposure Guidelines
The V,S, Congress required (1996 Telecom Act) the Federal Communications Commission ("FCC") to
adopt a nationwide human exposure standard to ensure that its licensees do not, cumulatively, have a
significant impact on the environment. The maximum pennissible exposure limits adopted by the FCC
(see Figure I) apply for continuous exposures from all sources and are intended to provide a prudent
margin of safety for all persons, regardless of age, gender, size, or health, Higher levels are allowed for
short periods of time, such that total exposure levels averaged over six or thirty minutes, for
occupational or public settings, respectively, do not exceed the limits,
Near Field.
Prediction methods have been developed for the near field zone of panel (directional) and whip
(omnidirectional) antennas, typical at wireless telecommunications cell sites, The near field zone is
defined by the distance, D, from an antenna beyond which the manufacturer's published, far field
antenna patterns will be fully fonned; the near field may exist for increasing D until some or all of three
conditions have been met:

SECTION II: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more
public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:
1, The proposal, at the proposed location, will not be detrimental or injurious to property
or improvements in the vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
2, The proposal is consistent with the purposes of this chapter, the General Plan, and
zoning ordinance;
3. Abrupt changes in building scale is avoided and a gradual transition related to height
and bulk is achieved;
4, Design harmony between new structures and existing buildings is protected through
the use of consistent or compatible design and color schemes;
5, The project complies with federal safety standards for radio frequency radiation
emissions; and
6, The project is consistent with the City's Wireless Facilities Master Plan and Wireless
Communications Facilities Ordinance,
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the design review application is hereby approved subject to the
conditions which are enumerated in this Resolution beginning on page 2 thereof; and

are based and contained in the public hearing record concerning Application ASA-2005-13
set forth in the Minutes of the Design Review Committee meeting of, December 15, 2005, and
are incorporated by reference as though fully set forth herein,
SECTION III, CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT
DEPT.
1. APPROVED PROTECT
This approval is based on the approved plan set exhibits entitled "BI-MARK STEVENS
CREEK BLVD, SF-14973, 21760 STEVENS CREEK BLVD, CUPERTINO, CA 95014 SANTA
CLARA COUNTY" dated 10/25/05 and consisting of 5 sheets labeled T-l, A-I through A-
4, except as may be amended by the conditions contained in this resolution,
2, NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions, Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other
exactions, You are hereby further notified that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun, If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions,
3, ABANDONMENT
If after installation, the aerial is not used for its permitted purpose for a continuous period
of 18 months, said antennas and associated facilities shall be removed, The applicant shall
bear the entire cost of demolition and removal.
4, EXPIRATION DATE
This use permit shall expire five (5) years after the effective date of the permit. The
applicant may apply for a renewal of the use permit at which time the Planning
Commission may review the state of wireless communication and camouflage
technologies to determine if the visual impact of the personal wireless facility can be
reduced. .
5, FIELD MEASUREMENT OF RF RADIATION
Within one month of activation of the personal wireless service facility, the applicant shall
submit a report prepared by a State-licensed radio engineer documenting the actual level
of radio frequency radiation emissions at the following exposure sites:
1, ground level, 30 feet away from antenna
2, 2nd floor office suite below antenna
3, 2nd floor level of adjacent office building to the east
4, same roof top exposure adjacent to antenna (indicate distance)

The measured results shall be compared to the relevant federal safety standards, If the
measurements exceed federal standards, the engineer shall offer recommendations to achieve
standards,

public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:

safety, general welfare, or convenience;
2, The proposal is consistent with the purposes of this chapter, the General Plan, and

similar pervious materials), A material sample and the final design shall be reviewed and
approved by the Planning Department prior to issuance of building permits,

The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions, Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
