Mutual agreement to postpone Project commencement
The following changes are hereby approved, notwithstanding language in any attachment to the
contrary. Contractor agrees that the amount paid pursuant hereto is full and complete compensation
for the work described herein for each and every entity involved in the project who is being
compensated hereunder and that each and every claim for any cost for schedule impact such as for
delay, impact, inefficiency, acceleration, extended overhead, increased supervision, compression and
all other factors affecting cost arising from the subject of this Change Order are hereby released and
waived by Contractor and all Subcontractors and Suppliers at all tiers.

Regnart Road Improvements Phase 1 Project
CCO #1-Attachment A
This Attachment A to Construction Change Order (CCO) #1 modifies the terms of the
Contract Documents concerning the construction of Regnart Road Improvements Phase
1 Project. Based on mutual agreement to postpone commencement of the Project to 2024,
City and Contractor have agreed that CCO #1 will modify the Contract Documents as
follows:
1. The Notice to Proceed issued on July 27, 2023 is hereby rescinded.
2. The Project is hereby postponed until 2024, as further specified below, to
accommodate long lead times for materials and California Department of Fish
and Wildlife permit requirements.
3. The mutually-agreed upon postponement is undertaken for the convenience of
the parties and does not entitle the Contractor to any additional compensation.
4. Contractor agrees to be bound by the price and terms of the bid Contractor
submitted on June 15, 2023 and by the Contract signed on July 21, 2023, subject
only to the changes set forth pursuant to the terms of this CCO #1.
5. The parties will reconvene on January 8, 2024, unless rescheduled by mutual
agreement, to discuss the revised Project schedule, including timing for issuance
of two Notices to Proceed, the first for submission and review of Construction
Project Schedule, Structural Steel, Paint, Reinforcing Bar, and Precast Concrete
Lagging submittals required for material orders with long lead times, and the
second for onsite commencement of Work on the Project.
6. The first Notice to Proceed will specify the timing and requirements for the
initial submittal process to begin on or about January 15, 2024, or as otherwise
agreed upon during the meeting scheduled pursuant to Section 5, above. Because
these submittals are on the critical path for timely completion of the Project, the
first Notice to Proceed may also specify reasonable deadlines for submission of
acceptable submittals and may provide for assessment of liquidated damages in
the event of Contractor’s unexcused delay in complying with the submittal
requirements.
7. The second Notice to Proceed will authorize commencement of construction on
or about April 15, 2024, or as otherwise agreed upon during the meeting
scheduled pursuant to Section 5, above.
8. By executing this Attachment 1 to CCO #1, Contractor acknowledges that this
postponement is for mutual convenience and Contractor expressly waives any
entitlement to additional compensation for postponement of the Project except as
specified herein.
9. All capitalized terms that are not otherwise defined herein have the meaning
provided in the Contract Documents for the Project, including, but not limited to,
the definitions provided in Article 1 of the Project General Conditions.
10. Except as expressly stated herein, all other terms and conditions of the Contract
Documents remain in full force and effect.
