SUBJECT AND ISSUE
Adoption of Resolution No. 06- 0 '2L{ , Ordering street name change within the City of Cupertino,
pursuant to Section 5026 of the Streets and Highways Code, State of California, Stella Road and
Paloma Road both to Balboa Road.
BACKGROUND
The Santa Clara County Fire Department, which provides fire suppression and other emergency
seryices in the City of Cupertino, requested that the entire roadway, which is a private drive, indicated
on the attached map be named Balboa Road. The Fire Department has indicated that doing so will aid
in the delivery of emergency seryices by eliminating the confusion inherent in having several street
names along one length of roadway.
A portion of the road, which is being constructed as part of a single family dwelling building permit on
APN 342-31-01, is currently named Balboa Road. However, in order for the total length of the new
roadway in its entirety to have the name Balboa Road, two sections of roadway along the road, Paloma
Road and Stella Road, must be changed to Balboa Road. Those sections of roadway are shown on the
attached map. The portion of the Paloma Road right of way ending in a cul-de-sac, which is southeast
of the road under construction as part of a single family dwelling building permit on APN 342-31-01,
will continue to be called Paloma Road.
On January 3, 2006, Council adopted Resolution 06-006, declaring the Council's intention to change
the street names of Stella Road and a portion of Paloma Road to Balboa Road, pursuant to Section
5026 of the Streets and Highways Code, State of California, and setting a public hearing for to
consider changing said street names. Adoption of the current resolution will complete the name
change process by ordering the street name change.

The City of Cupertino shall specify whether these submittals shall contain multiple
street names. The fire department's contention is that there should be o~ a

2 The applicant shall provide a copy of the City of Cupertino Roadway Agreement
to this department for inclusion to file. The agreement shall reflect requirements
for roadway width becoming 20' in overall width once three home sites are served
by it with all appropriate dimensions identified and timing of all such roadway
improvement requirements.

3 Certain portions of the roadway reflect degrees of slope in excess of this
department's standards & details A-I artd D-l. Mitigation measures have already
been discussed with Terry Brown Construction. At time of building permit or
other planning review, all such mitigation shall be identified by this department.
4 No construction on the proposed home site shall commence prior to the
completion of the roadway installation through at least the first lift of asphalt.

5 The applicant shall reflect compliance with this department's standards and details

home site. Prior to building permit submittal, please identify whether the
centerpiece at the main entryway is drivable or not and that all turnaround

1 The notation of street name and aqdress continues to be a concern for this

2 The fire hydrant piping shall not run through the domestic pressure booster pump
pad components. The supply piping for the fire hydrant shall be solely dedicated
to the fire hydrant without running through other devices. The applicant shall
please note that the hydrant shall receive water via gravity fall to the hydrant.
Insure that the tank pad and hydrant location elevations are consistent with this
concept. It would appear that the tank pad and hydrant location is equal in
elevation. There shall be a percentage fall to the hydrant. Please reflect in a
revised site plan submittal.
It is suggested that considering the planting scheme, and driveway plan past the
fire department turnaround, the fire hydrant would be best located closer to the
fire department turn-around than is currently proposed.
3 As a reminder to the applicant, the entire structure shall be provided with an
approved, residential fire sprinkler system complying with NFP A 13d and our
Standard, Detail and Specification SP-4. A pressure pump system shall be required
as the project is supplied by storage tanks. A 4-head hydraulic calculation shall be
required. Please note that the attic shallJikewise be provided with fire sprinklers
in areas of storage or where HV AC system components are housed.
All previous conditions are still in effect.
Approved for building permit subject to compliance with the above noted
conditions prior to final inspection.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ORDERING STREET NAME CHANGE WITHIN THE CITY OF CUPERTINO
PURSUANT TO SECTION 5026 OF THE STREETS AND HIGHWAYS CODE,
STATE OF CALIFORNIA; CHANGE A PORTION OF STELLA ROAD AND A
PORTION OF PALOMA ROAD TO BALBOA ROAD
WHEREAS, hearing on Resolution of Intention No. 06-006 was held on January
17, 2006, at a regular meeting of the City Council at 10350 Torre Avenue, Cupertino,
California;
WHEREAS, it appears that notice thereof was duly given as required by law; and
WHEREAS, from the evidence presented, both oral and documentary, it appears
to be in the best interests of the City to change the street name of a portion of Stella Road
and a portion of Paloma Road to Balboa Road.
NOW, THEREFORE, BE IT RESOLVED:
I. That any and all protests against said name change be and hereby are
overruled and denied.
2. That the name of portion of Stella Road and a portion of Paloma Road, in
Exhibit "A" attached hereto and made part hereof, is hereby changed to Balboa Road.
BE IT FURTHER RESOLVED:
That the City Clerk be and hereby is instructed and directed to cause a certified
copy of this resolution, attested to and sealed with the official seal of the City, to be
recorded with the County Recorder of the County of Santa Clara, California, forthwith.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 17th day of January, 2006, by the following vote:
