RECOMMENDATION: Staff recommends approval of a resolution finding that the building plans substantially conform to the architectural rendering submitted on behalf of application file no. ASA- 2004-02. BACKGROUND: On March 1, 2005, the City Council approved an Architectural and Site Approval for the design of a mixed use project, consisting of 2,395 square feet of retail space and 23 residential units at 20128 Stevens Creek Boulevard, also known as Adobe Terrace. Part of that approval included a Council directive for the Design Review Committee to review the building permit plans for their conformity to an architectural rendering that was submitted by the applicant at the public hearing (Exhibit A). DRC first heard this item on November 17th and continued the hearing to the next meeting to obtain additional information. DISCUSSION: The submitted plans include: the preliminary final tract map and a plan set that includes a number of construction drawings that illustrate features found in the architectural rendering. What appears to be "curtains" in the garage elevation are actually openings in the wall depicted on sheet # AO.6. Staff has reviewed the building plans and compared them to the architectural rendering and finds the plans are in substantial conformance to the rendering. The project architect will be at the hearing to answer questions and will bring a color and material board. Staff will bring the full set of construction drawings in the event you have questions not answered by this plan set. Abrupt changes in building scale is avoided and a gradual transition related to height and bulk is achieved; 4, Design harmony between new structures and existing buildings is protected through the use of consistent or compatible design and color schemes; 5, The project complies with federal safety standards for radio frequency radiation emissions; and 6, The project is consistent with the City's Wireless Facilities Master Plan and Wireless Communications Facilities Ordinance, NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the design review application is hereby approved subject to the conditions which are enumerated in this Resolution beginning on page 2 thereof; and Resolution No, 229 Page 2 ASA-2005-13 December 15, 2005 That the subconclusions upon which the findings and conditions specified in this resolution are based and contained in the public hearing record concerning Application ASA-2005-13 set forth in the Minutes of the Design Review Committee meeting of, December 15, 2005, and are incorporated by reference as though fully set forth herein, SECTION III, CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED PROTECT This approval is based on the approved plan set exhibits entitled "BI-MARK STEVENS CREEK BLVD, SF-14973, 21760 STEVENS CREEK BLVD, CUPERTINO, CA 95014 SANTA CLARA COUNTY" dated 10/25/05 and consisting of 5 sheets labeled T-l, A-I through A- 4, except as may be amended by the conditions contained in this resolution, 2, NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions, Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions, You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun, If you fail to file a protest within this 90- day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions, 3, ABANDONMENT If after installation, the aerial is not used for its permitted purpose for a continuous period of 18 months, said antennas and associated facilities shall be removed, The applicant shall bear the entire cost of demolition and removal. 4, EXPIRATION DATE This use permit shall expire five (5) years after the effective date of the permit.
