RESOLUTION NO. 99-011
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
RECEIVING DECLARATION OF MAIL BALLOT RESULTS RELATED TO THE STORM DRAIN
SERVICE FEE LEVY IN RANCHO RINCONADA AREA
JANUARY 4,1999
WHEREAS, the City of Cupertino conducted a mail ballot for the purpose of submitting a
question to the property owners of the Rancho Rinconada related to levy of stonn drainage service fees
upon the annexation of that area;
-WHEREAS, the Rancho Rinconada area is east of the City, generally bounded by Miller Avenue,
Stevens Creek Boulevard, Lawrence Expressway, Bollinger Road, and Tantau Avenue, and consisting of
about 324 acres ofland (Exhibit A).
WHEREAS, said mail ballot was conducted and the final date for submitting a ballot was at the
close ofthe public hearing on this item, January 4, 1999; and
WHEREAS, the City Clerk of the City of Cupertino has canvassed the returns of said mail ballot;
and has certified that the attached is a full, true and correct statement of the votes cast at said mail ballot;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino hereby
receives the Certificate of Mail Ballot Results, Stonn Drainage Service Fee Levy in Rancho Rinconada
Area, January 4, 1999.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cupertino this
4th day of January, 1999, by the following vote:

declare that a mail ballot was conducted in the City of Cupertino for the purpose of
submitting to the property owners ofthe Rancho Rinconada area the following matter:
Do you approve the extension of the storm drainage service fee on your property
in the event this property is annexed to the City of Cupertino?
That the official canvass ofthe returns and said mail ballot was conducted by the
office of the City Clerk of the City of Cupertino; and that the statement of votes cast
listed below shows the whole number of votes cast for and against this question, and that
the totals shown are true and correct.
