WHEPFAS, hearing on Resolution of Intention No. 7889 was held on
August 21, 1989, at a regular meeting of the City Council of the City of
Cupertino, California; and
VEDM S, it appears that notice thereof was duly given as required by
law; and
MMEMM, frram the evidence presented both oral and do=nentary, it
appears to be to the best interest of the City to vacate the hereinafter
described portion of slope easement; that said portion of said easement is
unnecessary for present or prospective public purposes; and
1. That all or any protests against the vacation of said portion of
slope easement be and hereby are overruled and denied.
2. That that certain portion of slope easement described and shown in
EXhibit "A" and "B" attached hereto and made part hereof, be and hereby is
vacated.
That the City Clerk be and hereby is instructed and directed to cause
a certified copy of this resolution, attested to and sealed with the
official seal of the City, to be recorded with the County Recorder of the
County of Santa Clara, California, forthwith.

All that certain real property situate in the City of Cupertino, County of
Santa Clara, State of California and being a portion of Lot 8, as shown on
that certain map entitled "Tract No. 6401" recorded in Book 449 of Maps at
Pages 4 - 8, Santa Clara County Records and being more particularly
described as follows:
Commencing at the most southwesterly corner of said Lot 8, as shown on the
map above referred to;
Thence along the southerly line of said lot, North 88017'48" East. 88.on
feet to the intersection of said southerly line with the slope easement
line of said lot;
Thence along said slope easement line, North 11035'29" West, 110.64 feet;
Thence continuing along said line, North 40°34'13" East, 65.33 feet to a
point established as being the "True Point of Beginning" for a slope
easement abandonment described in Resolution No. 5571, recorded in Book
F961 of Official Records at Page 556, Santa Clara County Records, said
point also being the True Point of Beginning for this description;
Thence along the sbope easement line, as established by said recorded

Thence continuing along said line, South 73053'11" East, 40.24 feet to a
point on the slope easement line, as shown on the map above referred to;
Thence along said slope easement line, South 18031'29" East, 6.92 feet;
Thence North 88017'48" East, 60.00 feet;
Thence North 54033'00" East, 86.92 feet: to a point on the easterly line of
Lot 8, as shown on the map above referred to;
