Citywide Policy Manual Policy # Small Unmanned Attachments: Aircraft System (sUAS) Operations Policy Effective Date: Responsible Department: InnovationTechnology Related Policies & Notes: FAA 14CFRPart107(Part107) CaliforniaCivilCode1708.8 /»¸¶µ¹« Thepurposeofthispolicyistoestablishguidelinesfortheuseofasmallunmannedaerial system(sUAS)forCityofCupertinoservicesandforthestorage,retrievalanddisseminationof imagesanddatacapturedbythesUAS. #«¬¯´¯º¯µ´¹ AsprovidedbytheFAA,definitionsrelatedtothispolicyinclude: Unmannedaircraftanaircraftoperatedwithoutthepossibilityofdirecthumanintervention fromwithinorontheaircraft. Smallunmannedaircraftanunmannedaircraftweighinglessthan55poundsontakeoff, includingeverythingthatisonboardorotherwiseattachedtotheaircraft. SmallunmannedaircraftsystemȘȠ¹³§²²4 2ȡorȠ¹4 2ȡșasmallunmannedaircraftandits associatedelements(includingcommunicationlinksandthecomponentsthatcontrolthesmall unmannedaircraft)thatarerequiredforthesafeandefficientoperationofthesmallunmanned aircraftinthenationalairspacesystem. /µ²¯©¿ Withintheparametersofthe¶»¨²¯©ȟ¹privacyinterestsetforthbelow,SmallUnmannedaircraft systemsmaybeutilizedtoenhancethe"¯º¿ȟ¹missiontoprovideexceptionalserviceincluding providingpublicservicesandprotectinglivesandpropertywhenothermeansandresourcesare notavailableorarelesseffective. The"¯º¿ȟ¹sUASprogramwilloperateunder14CFRPart107(Part107),whichare theFAArulesforsmallunmannedaircraftsystems,orȠª¸µ´«ȍȡoperationscoveringabroad spectrumofcommercial,andgovernmentusesfordronesweighinglessthan55pounds.When amissionrequiresoperatingadronecontrarytoPart107rules,anFAAwaivermustbe . requested AnyuseofansUASwillbeinstrictaccordancewithconstitutionalandprivacyrights,California dronelaws,andanylocalrulesorordinances. Privacy: TheuseofthesUASinvolvesprivacyconsiderations.Absentacourtorderorexigent circumstances,operatorsandobserversshallnotintentionallyrecordortransmitimagesofany locationwhereapersonwouldhaveareasonableexpectationofprivacy.Operatorsand observersshalltakereasonableprecautionstoavoidinadvertentlyrecordingortransmitting imagesofareaswherethereisareasonableexpectationofprivacy.Reasonableprecautionscan include,butarenotlimitedto,deactivatingorturningimagingdevicesawayfromsuchareasor personsduringsUASoperations.Alloperationsshallbestrictlywithinthelawandregulations pertainingtosUAS.Wheneverrequiredbypolicyorlaw,operatorswillensurethatthe necessarypermitsorapprovalsareobtainedpriortodeployingthesUAS.Intheeventofan inadvertentrecordinginviolationoftheforegoing,Cityshall,assoonaspossible,destroyany suchrecording. RequiredTraining: ToobtainalevelofproficiencyandunderstandingtooperatethesUASsafelyandwithinthe requirementstomaintainpublicconfidence,alloperatorsshallcompletethefollowingtraining: INITIALTRAINING ¤ AcquireanFAAPart107RemotePilotCertificate. ¤ Cityapprovedtrainingcoveringprogrampolicies,authorizations,andrestrictions. ¤ FourhoursofflighttrainingwithUASinstructors. RECURRINGTRAINING ¤ MaintaincurrentPart107RemotePilotCertificate ¤ AnnualreviewofCityapprovedtrainingcoveringprogrampolicies, authorizations,andrestrictions. ¤ Documentedflighttimeviaregularmissionsorexercisesforatleastone(1)hour everysix(6)months. ProgramCoordinator: TheDirectorofInnovationandTechnologywillappointaprogramcoordinatorwhowillbe responsibleforthemanagementofthesUASprogram.Theprogramcoordinatorwillensurethat policiesandproceduresconformtocurrentlaws,regulationsandbestpracticesandwillhavethe followingadditionalresponsibilities: CoordinatingtheFAACertificateofWaiverorAuthorization(COA)application ¤ process andensuringthattheCOAiscurrent. ¤ Stayinguptodatewithfederal,state,andlocallawsandregulations,including thoserelatedtoprivacy ¤ DevelopingCityapprovedtrainingcoveringprogrampolicies,authorizations,and restrictions. Ensuringthatallauthorizedoperatorsandrequiredobservershavecompletedall ¤ requiredFAAanddepartmentapprovedtrainingintheoperation,applicablelaws, policies,andproceduresregardinguseofthesUAS. Developinguniformprotocolforsubmissionandevaluationofrequeststodeploy ¤ asUAS,includingurgentrequestsmadeduringongoingoremergingincidents. Developinganoperationalprotocolgoverningthedeploymentandoperationofan ¤ sUAS including,butnotlimitedto,safetyoversight,useofvisualobservers,flight hazardidentification,establishmentoflostlinkproceduresandcommunication withairtrafficcontrolfacilities. ¤ CommunicatingchangestosUASprogramandpolicytoalloperators. ImplementingasystemforpublicnotificationofsUASdeployments ¤ . Developingaprotocolforfullydocumentingallflights. ¤ DevelopingasUASinspection,maintenance,andrecordkeepingprotocolto ¤ ensure continuingairworthinessofaUAS,uptoandincludingitsoverhaulorlife limits. Developingprotocolsthatensureretentionandpurgeperiodsaremaintainedin ¤ accordancewithestablishedrecordsretentionschedules. Facilitatingpublicrecordsrequestincludinglawenforcementaccesstoimagesand ¤ datacapturedbytheUAS. Recommendingprogramenhancements,particularlyregardingsafetyand ¤ information security. Ensuringthatestablishedprotocolsarefollowedbymonitoringandproviding ¤ periodic reportsontheprogramtotheDirectorofInnovationandTechnology. UseofsUAS: Onlyauthorizedoperatorswhohavecompletedtherequiredtrainingshallbepermittedto operatethesUAS. Useofvisionenhancementtechnology(e.g.,thermal,andotherimagingequipmentnot generallyavailabletothepublic)ispermissibleonlywherethereisnoprotectableprivacy interestorwhenincompliancewithexigentcircumstances,orcourtorder.Inallotherinstances, legalcounselshouldbeconsulted. sUASoperationsmustcomplywithFAAregulations. PreauthorizedusesforsUASare: ¤ SupportingPublicServices(TreeTrimming,CityBuildingSurveys,Utility Assessments) ¤ SearchandRescueMissions ¤ DisasterResponse(Earthquake,Flood,Wildfire) ¤ DisasterPreparedness(PreDisasterAssessment) ¤ TrainingFlightsasRequiredtoMeetFAACertificationsandanyInternalTraining Requirements ProhibitedUse: ThesUASequipmentshallnotbeused: Toconductrandomsurveillanceactivities. ¤ Toharass,intimidateordiscriminateagainstanyindividualorgroup. ¤ Toconductpersonalbusinessofanytype. ¤ ThesUASshallnotbeweaponized. Registration: AllsUASoperatedbytheCitymustberegisteredwiththeFAA RetentionofsUASData: DatacollectedbythesUASshallberetainedasprovidedinthe"¯º¿ȟ¹establishedrecords retentionschedule. MissionsonbehalfoftheCityofCupertinomustbelogged.Informationthatmustbe documentedincludepilot,crewmembers,descriptionofmission,date,andsUASflown.This logshallberetainedasprovidedinthe"¯º¿ȟ¹establishedrecordsretentionschedule.
