As we all know, voters in the Nov. 8 election decided not to adopt three ballot Measures:
(A) housing density, (B) building heights, and (C) setbacks from the street. The intended
goal of those measures was to establish standards for sensible growth management, in
order to preserve the suburban character of our city. The objectives of Concerned
Citizens for the future of Cupertino are listed below:
· Protect Our Excellent Schools
· Protect Our Home Values
· Provide a Choice For Residents
· Preserve Our Scenic Views
· Control Traffic Congestion
Nearly 6000 voters signaled YES on the ballot measures. If ~500 people had voted in
favor of Measures A or B instead of voting against them, those two Measures would have
passed. It was a close election despite overwhelming amounts of funding contributed to
the opponents, the unanimous statements against the measures by all the politicians, and
negative editorials and recommendations in all the newspapers. A completely grassroots
group of Cupertino residents supported the measures with financing only trom individual
citizens. Developers and special interest groups (most of whom are not Cupertino
residents) provided over 90% of the funding for the opposition.
It is clear that the residents really do want substantive action to preserve the suburban
character of Cupertino, and to protect the schools from overcrowding. However,
evidently a majority of voters had strong enough doubts about possible side effects of the
initiative measures, that they voted "No". Even though the measures did not quite pass,
the voters have sent a strong statement to the Council, which must not be ignored.
Several Council Members have already responded that they understand this message, as
indicated below.
Mayor Patrick K wok wrote: "The new council needs to bring our community together in
the post Measures A, B, & C era with a better understanding of the issues and what we
can do to solve these issues together rather than in an adversary role."
Vice Mayor Richard Lowenthal wrote: "I have... clearly heard [that] 1) We need to
slow down housing growth; and 2) Residents are not being heard. ... I believe you
[CCC] are better in tune with a great many residents than we are. I know we need to
improve. "
The Concerned Citizens of Cupertino have always been willing to work with the Council.
We offered in writing, a wish to work out a compromise in several letters that we
submitted to the Council. We also made the same offer orally many times during Council
meetings. We now must work together and make sure that the new Council actually does
act to promote sensible growth. There are a number of actions which would work toward
the objectives underlying initiative measures. We ask the Council to consider the
following steps:
1. Notification Whenever large, character-changing projects are being considered,
make sure that there is widespread notification, well in advance, and publicize
important facts and concerns about the issue in area newspapers.
2. Conversion and Rezonine A void converting commercial property into high-
density housing. Place more emphasis on retail development and less on housing.
Resist conversion of rental housing into for-sale condo units
3. Pass Sensible Growth Ordinances In the past, some Council Members have
indicated willingness to enact ordinances to control growth. Some of the
suggestions we have heard are: an ordinance limiting heights to 45 ft., a limit on
population increase in the city to several percent per year, and a "bedroom quota"
which would set limits on the number of new bedrooms added to the housing
stock each year.
4. Account for Chanees in Neiehborine Cities. Which Affect CUDertino.
Bordering cities such as San Jose, Sunnyvale, etc., are adding housing and
increasing population, which is likely to impact traffic and school crowding in
Cupertino. Growth at De Anza College is also going to increase traffic
congestion. Cupertino needs to take a regioual view in planning for the future and
providing inftastructure.
CCC would be pleased to work with Council toward the implementation of the steps
outlined above. Please do make some substantive changes in policy to maintain
Cupertino as a suburban community and do not allow it to become a dense urban city.

SUBJECT: Gate of Heaven Permit Application U-2005-04
Honorable Council Members:
Thank you for the opportunity to comment on the appeal submitted by Gate of Heaven
Cemetery to the Cupertino City Council. The District has worked extensively with Gate
of Heaven and City staff during the design review process and has submitted two
previous letters to the Planning Commission regarding this proposed project (dated May
25, 2005 and August 16, 2005). The District maintains its position and respectfully
requests that the City Council support and uphold the Planning Commission's unanimous
(5-0) decision on August 23, 2005 to deny the Cemetery's request to change their current
Use Permit to allow the installation of vertical gravestones.
Th" Midpeninsula Regional Open Space District (District) manages the 1 65-acre Rancho
San Antonio County Park, which borders the cemetery, as well as the 3,800-acre Rancho
San Antonio Open Space Preserve, adjacent to the cemetery. This is the most heavily
used Preserve out of the total of26 managed by the District in Santa Clara, San Mateo
and Santa Cruz Counties. This area also serves as an open space outlet to residents of the
adjacent and surrounding urbanized areas.
The initial permit for the Cemetery was granted by the County of Santa Clara before the
annexation of this area into the City of Cupertino. The County recognized that the
Cemetery is located on the urban fringe adjacent ('J extensive natural areas. The District
supported the County's subsequent Use Permit requirement for flush gravestones to
reduce the visual impacts of this use. The annexation of this property by the City has not
changed the adjacency of the Cemetery to the surrounding natural areas, and the reasons
for inset gravestones are as valid now as they were then.
Furthermore, the current permit proposal shows only anticipated development for the
next ten (10) years. Less than half of the fifty-eight (58) acres is currently in use, but
over time Gate of Heaven's long-range goal would be to develop the entire property.
Some of this undeveloped land directly borders dedicated public open space and is
clearly visible when entering and exiting the preserve. The District would hope that such

a precedent would not be set that would allow for the future installation of upright
gravestones and terraced walls in the undeveloped areas of the cemetery, which is not
covered in the current plan.

Urgent concerns regarding Gate of Heaven agenda item

Dear Cupertino City Council Members,
My name is Lori Ng and I would like to express my concern regarding Mr.
Robert Lindberg's appeal to the City Council regarding Gate of Heaven
Cemetery (GOH), which is scheduled for tomorrow night's meeting.
I attended and spoke at both the June 14th and August 23rd Planning
Commission meetings, where Mr. Lindberg presented his application. There
were numerous hotly debated issues regarding GOH's plan. I was impressed by
how many compromises were reached, how democratically the Planning
Commission handled the meetings, and how hard they worked to understand the
issues. I felt their decision was both fair and well thought out.
I had come to the meetings to voice my opposition to GOH's request for
vertical markers. My son is buried at GOH and I feel that the vertical
markers would have a drastic and negative impact on the character of the
cemetery. I also felt that Mr. Lindberg had disregarded the views of the
cemetery's patrons and I wanted to lend them a voice.
I had intended to share my story with you at tomorrow night's meeting as
well. But this evening an incendiary flyer that Mr. Lindberg distributed at
the cemetery and at a local parish over Veteran's Day weekend was brought to
my attention. In the flyer, Mr. Lindberg made statements about the Planning
Commission's prior decision that I found both inflammatory and extremely
misleading. The flyer portrays those opposing vertical markers as both
anti-Asian and anti-Veteran. Mr. Lindberg calls both of these groups to
rally at tomorrow night's meeting in support of his cause. This emotionally
charged and potentially explosive environment has made me fearful to get up
and speak.
Given that this flyer has appeared so shortly before the council meeting, I
doubt that anyone in opposition to Mr. Lindberg's appeal has had an
opportunity to prepare themselves or respond to his attacks. As a life-long
Catholic, I myself wish I had the opportunity to first address Bishop
McGrath regarding Mr. Lindberg's actions.
I hope that you may consider postponing the GOH appeal tomorrow in order to
give all involved the chance to cool down and get the facts. Those who
oppose Mr. Lindberg's appeal deserve the opportunity to respond to his
negative campaign. At the very least, I want to alert you to the
possibility of an extremely confrontational meeting.

Dear Honorable Council Members:
As representatives of the local community, we respectfully submit that it is in the best
interests of the City Council to postpone the Public Hearing for the Gate of Heaven
Catholic Cemetery's Appeal of Planning Commission Resolution 6314. As you will see
in the attached document, the Cemetery has purposely distorted the facts ITom the August
23 Planning Commission meeting, and failed to take action on a specific request of the
Planning Commission - to install the Veteran's Memorial as soon as possible. The
Veteran's Memorial installation was approved by the Planning Commission in a 5-0
decision on August 23, 2005.
This postponement will allow representatives of the local community to work together
with the Cemetery, members of the Planning Commission, and local Veteran's groups to
resolve this issue. Having the Veteran's Memorial installed prior to the next City
Council meeting will allow for a much more productive Public Hearing on the two issues
raised by the Cemetery in their appeal- Vertical Gravestones and Landscape Review.
The publication of a distortion of facts, and refusing to install the Veteran's Memorial
prior to Veteran's Day, indicates that the Cemetery is having a difficult time fmding
citizens who will come forward to support their position on the remaining two issues. In
an attempt to gain support, the Cemetery evidently chose to disenftanchise the Veteran's
community and purposely not install the Veteran's Memorial prior to Veteran's Day. By
distorting the facts, implying that the Memorial was held up by the City of Cupertino and
is somehow tied to both the Landscaping Review and Vertical Gravestones issues, they
are confusing citizens into being outraged at the City of Cupertino about an issue that was
already resolved. Postponing the City Council Public Hearing will allow accurate
information to be communicated, and ensure that future public hearings on this subject
will be more focused on the issues raised in the appeal.

Oak Valley Community Awareness
Background: Veteran's Memorial Issue has been resolved
This is the same tactic - distorting the facts and disseminating misinformation - that was
used prior to the June 14 Planning Commission Public Hearing to create panic and rage
among local Veteran's groups. As a result, the June 14 Public Hearing was chaotic and
emotional. Because of the approach used in the Public Hearing, the Cemetery was
specifically asked by the Planning Commission to meet with the local community and
resolve the issues prior to the next Public Hearing on August 23.
After the June 14 Public Hearing, representatives of the local community called meetings
and successfully negotiated 7 of the 8 open issues directly with the Cemetery, including
installation of the Veteran's Memorial. As indicated clearly in the August 23 Planning
Commission Public Hearing and documented by the Planning Commission, the Veteran's
Memorial issue was resolved. and it is not tied to either of the remaining issues.
During the August 23 meeting, the Cemetery was specifically requested by both
representatives of the local community an by the Planning Commission Chainnan to have
the Veteran's Memorial installed as soon as possible, preferably long before Veteran's
Day. To quote from the Planning Commission minutes of the August 23 meeting:
Chair Wong:
· Regarding the veterans memorial, can they go ahead and implement it immediately?
Mr. Piasecki:
· With this approval they can; but they would have to come back to you with the landscape
plan that you asked for first.
Chair Wong:
· How can we make it so that they can implement the veterans' memorial.
Mr. Piasecki:
· You would change COndition 4 that says "a detailed landscape plan shall be approved by
the Planning COmmission prior to implementation of the use permif' and state ''with the
exception of the veterans' memorial which can be installed along with the adjacent
landscaping," subject to my review and approval, and I will do it at the building permit stage.
To accomplish this, the memorial was specifically excluded ITom the landscaping plan
review. Here is the relevant text ITom Planning Commission Resolution 6314:
4. LANDSCAPE PLAN
A detailed landscape plan shall be approved by the Planning Commission prior
to implementation of the use permit, with the exception of the Veterans'
memorial, which can be installed with landscaping subject to the Director of
Community Development. The detailed landscape plan shall include landscaping
for the new niche feature and trellis in the veterans' section.

GATE OF HEAVEN CATHOLIC CEMETERY
A Veterans' Memorial was erected in the cemetery to honor the men and women who served in
our armed forces and MIA's for Memorial Day '05. Alter Ins that two weelll. It was removed

the City of Cupertino that the Memorial and the AmerICan flag went unsightly and would
bring clown their property va...... Included in their complaint were the proposed use of upright
markers and a proposed cross.
The Cupertino City Planning Commission held two meetings that resulted in the Commission
approving the Memorial, the flag, and the cross but disapproving the upright markers. At the
same time the Planning Commission imposed a requirement the oemetery submit a detailed
landscape plan requiring pre-approvaI by the commission before the nl8mOlial could be re-
erected. Without appearing to be unpabiotic or insensitive to the cultural diversity in our
community, the city appeared to give with one hand while at the same time it took away with the
other hand.
The Planning Commlnton by requiring that -a detailed landscape plan ,hall be approved
by the Planning Commission prior to Implementation of the .... pemdt.- - found a way to
prevent the Veterans' Memorial from ever being re-erected without appearing to be
unpatriotic .. In shott this requirement can indefinitely prevent the Catholic Cemetery from
re..recting the Memorial while the Planning Commission "haggles" over the color and
location of a roM bush or removal of a dead t.... Tbe ...trictionS are unnec....ry.

What has happened to the sepanltion of church and .... guaranteed by our constitution?
Gate of Heaven is a private Catholic Cemetery that should not be mlcro-managed by the
City of Cupertino Planning Commission or any other cIvtc body.
What is occurring is a disgrace and dishonor to the men and women buried in the veterans'
Section and to the sacrifices they made for their coun!ry. It is an affront to their families. We
cannot understand hoW the community and the City of Cupertino has turned its back on the men
and women who served their country SO that we can enjoy the freedomS we have today and hope
to have tomorrow.
We are requesting approval of the upright markers. The upright markers are culturally significant
In honoring the loved ones of many members of the Asian Community seM!d by the cemetery.
The City of Cupertino's insensitivity to and ignorance of the cultural needs of the Asian
community that it serves and which comprises such a significant percentage of its population is
appalling.

Dear Mayor Kwok and Councilmembers:
The Silicon Valley Association of Realtors represents over 3,800 real estate professionals
in the South Bay and Peninsula. We would like to comment on the proposed Pruneridge
development.
The project proposes to convert 127,000 square feet of functionally obsolete office space
and build 130 for sale townhomes and flats and a one-acre park on the site. The current
office buildings have been vacant for many years and are no longer marketable.
Furthermore, given the surplus of commercial office space available in Santa Clara
County it seems unlikely that this parcel can be redeveloped into newer class A
commercial office space anytime soon. There is, however, a shortage of residential
development and this proposal will provide much needed housing for Cupertino.
As a matter of policy, our association normally rerrains rrom endorsing or lending
support to individual development projects, but given the unique opportunity the
Pruneridge project provides to encourage well-designed, residential development, we felt
compelled to act. The project is in-line with the principles of the general plan, which
already allows for residential uses in this area. As the surrounding neighborhood is
already residential, the construction of housing would make the site more congruent with
the surrounding community. Furthermore, the project is an example of smart growth
principles that recommend locating housing near major transit corridors; it will also
implement green building principles and provide 20 below market rate homes spread
throughout the project.
We understand the concerns about the potential loss of commercial or industrial office
space as a result of this development, however we feel they are unwarranted. In addition
to the surplus of available office space in Santa Clara County, there are 8,325,312 total
square feet of office space in Cupertino and the Pruneridge project would represent only
1.5 percent oftotal inventory in the city. Any loss of commercial office square footage as
a result of this project can be placed into a pool and be reallocated in another area where
it can be redeveloped to best meet the future needs of the growing business community.
The pooling system is an effective economic development tool that many other cities

have used to properly configure their office needs to conform to changing trends in the
market.
Given these advantages and the groundspring of support by members of the surrounding
community and the general public for this type of high-quality, low impact housing, we
encourage you to approve the negative declaration for this project. Thank you for the

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
REZONING OF A 8.96 GROSS ACRE PARCEL FROM PLANNED INDUSTRIAL
PARK ZONE, P(MP), TO PLANNED RESIDENTIAL, P(RES), AND PUBLIC PARK, PRo
LOCATED AT 19310-19320 PRUNERIDGE AVENUE
WHEREAS, an application was received by the City (Application no. Z-2005-02) for the
rezoning of a property to Planned Residential, P(RES) and Public Park (PR); and
WHEREAS, the rezoning will be consistent with the City's General Plan land use map,
proposed uses and surrounding uses; and
WHEREAS, upon due notice and after one public hearing the Planning Commission
recommended denial of the rezoning, deferring the decision to the City Council; and
WHEREAS, a map and legal description of the subject property is attached hereto as
Exhibit A and Exhibit B, as a proposed amendment to the Master Zoning Map of the City of
Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described in attached Exhibit A and B is hereby rezoned to
Planned Residential, P(RES), and Public Park (PR); and that Exhibit A and B attached hereto is
made part of the Master Zoning Map of the City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty (30) days after its
passage.
