SUBJECT: TREE REMOVAL PERMIT ACTION LETTER - Application TR-2008-03:
This letter confirms the decision of the Director of Community Development, given on
May 27, 2008, approving a tree removal permit to remove three (3) Eucalyptus trees
with a (50, 53 and 49-inch circumference) located in a planter bed on the south side of
the parking lot, identified as Tree(s) 1,2 and 3 in the applicant's plan set, with the
following conditions:
1. APPROVED PROTECT
This approval is based on the tree removal plan set and Commercial Tree Care &
Landscape certified arborist evaluation submitted by the applicant, except as
may be amended by conditions in this resolution.
2. TREE REPLACEMENTS
The applicant shall be required to plant three (3) 24-inch box Italian Cypress trees
on the property as shown on the approved plans. The replacement trees shall be
planted within 60 days of the approval of this application.
Staff has made the findings necessary to grant the tree removal permit in accordance
with Section 14.18.180 of the Protected Trees Ordinance. Please note that an appeal of
this decision can be made within 14 calendar days from the date of this letter. If this
happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission and the tree cannot be removed until a final decision on the
appeal has been made. If no appeal is made within the appeal period, the tree may be
removed after Monday June 9, 2008.

Assignment:
Assess and report on the health, stability and structural integrity of three (3) specimens of Silver
Dollar Gum Eucalyptus, Eucalyptus polyanthemos located at the end of the court near 10250
Yoshino Place Cupertino, California.
Observations:
The subject specimens are located in a raised planter adjacent to a wooden fence at the end of
the court. Two similar specimens located eleven (11) feet and twenty (20) feet respectively
along the fence line to the east of specimen 1 previously have been removed.
Specimen 1, the smallest of the subject group, is located nine (9) inches north of the property
line fence and nineteen (19) inches south of the paved Yoshino Place roadway. Specimen 1
measures fifty (SO) inches in circumference at forty-eight (48) inches above grade and is
approximately thirty-five (35) feet in height. Specimen l's canopy is approximately twenty (20)
feet in diameter and overhangs both the Yoshino Place roadway and the neighbor's back yard.
Specimen 1 was previously topped at approximately twenty (20) feet above grade and,
consequently, in excess of forty (40) percent of its canopy stems from old water sprouts that
are susceptible to limb failure if not regularly thinned and lightened.
Specimen 2, the middle tree in the subject group, is located eighteen (18) inches north of the
property line fence and thirteen (13) inches south of the paved Yoshino Place roadway.
Specimen 2 measures fifty-three (53) inches in circumference at forty-eight (48) inches above
grade and is approximately thirty-eight (38) feet in height. Specimen 2's canopy is also
approximately twenty (20) feet in diameter and, like Specimen 1, overhangs both the Yoshino
Place roadway and the neighbor's back yard. Specimen 2 also was previously topped at
approximately twenty (20) feet above grade and shares the same structural weaknesses as
described above for Specimen 1.
