Subject: Comments on Carmen Road Bridge Project for Cupertino City Council Meeting

Please read my comments at the Tuesday, April 5 Cupertino City
Council meeting.

Dear Mayor Paul and Members of the Council,
I, along with the majority of my fellow neighbors on the 10000 Carmen Road block leading
to the Carmen Rd Bridge, write to express our strong opposition to the proposed Carmen
Road Bridge project.
Here are a few reasons why we oppose this bridge:
1. The city has not determined where the east side of Carmen Road will be connected. As
of now, the bridge would continue through portions of city property and private property
which could invoke eminent domain. Alternatively the bridge will end up on the east side
with a long set of stairs so bikers will need to get off their bikes and carry it down the stairs.
2. Staff has not polled the elementary school parents in the neighborhood to see if they
would even use the bridge to walk their kids to Steven’s Creek Elementary school under the
Safe School Route. Parents mostly likely feel it i s not a safe pathway to ride or walk to
school by themselves.
3. With the declining school enrollments, there will be less students going to Stevens Creek
Elementary Schools and less of a reason to use the bridge by the time the bridge is
completed. If the declining enrollment continues, Stevens Creek Elementary School could be
one of the schools to be closed.
4. Our neighbors enjoy walking along Carmen Road since it dead ends and we feel safe
walking on the wide road. I've seen children playing in this area since it is a dead
end. Adding the bridge will narrow the road and there will be increased traffic both from
cars and bikes on this road. This will make it unsafe for children to play.
5. At least 8 residents on Carmen Road will see beautiful trees, including several mature oak
and redwood trees, removed to make room for the bike path. Additionally, the front yards
of their houses and side walks that might encroach into city property will have to be
removed for the bike route. This will greatly diminish their curb appeal with a bike path in
front of their houses.
6. The residents living on Carmen Road who will be significantly impacted by the project
have not received a Notice of Public Hearing on this agenda item. As a result, they will not
have the opportunity to submit their comments.
Before the council makes their decision, I respectfully ask you to consider these questions:
1. What is the cost benefit to the Cupertino residents on this project?
2. How many Cupertino residents will truly benefit from this project?
3. Shouldn't public funds be allocated to other park projects that could benefit a wider range
of Cupertino residents?
4. Why haven't staff surveyed the neighbors on a project that will directly impact them?
5. What will the east side of the bridge look like?
Please consider all these issues before you prioritize this project.

I am Louise Saadati, one of the main DOLA Leaders in our DOLA Leadership and community
that now represent over 300 dogs, 500 people, and 6 different dog groups..
NO new DOLAs have been started since 2019.
Staff comment of “an additional year of Jollyman DOLA observation by the City to occur
BEFORE more DOLA trials can start” is
●NOT NEEDED
●NEVER DISCUSSED NOR RECOMMENDED with the Jollyman DOLA
leadership in the over 16 meetings we had with City staff, Commission, nor with
former the Interim City Manager
Jollyman DOLA has been observed since October 2019;its extensive 3 year trial was a
success and it is now successfully on-going.
Instead of observing Jollyman DOLA for an additional year,these same city resources would
be much more effectively used instead:
●to issue notifications to pertinent surrounding park areas
●observe the relevant parks,
●and to actually start more DOLA trials.
We in the DOLA community have already organized, prepared and are operating our dog
groups in readiness for our proposed four trial DOLAs.They are all modeled after the
successful Jollyman DOLA.We are ready to start trials on them with the city in the following
order:

In the last city council meeting, a question of whether fencing is needed was asked. The
current Jollyman DOLA did not need fencing and it has been successful.
Linda Vista Park field:
●is rarely used by the community and does not require any fencing.
●It has NO adjoining athletic field so it’s trial can be concluded in 6 months, as
DOLA trials were originally conceived and discussed in 2018
Quinlan Knoll DOLA could begin with or without fencing.
●It has a little used dead end small street next to it. Our proposed DOLAs have volunteer
DOLA “sheriffs” who besides the owner will insure that the dogs stay within the
boundaries.
●Quinlan Knoll also has no adjacent athletic field, so its trial can be concluded in 6
months also.
Currently, there is no DOLA that serves the needs of little dogs nor delicate dogs.
JM DOLA has large athletic, very active hunting, herding and defense dogs who appropriately
running and playing can inadvertently hurt little or delicate dogs.
With the DOLA Community’s help, the city staff involvement was only 15% of the work
needed to start and regulate Jollyman DOLA.
●Jollyman DOLA Community collected 145 data entries before Jollyman DOLA trial
ended sucessfully. The city only collected only about 40 entries at the same time.
●The ongoing Jollyman DOLA data collection has now grown to 343 data entries
documenting its ongoing success.
City staff has now designated more DOLAs as a Large Project for FY22-23.Previously
DOLAs from 2019-2021 were designated a Small Project.
Previously, city staff kept:
●delaying start of city DOLA data collection for two years
●then changed its survey to include another full year for adjoining athletic field and
●then changed its survey to include the entire park for another full year though the
DOLA only occupied only 10% of the park
Instead of the above, City staff can GIVE A SMALL PROJECT DESIGNATION to more
DOLAs by:
●planning to use our DOLA community’s dedicated and organized assistance.
●use our already operating preDOLA dog groups as outlined above in DOLA trials
●use our “leadership and sheriff” system that reinforces compliance with all City
DOLA policies
Our DOLA a community is ready to assist the city in completing each trial with efficient
use of limited city staff time in 6 months INSTEAD OF THREE YEARS!
If city staff would accept help from the DOLA leadership and community:
●It will take this SMALL PROJECT into an efficiently ACHIEVED STATUS.
●This small project can be an efficient success!
More DOLAs can then be in ongoing operational mode and NOT take up the Council’s valuable
and limited time.
Please vote to give a high priority above 5 to more DOLAs!

WAIVER, RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE
I, to whom an Exclusive Use Permit has been granted (hereinafter, “Permitee”), shall hold harmless and indemnify the City of Cupertino, its city
council, employees, agents, servants, and volunteers against any and all liability, claims, losses, damages or expenses arising from the event or
activities of Permitee, its ofcers, agents or employees; excluding, however, such liability, claims, losses, damages or expenses arising from the City’s
sole negligence or willful acts. Permitee shall be liable to the City for any and all damages to parks , facilities, and buildings owned by the City arising
from the activities of Permitee or any participant in said activity .
I understand that I am renting and using the City property in its current condition, I have had an opportunity to inspect the property, and there have
been no representations of the construction, condition, or safety of the property. In consideration of acceptance of my application for rental of property,
I hereby RELEASE, DISCHARGE, AND AGREE NOT TO SUE the City of Cupertino, the City Council, ofcials, ofcers, agents, employees, or
volunteers (collectively, “City”) to the fullest extent legally possible from any injury, death, or damage or loss to personal property arising out of, or in
connection with, my rental of the property from whatever cause, including the active or passive negligence of City or any other participants in the
activity. I understand that City does not guarantee the construction, condition, or safety of the facilities where the activity is taking place.
In consideration for being permited for the rental of property, I hereby agree, for myself, my heirs, administrators, executors, and assigns, that I shall
indemnify and hold harmless the City of Cupertino, the City Council, ofcials, ofcers, agents, employees, or volunteers (collectively, “City”) from any
and all claims, demands, actions or suits arising out of or in connection with my participation in the activity or rental of the property.
I have carefully read this agreement and fully understand its contents. I am aware that it is a full release of all liability and sign it on my own free
will.
Cancellation of reservation must be made at least 30 calendar days prior to your reservation date in order
for your rental fees to be refunded.
I hereby agree to provide a certificate of commercial general liability insurance with the City of Cupertino
listed as an additional insured in the amount of $1,000,000 per occurrence if required.
I, the undersigned, hereby agree to be present for the entirety of my event. I agree to be present for both
a pre-event inspection and a post-event inspection of the rental facility and understand that my
signature will be required on any inspection reports.
Functions exceeding the permitted reservation time shall be charged 1.5 times the associated hourly fee for
anytime to the first half hour and 1.5 times the associated fee for every half hour there after.

Revised Objective: Standardize the process to create DOLA trial programs, with no more than
two trials running at a time. Respond and evaluate community-driven DOLA proposals to
implement additional DOLAs throughout the City.
• One-two new trials on locations should start as soon as feasible, since the trial at
Jollyman Park has ended in October 2021. Each trial should last 6 months unless the
site is adjacent to an athletic field or playground or there are other considerations.
• A task force (including two Parks Rec Commissioners and DOLA champions) is created
to help with the rule setting and moderation in order to facilitate the standardized
process
Justification/Consideration:Trial ended October 2021. The ongoing program is to be observed
for one year before another such area can be established..

#6 Cupertino Store -
(PROPOSED) Revised Objective: Implement the Cupertino Store plan, which will be adopted by
Council as part of the current City Work Program Item "Cupertino Store at Chamber of
Commerce". This would include identifying a location if one is not identified in fiscal year 2021-
2022. Fine Arts Commission will create a plan to select items and designs for the Store. Fine
Arts Commission will solicit designs from the community to represent the characteristics of
Cupertino.The store items will be for sale to the public, and also available for exchange
purposes for formal delegations to and from the City, with an at-cost charge structure for the
latter purposes.

#15 Senior Strategy: Objective: Address the needs of seniors in collaboration with the City
Council and Commissions. Needs to address include technology resources, housing, food
supply, transportation, and mental and physical health and wellbeing.
• Conduct a in-depth survey of Senior service needs as proposed by Age-Friendly
Cupertino in order to access the needs of the “missing middle”: seniors who don’t use
the Senior Center or qualify for the West Valley Community Services
• Address the service needs of seniors who choose to age at home, since they cannot
afford a pricey senior center with ever rising rents.
• Elder Abuse Prevention. Financial Prevention for Elder Homeowners

Objective: Explore solutions for homeless and housing insecure students. Assist, as appropriate
in, the long-term development of De-Anza student housing. Investigate partnership with De
Anza on student housing and transportation solutions.
• Re-start the home share program, which was run by Catholic Charities, but paused in
late 2020
• Explore BMR or middle-income housing funded by the $890M bond measure, such as
on campus or off campus.

#28 Gun Safety Storage Ordinance
Revised Objective: Research best practices for safe gun storage from neighboring jurisdictions.
Adopt safe gun storage ordinance to increase public safety for residents.
• Provide information on existing requirements for gun purchase and storage, information
on criminal charges on gun owners when unauthorized users or minors gain access, and
methods of enforcement for proposed city laws.

#30 Student Internship program
Objective: Implement a trial student summer internship program with the City of Medium
7/1/2022 9/30/2022. Cupertino. Initial year will be on a limited basis. If approved, applications
will be sought for one-, two- or three-week internships during the summer, with applications to
be released in mid-July. Internships will be project-focused, with participating City departments
asked to identify a specific project or projects that a student intern can undertake. The
internships will have a common start date, and include an orientation, group activities and exit
interviews.
Alternatively, if the time and resources do not permit the City to run a trial program in the
upcoming summer of the fiscal year (i.e., Summer 2022), Council may form a subcommittee to
share practices for student internships, and to bring a report back to Council at the end of
Summer 2022 with recommendations as part of the initiation of a student internship program in
Summer 2023.
• This kind of internship program builds the pipeline so that more students are interested
in civic services and will consider working for public agency.
• The internship program is open for college students and high school students.
• The internship program could be summer program or year round.
• College interns might be paid a stipend or paid by the hour. Potential funding will be
sought from other organizations, such as CLUSA.

#47 Youth Who Work
Objective: Encourage more youth and young adults in schools to work and also help small
businesses to reduce the burden caused higher minimum wages. For example, the City could
provide $2/hour to compensate local small businesses.
• This program helps relieve the labor shortage for hourly wage workers in our area for
Cupertino businesses.
• Economic Development manager could likely work with a community partner to
administer this program

Homeownership Enhancement Initiative - a study session and more
Homeownership is often the essential step for upward mobility. Cupertino should
improve the percentage of residents who own their homes, rather than rents.
a. Housing Stock Survey - collect statistics on the types of houses, condos, multi-
family homes in Cupertino and how many residents rent or own at what price range.
▪ How many ownership homes are rented out? How many units are
vacant? (Vacancy Tax or Foreigner Ownership Tax or Corporate
Ownership Tax for ownership homes may be considered as a next
step if the data supports it.)
▪ How many homes are purchased by corporations to flip for a higher
price? How many homes are owned by corporations to operate as
rental homes?
b. Community Land Trust - study feasible models of community trust programs in
order to provide long-term homeownership for people with low or limited income..
"A community land trust is an entity that controls the ownership of a property and
is responsible for its stewardship, according to staff. These usually make
homeownership more affordable because the homeowner is buying just the
house, not the land that the property sits on. The homeowners lease the land
long term from the community land trust and agree to sell the home at a
restricted price to keep it affordable in perpetuity, but may be able to realize the
appreciation from improvements they make while living in the house, according
to an explanation by Grounded Solutions Network, a Bay Area-based housing
policy nonprofit."
c. Homeownership Assistance Program - down payment assistance, or shared-
equity down payment assistance, such as Empower Homebuyers program by
Housing Trust SV or Landed.com, and education programs for path to
homeownership.
d. Incentives for development projects to create more ownership homes ,
rather than rental homes.
