Res. 98-165 Contingent on Taxes RESOLUTION NO. 98-165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO STATING THAT THE ANNEXATION OF THE RANCHO RINCONADA AREA IS CONTINGENT UPON THE VOTERS AND LANDOWNERS AGREEING TO THE EXTENSION OF CITY TAXES AND FEES WHEREAS, the City Council is considering the annexation of the area known as Rancho Rinconada. For purposes of this resolution the area known as "Rancho Rinconada" is described as the unincorporated area generally bounded by Miller A venue, Stevens Creek Boulevard, Lawrence Expressway, Bollinger Road, and Tantau Avenue, commonly referred to as Loree Estates and Rancho Rinconada, and consisting of 324 acres ofland; and WHEREAS, such an annexation would necessitate the extension of existing taxes and fees currently imposed in Cupertino to the Rancho Rinconada area; and WHEREAS, Proposition 218, the "Right to Vote on Taxes Act" adopted by California voters on November 5, 1996, appears to require that a vote be held to extend existing city taxes and fees to areas which may be annexed. NOW, THEREFORE, BE IT RESOLVED that it is the position of the City Council of the City of Cupertino that the city will not consider annexation of the Rancho Rinconada area unless the voters and/or property owners in the area vote to have existing city taxes and fees extended to them upon annexation.
