BACKGROUND
On January 25, 2006, the City published a Request for Proposals for Design, Project
Management and Construction Management Services for the Stevens Creek Corridor Park
proj ect.
Two proposals were receiyed on February 23,2006 in the City Clerk's Office before the
5 :00 p.m. deadline. They were submitted by the San Jose office ofHNTB Corporation and
the San Francisco office of Swinerton Builders.
On March 15, 2006, both HNTB and Swinerton attended interviews with a selection panel
in which they presented their respective firms proposals to manage the complex corridor
and creek project.
ANALYSIS
The HNTB interview was strong and very well receiyed by the panel. Members of the
HNTB team had direct, relevant, and extensiye experience with the Army Corps of
Engineers and the California Department ofFish and Game, two yery important regulatory
agencies inyolyed in this project. Following seyeral days of deliberation and checking
references, HNTB was adyised that their proposed team was deemed highly qualified and
ideally suited to execute the various portions of work in the corridor project.
This particular project is very complex with various types of work spread over a large area
ofthe park. As such, it is essential that a small group of professionals be involved in
every aspect of the work, including civil and architectural design, value engineering, cost
estimating, alternative use analyses, construction scheduling, permit application, material
reuse analyses, project management, and construction management.

HNTB, in conjunction with the primary members of the existing master plan team, and
some additional sub consultants, will provide all of these services through several and yet
to be determined phases of design and construction.
HNTB will also coordinate the remaining work in the preparation of the CEQA
documents, responses to comments resulting rrom public review, the preparation of the
mitigation docurnents as may be necessary, and the coordination with the water district in
the applications for the yarious agency permits.
HNTB will proyide architectural design and value engineering for approximately nine
different buildings contemplated in the master plan, including the enyironmental
classroom, two maintenance buildings, three sets of restrooms, and some minor upgrades
to the existing 4- H facilities.
HNTB will be initially tasked, following Council approval of the recommendation in this
staff report, to assemble the necessary construction documents to enable the City to bid
work on the creek restoration in the late fall ofthis year, if the necessary permits can be
obtained. This early work, if accomplished, will provide an excellent time period for the
new creek banks to become stable with new growth before the creek is diverted into them
later in 2007.
This combination of services will result in a higher fee as a percentage ofthe project
budget of fee than would be expected of a design service only. It is anticipated that
HNTB's fee will approach 20% of the anticipated 4.0 to 4.5 million-dollar project budget.
However, these services are all inclusive of design, plans and specifications, and
construction management. Typically the percentage for these combined services for a
project of this magnitude would be rrom 25% to 30% so the cost is within the normal range
for these services.
It should be noted that this initial agreement with HNTB would be the first of at least two
parts. Staff is only recommending encumbering the amount not to exceed $400,000 until
more specific information regarding additional grant funding ayailability, project priorities,
and workflow is better understood by the entire consultant and City project management
team.

FISCAL IMPACT
Adoption of this resolution will result in the encumbrance of $400,000 rrom the Steyens
Creek Corridor Park fund account 427-9112.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO

WHEREAS, the City Council has been presented a proposal for initial design,
project management and construction management services for the Stevens Creek
Corridor Park; and
WHEREAS, HNTB Corporation has the necessary expertise, skill and resources
to perfoÌm the design, project and construction management services required,
NOW, THEREFORE, LET IT BE RESOLVED, that the City Council of the City
of Cupertino hereby authorizes the City Manager to negotiate and execute said initial
design, project and construction management services agreement, in an amount not to
exceed $400,000, on behalf of the City of Cupertino.
