LRC 08-10-2020 (Special)Legislative Review Committee Approved Minutes August 10, 2020 CITY OF CUPERTINO APPROVED MINUTES LEGISLATIVE REVIEW COMMITTEE This will be a teleconference meeting without a physical location Monday, August 10, 2020 8:00 AM SPECIAL MEETING ROLL CALL The meeting was called to order at 8:20 a.m. Present: Mayor Scharf, Councilmember Chao, City Manager Deborah Feng, Assistant to the City Manager Katy Nomura, Townsend Public Affairs (TPA) APPROVAL OF MINUTES 1. Subject: Minutes from July 24, 2020 Recommended Action: Approve minutes from July 24, 2020 The Mayor motioned to approve the July 24th Legislative Review Committee minutes. Councilmember Chao seconds. The motion carries unanimously. POSTPONEMENTS None ORAL COMMUNICATIONS Jennifer Griffin is concerned about the housing bills. PUBLIC COMMENT (including comments on all agenda items) This item was not conducted as the Chair decided to take public comments on agenda items when the agenda items were discussed. AGENDA REVIEW This item was not conducted ACTION ITEMS 2. Subject: Legislative Update Recommended Action: Receive legislative update and provide any input Legislative Review Committee Approved Minutes August 10, 2020 TPA explains that the legislature came back into session during the last week of July. The entire second half of the legislative process has been condensed into 5 weeks. The policy committee deadline is on August 15th and next week is the appropriations committee deadline. The adjournment date will be on August 31st. There may be some additional special sessions but only if the Governor calls the legislature into session to speak on specific issues (i.e. budget, COVID-19, etc.). The City has taken an oppose position to AB 1279 (Bloom), which was pulled and is no longer coming back. The City took a support position on AB 1063 (Petrie-Norris), which was not heard and will not be moving forward this year. On Friday, the Assembly Public Safety Committee met and passed many of the bills related to police reform and social justice, and are now up for consideration in the Appropriations Committee. SB 902 is in the Assembly Local Government Committee this week and will be heard tomorrow. Public Comment: Jennifer Griffin is concerned about SB 902. 3. Subject: Update on positions taken by the League of California Cities (League) and the Cities Association of Santa Clara County (CASCC) Recommended Action: Receive update on positions taken by the League and CASCC and provide input TPA has provided an updated Matrix but the CASCC has not taken any new positions at this time. The League took a support if amended position on SB 1120. 4. Subject: Consider adopting a position on Assembly Bill 1436 Tenancy: rental payment default: mortgage forbearance: state of emergency: COVID-19 Recommended Action: Adopt a watch position on AB 1436 and authorize the Mayor to send letters to the state legislature TPA explains that this bill works to protect renters from eviction and unpaid rent penalties and extends the protections until April 1, 2021. However, this bill has been gutted and amended so we cannot know how the final bill will look, which is why it is recommended that the LRC take a watch position on this bill. This bill can be further discussed once the final language is presented. Action Taken: The Mayor made a motion to take a watch position. Councilmember Chao seconded. The motion carried unanimously. Legislative Review Committee Approved Minutes August 10, 2020 5. Subject: Consider adopting a position on Assembly Bill 2345 Planning and zoning: density bonuses: annual report: affordable housing Recommended Action: Adopt an oppose position on AB 2345 and authorize the Mayor to send letters to the state legislature This bill is working to increase the density bonuses and concessions available for low- income and moderate-income households. This bill is very similar to SB 1085, which the LRC has previously opposed, which is why it is recommended for the LRC to take an oppose position on AB 2345. Public Comment: Jennifer Griffin is very concerned about this bill and wants the LRC to vote no on this bill. Action Taken: The Mayor made a motion to adopt an oppose position on AB 2345 and authorize the Mayor to send letters to the state legislature. Councilmember Chao seconded. The motion carried unanimously 6. Subject: Consider adopting a position on Assembly Bill 3040 Local planning: regional housing need assessment. Recommended Action: Adopt a support position on AB 3040 and authorize the Mayor to send letters to the state legislature This bill would provide cities with additional credit for meeting their RHNA allocation. The city or county would receive 1 credit towards their RHNA allocation for every 10 sites that are included in the RHNA inventory. This zoning credit is optional and there are no requirements for any city to participate. Based on the City’s Legislative Platform, this bill falls under the City’s desire to support legislation that would provide incentives for items under the City’s control through the RHNA process, it is recommended that the LRC take a support position on this bill. The LRC agrees to support this bill based on the fact that it is purely voluntary. Public Comment: Jennifer Griffin is concerned about this bill and the author. Action Taken: The Mayor made a motion to adopt a support position on AB 3040 and authorize the Mayor to send letters to the state legislature. Councilmember Chao seconded. The motion carried unanimously. Legislative Review Committee Approved Minutes August 10, 2020 7. Subject: Consider adopting a position on Assembly Bill 3107 Planning and zoning: commercial zoning: housing development. Recommended Action: Adopt an oppose position on AB 3107 and authorize the Mayor to send letters to the state legislature This bill deals with housing on commercially zoned land. This bill was set to be heard in Senate housing committee last week, but it was pulled by the author. This bill will not be moving forward this year. Public Comment: Jennifer Griffin is glad to see that this bill will not be moving forward. FUTURE AGENDA SETTING The Mayor would like to discuss a ballot proposition for 2022 regarding local control at the next meeting. TPA explained that the next meeting will also include an evaluation of City position letters and letters to send to the Governor’s office. Public Comment: Jennifer Griffin is concerned about coronavirus and high-density housing. The next meeting is scheduled for September 2nd at 8:00 a.m. ADJOURNMENT The meeting was adjourned at 9:15 a.m.
