BACKGROUND: On August 23, 2008, the City verified a complai11t that 21 trees were removed without permits- arow1d t11e perimeter of a11 existlll.g office buildll1g located at 10201 Torre Avenue (see photos 1?elow). The trees removed ll1clude Coast Red\vood, Liquidamber and Or11ame11tal Pear trees (see Exhibit A, sheet L-2). The property OvV11er is requesti11g a retroactive tree remo'val permit for the .ull.permitted tree removals and permission to relnove five additional pear trees. 1-1 TR-2008-13 Page 2 October 28,2008 DISCUSSION: Snell and Company recently acquired the office building on the project site. They intend to make minor landscaping improvements with additional flowering trees, new groundcover and shrubs (see Exhibit C, Sheet L-1). According to the property owner, many of the existing trees onsite appear unhealthy and some were growing too close to the building. An arborist report has been submitted providing additional justification for the removal of the 21 trees (See Exhibit B). The applicant has submitted a landscape plan and is proposing to replace the removed trees with five 36" box Coast Redwood trees and thirty-eight 24" box trees including Crape Myrtle, Coast Live Oak, Chinese Pistache, Japanese Zelkova and Strawberry trees (see Exhibit C, Sheet L-1). Staff has reviewed the proposed landscape plan. While the plan does not include replacing the same number of the removed Coast Redwoods, the inclusion of Coast Live Oak trees is a suitable substitute and will add native species to the site. Staff recommends approval of application TR-2008-13. 1-2 TR-2008-13 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 6534 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING THE REMOVAL OF TWENTY-SIX TREES, INCLUDING COAST REDWOOD, ORNAMENTAL PEAR AND LIQUID AMBER TREES AT 10201 TORRE AVENUE SECTION I: PROTECT DESCRIPTION Application No.: Applicant: Location: TR-2006-13 Brad LaRue, Snell and Company 10201 Torre Avenue SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application to retroactively approve the removal of twenty-one (21) trees including Coast Redwood, Ornamental Pear and Liquidamber trees and the removal of 5 additional Ornamental Pear trees; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more public hearings on this matter; and NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, application for Tree Removal is hereby approved and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application TR-2008-13, as set forth in the Minutes of the Planning Commission Meeting of October 28, 2008 are incorporated by reference herein. SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROV AL ACTION Approval is based on Exhibit C titled "Landscape Plan, sheet L-1" dated September 25, 2008 for this project, except as may be modified by the conditions contained in this resolution. TREE REMOV AL & REPLACEMENT The retroactive approval allows for the previous removal of 21 trees including eight Coast Redwood, nine Ornamental Pear and one Liquidamber tree; the removal of 5 additional Ornamental Pear trees as indicated on Exhibit A titled "Existing/Tree Removal Plan, sheet L-2" dated October 7, 2008. They shall be replaced by five 36- inch box Coast Redwood trees, four 24" box Coast Live Oak trees, and 34 additional 24-inch box trees as illustrated in Exhibit D titled "Landscape Plan, sheet L-1" dated September 28, 2008. 3. TREE PROTECTION BOND AND TREE MONITORING A tree protection bond in the amount of the value of the new replacement trees to be planted and the associated planting of trees shall be provided. The applicant shall contracted with a ISA certified arborist to monitor the health of the new trees and provide an annual report to the Community Development Director for a two year period after planting. After a two-year period, the applicant shall submit a letter by a certified arborist verifying that the trees are healthy. At that time, the tree bond will be released. 4. NOTICE OF FEES, DEDICATIONS, RESERV A TIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions.
