Dear Ms. Sclu'nidt:
It is time again to prepare for tlie filing of tlie City of Cupertino's February 2017 annrial state mandated
cost claims. All of the mandates filed last year are reimbursable for fiscal year 2015/16. The latest
State budget appropriated $48,592,000 for payment of mandates filed from 2005/2006 tl'nougli
2014/2015. DuringlastfiscalyeartheStateController'sOfficecontinuedtomakepaymentsfor
mandates prior to 2004/2005 fiscal year. Although the State still owes for other back years, these
payments continue to be a welcome sign that tlie State is paying wliat they owe the City plus inte,rest for
mandates previously filed.
Tliis year's state budget continued to suspend tlie mandates previously suspended in other budget years.
This includes California Public Records Act (CPRA) along witl'i Absentee Ballots, Mandate
Reimbursement, and Local Recreational Areas: Background Screenings as well as the following
mandates in tlie Police and Fire Depaitments. All other mandates filed last year are still available to file
for tliis claiming period.

Due to the suspension of tlie above mandates in the State Budget Act, tliey are not funded for the
2015/2016 fiscal year. Therefore, tl'ie City is no longer required to follow the reqriirements of tlie
mandates listed above. This is due to Goveri'u'nent Code Section 17581 which states tliat the Legislature
may put a 0 (zero) appropriation in the State Budget for a recognized state mandated program. When
this is done, it makes tliat statute suspended and optional to tlie City for tliat fiscal year. Tlie programs
above, wliich were set aside by tlie Coinmission, are also no longer reimbursable.
Costs of Services
David Wellhouse & Associates, Inc. will prepare and file tl'ie City of Cupeitino's February 2017 claims.
These claims are for fiscal years 2015/2016 claims for a fixed fee of $ 4,000.00. Our fee for tlie
preparation and filing of the City's February 2017 claims includes all time and expenses necessary to
prepare and file the City's claims. Tliis fixed fee is due upon tlie submission of claims to the State
Controller's Office on or before February 15, 2017.
