Subject: Revised - CM Services Extension Proposal for 2017-15 McClellan Ranch Preserve
Community Garden Improvements
Dear Mr. Alex Acenas:
In our discussion on 12/9/20, we reviewed Gilbane’s CM services extension proposal dated 12/1/20. As an
outcome of the discussion, you had requested that we submit a revised proposal for continuing CM
Services through the revised contractor completion date of March 16, 2021. Subsequently, the contractor
submitted its updated schedule on 12/11/20. The revised proposal takes into consideration your request
and the contractor’s updated schedule as indicated below.
Proposed scope:
The contractor, GradeTech, Inc., has submitted its updated schedule that identifies days where no
construction activities are planned (December 19, 2020 through January 10, 2021) and identifies
substantial completion on February 19, 2021. Based upon these refinements to the schedule, we propose
to suspend services during the no ‘construction activities period’ and end Task 3 services on the
substantial completion date identified. During the balance of the time to substantial completion, we
would continue to provide Task 3 services in order to support the City in successfully completing the
project with the contractor. Our proposed scope remains unchanged from the original Service Order #5.
Proposed fee:
For the subject extension period, Task 3 management services are based upon the following
assumptions: Substantial Completion achieved by February 19, 2021, no work from December 19, 2020
through January 10, 2021, no night-time or weekend work required, and up to one half- time
management commitment.
During its delivery on Task 4 (testing and inspection services), Ninyo & Moore incurred additional costs
for their services related to compaction and concrete testing. In prior discussions, we had agreed to
delete their remaining scope related to concrete testing for fence footings as this work is not affiliated
with Building Department documentation requirements.
The proposed compensation is based upon the above scope of services for a lump sum not to exceed
cost of Forty-Six Thousand Seven Hundred Twenty-Eight Dollars ($46,728.00) for extended Task 3
services and One Thousand Four Hundred Seventy-Four Dollars ($1,474.00) for Task 4 services with total
additional compensation of Forty-Eight Thousand Two Hundred Two Dollars ($48,202.00).
