Mayor Paul and Councilmembers:
Please accept this note as a reiteration of my comments from April 20, 2021‐‐both oral and written‐‐on Ordinance No.
21‐2226. I encourage council to reconsider enactment of this Ordinance, and to seek technical guidance from the
California Department of Housing and Community Development (HCD) before proceeding in order to ensure that
Cupertino's density bonus regime is consistent with state law and the goal of incentivizing affordable housing
development as HCD interprets that term.

Dear City Council:
The public had no control over the high density housing bills
that are being pushed down from the state. These laws
take away public rights to privacy from neighbors becuase ADUS
are 4 feet from all neighbor houses. So we need to make anything
4 feet from the neighbors does not fill the neighbors yards with
smoke. You can get second hand smoke from people in your own
home and if you are stuck up against a four foot distance from
the neighbors J ADus or ADUS, that neighbors is a prisinor
in their own back yard or side yard or bedroom window and
the neighbor is smoking four feet from their property line.
Second hand smoke is second hand smoke where ever
you get it,

J Adus should be subject to the smoking ordinance. J ADus and ADUs
can be 4 feet from all neighbors and 2nd hand smoke can cause
cancer in the neighborbords too.

Through this letter, we would like to express our concern regarding the proposed Athletic Field Use Policy and fee
structure.
Here are our concerns:

2. Please allow more Sundays
3. for permitted use. Allowing just 2 more Sundays (in addition to 2 Sundays for Tournaments) is too little for our
needs.

6. Please allow pick‐up games
7. for youth on Sundays when the field is not booked for permitted use. Youth need to be engaged in healthy
outdoor activities and prohibiting pick‐up games will force them to stay indoors.

11. permitted Sunday use in place of proposed 10 AM to 2 PM time. Some of our games last longer than 4 hours.
Moreover, longer use time will enable us to accommodate more than one game in the allowed time.

15. as the proposed fee structure will put a huge financial burden on resident non‐profit organizations that use the
fields.

We request the Cupertino City Council to please review the proposed policy in light of the concerns listed above and
come up with a mutually agreeable policy that will be conducive to engaging youth in healthy outdoor activities
