7005OWNER'S CERTIFICATE We hereby certify that we are the owners or have some right, title or interest in and to the real property included within the subdivision shown upon the hereon map; that we are the only persons whose consent is necessary to pass a clear title to said real property; that we hereby consent to the making of said map and subdivision as shown within the blue border line, and we hereby offer for dedication to public use all streets and portions of streets not heretofore existing as shown upon the hereon map within said subdivision and also dedicate to public use easements for any and all public uses under, upon and over said streets and said portions thereof. We also hereby dedicate to public use easements for any and all utility facilities including poles, wires and conduits, and all appurtenances to the above, under, upon or over those certain strips of land lying between the front and/or sidelines of lots and the dashed lines each designated as P.U.E. (Public utility Easement). The above mentioned easements to be kept open and free from buildings and structures of any kind except public utility structures, irrigation systems and appurtenances thereto, lawful fences, and all lawful unsupported roof overhangs. Easements for Landscaping as shown on Lots 1, 3 and 4, and designated as L.E. (Land- scape Easement) are not dedicated to public use, but are the exclusive easements for the benefit of those Lots adjacent to said easements. Maintenance, care, and repair of said easement areas are the responsibility of those Lots to which said easements are appurtenant. Easement for ingress and egress as shown on Lots 2 and 3 designated "Ingress and Egress Easement for benefit of Lots 2 & 3, is not dedi- cated to public use, and is an easement for ingress and egress, and for the install- ation and repair of private utilities. Maintenance of said easement as to the surface and landscaping thereof, and private utilities therein, is the responsibil- ity of Lots 2 and 3. No activity of any kind that would impair or restrict said easement or the rights of ingress and/or egress thereover of those entitled thereto will be permitted. We hereby dedicate to public use and offer to dedicate to the City of Cupertino slope easements designated as "Slope Fasement" for the purpose of constructing and maintaining cut or fill slopes or retaining walls, said easements to be open and free from buildings and structures of any kind except public service structures, lawful fences, irrigation lines and sanitary sewer structures. We hereby dedicate to public use a strip of land delineated and designated as `Emergency Access Easement „ for emergency access purposes only. Said easement to be kept open and free from buildings and structures of any kind except public service.structures,lowful fences, irrigation systems,ond all lawful unsupported roof overhangs. There is also shown on the hereon map an easement for storm drainage purposes designated as P.S.D.E. (Private Storm Drainage Easement) for the installation and maintenance of private storm drainage facilities. This easement is to be kept open and free from buildings and structures of any kind except utility structures, irrigation systems and appurtenances thereto, lawful fences and all lawful unsupported roof overhangs. The maintenance, repair and/or replacement of private storm facilities shall be the sole responsibility of the property owner whose property the facilities benefit. This easement shall be created by appropriate covenants, conditions and restrictions. Said easement are not offered nor are they accepted for dedication by the City of Cupertino. We also hereby dedicate to the City of Cupertino an easement for scenic purposes designated as Scenic Easement to be kept openand free from buildings and structures of any kind except public service structures, irrigation systems, sanitary sewers , private ingress - egress structures, private storm drainage facilities, and emergency access structures.
